1. Heard Ms. Sukhmani Singh, Advocate, holding the brief of Ms. Pushpila Bist, learned counsel for the petitioners and learned Additional Chief Standing Counsel for the State.

2. The instant writ petition has been filed by the petitioners seeking relief for quashing the orders dated 14.02.2006 and 23.12.2006, passed by the Estate Officer, U.P. Government, whereby the representations of the petitioners dated 02.01.2006 and 16.11.2005 were rejected.

3. The brief facts of the case, shorn of unnecessary details, are that petitioner no.1 was engaged and working as Telex Messenger, and petitioner no. 2 was working as Farrash. Both posts are Group-D posts. In the Estate Department, the posts of Telephone Attendant, Telex Messenger and Farrash are Group-D posts in the same pay scale.

4. It is the case of the petitioners that applications were invited on 09.10.2001 for change of designation of the posts on which the petitioners were working to that of Telephone Attendant. The petitioners, being duly qualified, submitted their applications for change of designation. In furtherance of the said exercise, the department constituted a Departmental Selection Committee, which, in its meeting dated 25.06.2004, considered the names of the candidates and found only two candidates, namely, Sri Ram Sharan Singh (Farrash) and Sri Bhairav Singh Tomar (Farrash), eligible for being designated as Telephone Attendants. Accordingly, they were designated as Telephone Attendants by order dated 02.07.2004. 2 WRIA No. 3766 of 2006

5. The petitioners, though considered in the selection, were not selected as their names were not recommended by the Departmental Selection Committee. Subsequently, in the year 2005, the cadre of Telephone Attendant was declared a dying cadre. In the meantime, two posts of Telephone Attendant became vacant, one on account of the superannuation of Sri Chandra Prakash on 30.06.2005 and the other on account of the death of Sri Ranjeet Singh on 31.08.2005.

6. The petitioners filed Writ Petition No. 7307 (S/S) of 2005 claiming designation of the post of Telephone Attendant on account of the said vacancies. The writ petition was disposed of vide judgment and order dated 16.11.2005, with a direction to the Estate Officer, U.P. Government, to decide the representations of the petitioners seeking change of designation from the post of Farrash to the post of Telephone Attendant.

In furtherance of the aforesaid judgment and order dated 16.11.2005, the representation submitted by petitioner no.1, dated 02.01.2006, was duly considered and rejected vide order dated 14.02.2006 and the representation dated 16.11.2005 of petitioner no.2 was rejected vide order dated 23.12.2005. These orders have been challenged in the present writ petition.

The case of the respondents is that since the post of Telephone Attendant was declared as a dying cadre in the year 2005 itself, there was no occasion to consider the petitioners' request for being given the designation of Telephone Attendant. In fact, the Finance Department approved the proposal for the creation of 29 posts of Telephone Operator on 28.09.2005, after taking into consideration that the cadre of Telephone Attendant had been declared as a dying cadre. The order to that effect was issued on 19.07.2007, which has been annexed with the supplementary counter-affidavit as Annexure No. CA-1.

