"1. Heard learned counsel for the applicants and learned A.G.A for the State.
2. The present application under Section 482 Cr.P.C/528 B.N.S.S has been preferred with the following main relief: "i. Quash Charge Sheet No.01 dated-20.09.2022 filed in F.I.R. No. 0040 of 2022 dated-25.08.2022 U/S 498-A, 323, 504, 506, I.P.C & 3/4 D.P. Act. P.S.-Mahila Thana, District-Barabanki and the summoning order dated- 30.01.2023 passed by the court of Additional Chief Judicial Magistrate Court No. 48 Barabanki in criminal case no. 2081/2023 State Vs. Ravi Kant Srivastava & others as contained in Annexure No. 1 & 2 to this Petition. ii. Quash the entire proceedings of criminal case no. 2081/2023 State Vs. Ravi Kant Srivastava & others pending before the Additional Chief Judicial Magistrate Court No. 48 Barabanki."

The brief facts of the present case are that the respondent no. 2 has lodged an FIR dated 25.8.2022 against six named accused persons and 2-3 unknown persons including the present applicants alleging therein that she was harassed by her husband and in-laws for dowry demand and ill-treated mentally and physically both. The Police after the investigation has filed the charge-sheet against the applicants no. 1 to 3 i.e. husband, father-in-law and mother-in-law, respectively of respondent no. 2 and no charge sheet has been filed against the other named and unknown persons in the FIR. The court concerned has taken cognizance and issued summons against the applicants without application of mind and feeling aggrieved by the same, the present application has been filed. 3. Learned counsel for the applicants has submitted that during the pendency of the criminal case, the parties have arrived at a decision that they will file a suit for mutual 2 A482 No. 4236 of 2025 divorce under Section 13-B of Hindu Marriage Act, 1955. The suit for mutual divorce has been filed by the parties on 30.9.2024 wherein the conditions no. 7(अ) and 7(स) are relevant and the same are quoted hereinbelow: "7 (अ) - यह िक ्ऺथम प्ष ने ि्षतीयप्ष से अपने जीवन यापन िववाह आिद के िलए एक मुश्त भरण पोषण व समस्त स््ऴीधन के रूप में धनरािश मु०-16,10,000/- (सोलह लाख दस हजार) रुपये दो िकश्तों में ्ऺथम िकश्त मु० 8,10,000/- (आठ लाख दस हजार) जिरये बैंक ्ऱाफ्ट संख्या 255560 िदनांक 27-09-2024 के माध्यम से आज मुकदमा दािखला के समय ्ऺाप्त कर िलया है तथा दूसरी िकश्त मु० 8,00,000/- (आठ लाख ) रुपये जिरये बैंक ्ऱाफ्ट उ्व मुकदमे में बयान के समय िनणर्य से पूवर् ्ऺाप्त कर लेगी उ्व रकम की अदायगी के बाद ्ऺथम प्ष का कोई भी लेन देन ि्षतीयप्ष रिवकान्त ्शीवास्तव से नहीं रहेगा। 7 (स)- यह की ्ऺथम प्ष ्षारा ्शीमान जी के सम्ष दािखल भरण पोषण ्शीमती िनिध ्शीवास्तव बनाम रिवकान्त ्शीवास्तव वाद सं०-1432/2022 धारा 125 जा० फौ० थाना 1 बदोसराय व न्यायालय िसिवल जज (सी०िड०) कोटर् संख्या 38 बाराबंकी के सम्ष लिम्बत ्शीमती िनिध ्शीवास्तव बनाम रिवकान्त ्शीवास्तव आिद वाद संक्पड 37/2022 धारा 12 घरेलू अिध० तथा न्यायालय अपर मुख्य न्याियक मिजस््िेट कोटर् संख्या 48 बाराबंकी सरकार बनाम रिवकान्त आिद अप० संख्या 40/2022 धारा 498A,323,504,506 I.P.C. व 3/4 D.P.Act थाना मिहला थाना तथा ि्षतीय प्ष के िपता की ओर से दािखल अिभयोग न्यायालय अपर िसिवल जज (जू० िड०) कोटर् संख्या ि्षतीय सीतापुर अिनल कु मार ्शीवास्तव बनाम रमेश चन्द आिद पिरवाद सं०- 2769/2022 323,504 I.P.C. थाना महमूदाबाद सीतापुर को यह दावा दािखल करने के उपरान्त उभय प्ष अपने अपने मुकदमे को समाप्त करा लेंगे यिद कोई प्ष दावे में विणत सुलह समझौते के आधार पर िनरस्त कराने के हीलाहवाली करता है अथवा सहयोग नहीं करता है तो दूसरे प्ष को यह अिधकार होगा िक वह उ्व सुलहनामा के ' आधार पर उ्व मुकदमों को समाप्त करा लेवेगा ।"

