Judgment

1. Heard Sri Gamesh Kumar Gupta, learned Counsel for the petitioners, Sri Hemant Kumar Pandey, learned State Counsel and perused the records.

2. The present petition has been filed for the following main relief(s):- "I. Issue a writ of Certiorari or a writ order or direction in the nature of Writ of Certiorari to quash the order dated 8.1.25 passed by the respondent no.1/Deputy Director of Consolidation, District-Lucknow as well as order dated 20.11.2020 passed by the / respondent no.2 Settlement officer of Consolidation, District - Lucknow, contained as Annexure No.2 and 3 to this writ petition respectively in the interest of justice. II. Issue a writ of Mandamus or a writ order or direction in the nature of Writ of Mandamus commanding the opposite parties to restrain to implead the operation and implementation of order dated 8.1.25 passed by the respondent no.1 / Deputy Director of Consolidation, District - Lucknow as well as order dated 20.11.2020 passed by the / respondent no.2 Settlement officer of Consolidation, District - Lucknow, contained as Annexure No.2 and to this writ petition respectively, in the interest of justice. III. Issue a writ of Mandamus or a writ order or direction in the nature of Writ of Mandamus commanding the opposite parties to restrain to disturb the peaceful possession of petitioner over the land in question in the respect of order dated 8.1.25 passed by the respondent no.1 / Deputy Director of Consolidation, District - Lucknow as well as order dated 20.11.2020 passed by the / respondent no.2 Settlement officer of Consolidation, District - Lucknow, contained as Annexure No.2 and 3 to this writ petition respectively, in the interest of justice."

The brief facts of the case, which are relevant for deciding the present petition, are as under:- (A) The land in dispute relates to Khata Nos. 27 and 124 of Village- Parwar Purab, Pargana and Tehsil-Bijnor, District-Lucknow and during 2 consolidation proceedings co-tenancy rights were claimed by Mewa Lal s/o Shiv Ratan and Ram Bharosey s/o Guru Dayal, over the land in dispute, which is evident from the following paragraphs of instant petition:- "3. That the land of Khata no. 27 and 124 of the Basic Year ( Aadhar Varsh ) are the ancestral property of the petitioners as well as respondent no.3 to 13 of Late Shri Nohari . That Gata no. 459 / 7 , 459 / 2+3 , 496 /3 , 376 /1 of Khata no. 57 , Gata no. 434 / 2 450 / 1 , 372 / 1 of Khata No. 128 , Gata no. 434/1, 449 / 2 of Khata No. 129 , Gata No. 498 / 7 of Khata no. 176 , Gata no. 354 / 2 , 347 , 375 / 2 , 426 / 1 , 434 , 443 /6 , 482 of Khata No. 318 , 3 Gata no. 480 of Khata no. 403 , Gata No. 343 / 3 , 380 / 13 of Khata No. 524 , Gata No. 453 / 5 of Khata No. 647 , Gata No. 546 / 4 546 / 3 546 / 2 546 / 1 of Khata No. 735 , Gata No. 369 / 2 of Khata No. 736 , situated at then Village - Parvar Poorab , Pargana – Bijnor ,then Tehsil and District - Lucknow were recorded either name of Late Shri Mohan Lal son of Nohari or Late Shri Ram Deen son of Nohari or name of both . The copy Khatauni of Fasali Year 1304 is Being Annexed here with as Annexure No. 4 to this Writ petition .

5. That as per Khatauni of Fasli Year 1304 , The Khata No.57 and 128 , 129 , part of 176 , 524 , 647, 635 , 736 are recorded as Jiman ( 4 ) . The detail of Gata No. are given below :- A. Gata no. 459 /7 , 459 / 2+3 , 496 /3 ,376 / 1 of Khata NO. 57 were recorded in the name of Late Shri Mohan Lal and Late Shri Ram Deen . B. Gata No. 434 /2 , 450 /1 , 372 /1 of Khata No. 128 were recorded in the name of Late Mohan Lal . C. Gata no. 434 /1 of Khata No. 129 were recorded in the name of Late Shri Ram Deen . D. Gata no. 343 / 3 , 380 / 13 of Khata NO. 524 were recorded in the name of Late Shri Mohan Lal E. Gata no. 453 / 5 of Khata No. 647 was recorded in the name of Late Shri Ram Deen . F. Gata no. 546 /4 , 546 / 3 , 546 / 2 , 546 / 1 of Khata NO. 735 were recorded in the name of Late Shri Mohan Lal . G. Gata no. 369 /2 of Khata NO. 736 was recorded in the name of Late Shri Ram Deen .

6. That as per Khatauni of Fasli Year 1304 ,Gata No. 449 / 2 of Khata No. 129 and Gata No. 498 /7 of Khata no. 176 ( Garden ) are recorded as Jiman ( 8 ) as Garden in the name of Late Shri Ram Deen and Late Shri Mohan Lal .

7. That as per Khatauni of Fasli Year 1304 , The Khata No.318 and 403 are recorded as Jiman ( 5 ) means such occupant who has occupied the land without obtaining the consent of any person who has the right to enter as an occupant . The detail of Gata No. are given below :-

A. Gata no. 354 /2 , 347 , 375 / 2 , 426 / 1 ,434 , 443 /6 of Khata No. 318 were recorded in the name of Late Shri Mohan Lal and Late Shri Ram Deen. B. Gata no. 480 of Khata No. 403 was recorded in the name of Late Shri Mohan Lal .