A bare perusal of the Office Memorandum dated 19.07.2007 indicates that 29 posts of Telephone Attendant were abolished and those Telephone Attendants working on these posts were promoted to the newly created 29 posts of Telephone Operator in the pay scale of Rs.3050-4590. The Office Memorandum dated 19.07.2007 is reproduced hereinbelow :- अधोह(cid:293)ता(cid:87)री को यह कहने का िनदेश (cid:631)आ है िक रा(cid:269)यपाल महोदय चालू 3 WRIA No. 3766 of 2006 िव(cid:485)ीय वष(cid:259) 2007-08 म(cid:517) रा(cid:269)य स(cid:286)पि(cid:485) िवभाग, उ(cid:485)र (cid:352)देश के िनय(cid:281)(cid:347)णाधीन िविभ(cid:281)न इकाईय(cid:523) के िलए सृिजत टेलीफोन अटे(cid:281)डे(cid:281)ट के पद(cid:523) पर काय(cid:259)रत कािमक(cid:523) की उपयोिगता वत(cid:259)मान पिरि(cid:293)थितय(cid:523) एवं आव(cid:291)यकता(cid:603) के अनु(cid:628)प न रह पाने के फल(cid:293)व(cid:628)प टेलीफोन अटे(cid:281)डे(cid:281)ट के 29 पद (वेतनमान (cid:627)० 2550 - 3200) को समा(cid:282)त करते (cid:631)ए इन पद(cid:523) पर काय(cid:259)रत टेलीफोन अटे(cid:281)डे(cid:281)टस की (cid:352)ो(cid:281)नित के िलए टेलीफोन आपरेटर के 29 पद वेतनमान (cid:628)पया 3050 - 4590 म(cid:517) सृिजत िकये जाने की (cid:293)वीकृ ित िन(cid:286)नांिकत शत(cid:523) एवं (cid:352)ितब(cid:281)ध(cid:523) के अधीन (cid:352)दान करते ह(cid:520)- (1)- उ(cid:472) पद शासनादेश जारी होने की ितिथ से अथवा इन पद(cid:523) पर तैनाती ितिथ से जो भी बाद म(cid:517) हो, आगामी वष(cid:525) तक आव(cid:291)यकतानुसार िनर(cid:281)तर बने रह(cid:517)गे। (2)- टेलीफोन अटे(cid:281)डे(cid:281)ट संवग(cid:259) को मृत संवग(cid:259) घोिषत िकया जाता है। टेलीफोन अटे(cid:281)डे(cid:281)ट के समा(cid:282)त (cid:631)ए उ(cid:472) पद(cid:523) के अितिर(cid:472) अवशेष पद(cid:523) पर काय(cid:259)रत कािमक(cid:523) के सेवािनवृ(cid:485), मृ(cid:277)यु अथवा (cid:277)याग प(cid:347) आिद के पिरणाम (cid:293)व(cid:628)प िर(cid:472) (cid:631)ए पद समा(cid:282)त होते जाय(cid:517)गे। (3)- टेलीफोन आपरेटर के सृिजत उ(cid:472) 29 पद(cid:523) पर चयन/(cid:352)ो(cid:281)नित िवभाग म(cid:517) काय(cid:259)रत टेलीफोन अटे(cid:281)डे(cid:281)ट, जो टेलीफोन आपरेटर के पद(cid:523) की िनधा(cid:259)िरत शैि(cid:87)क एवं तकनीकी अह(cid:259)ताय(cid:517) रखते ह(cid:523), म(cid:517) से ही अनुपयु(cid:472) को अ(cid:293)वीकार करते (cid:631)ए (cid:269)ये(cid:505)ता के आधार पर चयन सिमित (cid:497)ारा चयनोपरा(cid:281)त (cid:352)ो(cid:281)नत िकये जायेग(cid:517)। (4)- उ(cid:472)ानुसार रा(cid:269)य स(cid:286)पि(cid:485) िवभाग समूह "ग" एवं "घ" सेवा िनयमावली म(cid:517) संशोधन बाद म(cid:517) िकया जायेगा। 2- उपरो(cid:472) पद(cid:523) के पदधारक(cid:523) को शासन (cid:497)ारा समय-समय पर (cid:293)वीकृ त दर(cid:523) पर महंगाई तथा अ(cid:281)य भ(cid:485)े जो भी िनयमानुसार अनुम(cid:281)य ह(cid:523), देय होग(cid:517)। 3- उपरो(cid:472) के स(cid:286)ब(cid:281)ध म(cid:517) होने वाला (cid:498)य चालू िव(cid:485)ीय वष(cid:259) 2007-08 एवं आगामी वष(cid:525) के आय-(cid:498)यक के अनुदान सं(cid:263)या- 59 के अ(cid:281)तग(cid:259)त लेखा शीष(cid:259)क - 2052 सिचवालय सामा(cid:281)य सेवाय(cid:517)-आयोजने(cid:485)र-090-सिचवालय एवं अ(cid:281)य काया(cid:259)लय भवन-03-रा(cid:269)य स(cid:286)पि(cid:485) िवभाग के अंतग(cid:259)त सुसंगत (cid:352)ाथिमक इकाइय(cid:523) के नामे डाला जायेगा। 4- ये आदेश िव(cid:485) िवभाग के अशासकीय सं(cid:263)या-ई-8-1260/दस-07 िदनांक 11-7-07 म(cid:517) (cid:352)ा(cid:282)त उनकी सहमित से जारी िकये जा रहे ह(cid:520)।

This Court, while entertaining the present writ petition, passed an order dated 17.08.2007 taking note of the letter dated 14.05.2007 issued by the Estate Department, in which it was indicated that the cadre of Telephone Attendant had not been declared dead and accordingly directed the Estate Officer to be present before the Court 4 WRIA No. 3766 of 2006 on 29.08.2007. In this regard, a clarification has been given in a supplementary counter affidavit filed by the respondents, in which it has been clarified that the decision was taken to declare the post of Telephone Attendant (Group-D) as a dying cadre by the Finance Department on 05.08.2005 and the approval was also granted by the Finance Department on 28.09.2005 for creation of 29 posts of Telephone Operator. The final approval from the higher authorities with regard to the declaration of the cadre of Telephone Attendant as a dead cadre and creation of 29 posts of Telephone Operator could not be obtained immediately, and it was obtained after a lapse of some time, hence, the order with regard to the same could not be issued. Subsequently, when the approval was obtained from the higher authorities, the office memorandum dated 19.07.2007 was issued with the consent of the Finance Department, declaring the cadre of Telephone Attendant as a dead cadre. Thus, the information given under the Right to Information Act to the petitioner, as indicated in the letter dated 14.05.2007, was for the reason that though the decision was taken and the approval of the Finance Department was obtained way back on 28.09.2005, the office memorandum to that effect could only be issued on 19.07.2007.

11. Be that as it may, the fact remains that the cadre of Telephone Attendant has been declared as a dying cadre, which is evident from the Office Memorandum dated 19.07.2007. Hence, at this stage, it cannot be said that the cadre of Telephone Attendant continues to exist after the issuance of the said Office Memorandum.

12. In view of the fact that the cadre of Telephone Attendant is no longer in existence, the relief sought by the petitioners in the present writ petition cannot be granted. Accordingly, the writ petition is dismissed.