It is further submitted that the applicant no. 1, as per the condition 7(अ), had given a demand draft of rupees eight lacs and ten thousand to the respondent no. 2 and after receiving the same, as per the condition of para 7(स) she has never proceeded with any further by moving applications in the pending cases except by moving an application in case registered under Section 125 Cr.P.C.. 5. It is further submitted that the applicants, as per the condition 7(अ), have already been prepared a demand draft dated 27.3.2025 of rupees eight lacs but since then the respondent no. 2 is not coming for recording her statement. 6. It is further submitted that the said para 7(स) of conditions provides that in case, the parties would not proceed further for withdrawal of the cases against each other or are not cooperating with each other then the second party has a right to withdraw these cases on its own.
7. On the other hand, learned A.G.A. has opposed the case but unable to dispute the submissions made by learned counsel for the applicants. 8. The matter requires consideration. 9. Issue notice to the respondent no. 2. 10. Steps be taken within a week. 11. List this case in the 3rd week of July, 2025. 12. Office is directed to submit service report by the next date of listing. 13. Till the next date of listing, the proceedings of the aforesaid case shall remain stayed so far as the applicants are concerned."
3. In pursuance of the order dated 05.12.2025, the applicant no. 1 Ravi kant 3 A482 No. 4236 of 2025 Srivastava as well as respondent no.2 are present before this Court. They are being duly identified by their respective counsels. The Aadhar Card No.of applicant is 7956 89770872 and respondent no. 2 is 822844188603 respectively.

As it is admitted by respondent no.2 that earlier Rs.8,10,000/- (Eight lacs ten thousand) was received through Bank Draft No.255560 dated 27.9.2024 and it was also decided that rest of the amount of Rs.8 lacs of the alimony be paid after recording their statement in the divorce proceedings and before the judgment. The draft of Rs.8,10,000/- bearing No.257351 dated 09.12.2025 in the name of private respondent is also placed before this Court. The photocopy of the same is annexed with the supplementary affidavit filed by the applicant and original is handed over to the private respondent and she also requested that proceedings may be quashed, she has no objection and she also undertakes that she will appear before the family court in a proceedings pending under Section 13-B of Hindu Marriage Act for conclusion of the same.

Considering the submissions of learned counsel for the parties, going through the contents of the application as the issue has already been resolved between the parties and the conditions are already mentioned in the application filed before the family court under Section 13-B of Hindu Marriage Act as all the amount of alimony of Rs.16,10,000/- (Sixteen lacs ten thousand rupees) has already been paid to the private respondent and she has no objection for quashing of the proceedings.
6. Accordingly, the present application is allowed. The entire proceedings of charge sheet No.01 dated-20.09.2022 filed in F.I.R. No. 0040 of 2022 dated-
25.08.2022 U/S 498-A, 323, 504, 506, I.P.C & 3/4 D.P. Act. P.S.-Mahila Thana, District-Barabanki and the summoning order dated- 30.01.2023 passed in criminal case no. 2081/2023 State Vs. Ravi Kant Srivastava & others as contained in Annexure No. 1 & 2 to this Petition as well as the entire proceedings of criminal case no. 2081/2023 pending before the Additional Chief Judicial Magistrate Court No. 48, District Barabanki are hereby, quashed.
7. It is also expected from the private respondent that she will cooperate in the proceedings pending before the family court under Section 13-B of the Hindu Marriage Act. In case, she does not cooperate, then it would amount to contempt and it will be open to the parties to take appropriate action under the provisions of Contempt of Courts Act.