8. That the Sabik / Khasra nos .as recorded in the name of name of Late Shri Mohan Lal son of Nohari or Late Shri Ram Deen son of Nohari or name of both as per Khatauni of Fasli Year 1304 had new Nos. That as per Khatauni fasli year 1332 itself Khata no. 61 , 179 , 299 , 706 , 153 325 , 555 606 , 706 , 153 , The name of the Badal were recorded without any order of the competent Authority . whereas the disputed Khata originated from Mohan Lal son of Nohri . The only name of Badal was recorded without any order of the competent Authority and name of brother of Badal were left out without any sufficient reason .The copy of the Khatauni of fasli year 1332 recorded in the name of Badal is being Annexed here with as Annexure No. 6 to this writ petition . It is relevant to submit here that either name of Late Shri Mohan Lal or Late Shri Ram Deen or both name were recorded in Khasra no. 1427 , 1155 , 1399 , 1161 Kha , 1463 , 1216 etc in the Fasli Year 1304 and same Khasra no. were also recorded in the Khatauni of the Fasli Year 1332 and detail are given below :- 5 a. The name of Late Shri Badal was recorded in Khasra nos. 1153 ka , 1154 , 1156 , 1155 , 1226 ,1230 , 1241 of the Khata no. 299 ( Total Area 2 + ½ Bigha ) , in the Khatauni of Fasli Year 1332 . b. The name of Late Shri Badal and Late Shri Shiv Ratan were recorded in Khasra nos. 1213 , 1234 ka, 1257 , 1251 , 1399 ,1433 of the Khata no. 706 ( Total Area 9 + ¼ Bigha ) , in the Khatauni of Fasli Year 1332 . It is also submitted here that there is no change in the Khasra no. from fasli year 1304 to 1332 relating to the Ancestor of petitioners .

That as per Khatauni of Fasli Year 1347 , The name of Guru Dayal was recorded in the Khata No. 128 and said land was self created by the Late Guru Dayal and said fact was duly established by the witness . The copy of the Khatauni of fasli year 1347 recorded in the name Guru Dayal is being Annexed here with as Annexure No. 7 to this writ petition .

11. That as per Khatauni of fasli year 1346 of Khata no. 792 the name of Badal and Shiv Ratan were recorded respectively without any order of the competent Authority . whereas the disputed Khata originated from Mohan Lal son of Nohri . The name of other brother of Badal were left out in the rest of Gata no. .The copy of the Khatauni of fasli year 1347 of khata no. 792 recorded in the name of Badal and Shiv Ratan is being Annexed here with as Annexure No. 8 to this writ petition .

That as per Khatauni of fasli year 1356 , Khata no. 777 and 788 , The name of the Badal and Shiv Ratan were recorded without any order of the competent Authority . whereas the disputed Khata originated from Mohan Lal son of Nohri . The only name of Badal and Shiv Ratan were recorded without any order of the competent Authority and name of other brother of Badal and Shiv Ratan were left out .The copy of the Khatauni of fasli year 1356 of Khata no. 777 and 788 recorded in the name of Badal and Shiv Ratan is being Annexed here with as Annexure No. 9 to this writ petition .

That as per Khatauni of fasli year 1356 of Khata no. 146 and 151 , The name of the Badal were recorded without any order of the competent Authority . whereas the disputed Khata originated from Mohan Lal son of Nohri . The only name of Badal was recorded without any order of the competent Authority and name of brother of Badal were left out .The copy of the Khatauni of fasli year 1356 recorded in the name of Badal is being Annexed here with as Annexure No. 10 to this writ petition .

14. That Late Shri Badal was eldest amongst all the brothers namely late Shri Jodha , Late Shri Shiv Ratan , Late Shri Dirgaj and Shri Guru Dayal . After death of Late Shri Mohanlal , the name of the Badal son of late Shri Mohanlal was recorded in the Revenue Record / Khatauni in the Fasli Year 1347 , in the capacity of Hindu Joint Family Property Holder , but all the brothers namely late Shri Jodha , Late Shri Shiv Ratan , Late Shri Dirgaj and Shri Guru Dayal being original account holder of Late Shri Mohanlal Lived in Joint Family .

That among the sons of the Late Shri Mohanlal , Late Shri Dirgaj was employed in the Police Department and since he was educated , he 6 got his ¼ share of the land of original account holder of Late Shri Mohanlal separated from other brothers namely Late Shri Jodha , Late Shri Shiv Ratan , Late Shri Badal and Late Shri Guru Dayal by doing the corrective revenue record . Now in present share of the land of original account holder of Late Shri Mohanlal are legal Heirs of Late Shri Shiv Ratan , Late Shri Guru Dayal and Late Shri Badal after separation of the share Shri Dirgaj . The copy of the Khatauni of Fasli Year 1359 and 1362 recorded in the name of Shri Dirgaj are being annexed here with as Annexure No.11 to this writ petition collectively . It is relevant to submit here that Khasra nos. 1213 , 1234 ka, 1257 , 1251 , 1399 ,1433 of the Khata no. 706 ( Total Area 9 + ¼ Bigha ) , in the Khatauni of Fasli Year 1332 and Khasra nos. 1153 ka , 1154 , 1156 , 1155 , 1226 ,1230 , 1241 of the Khata no. 299 ( Total Area 2+ ½ Bigha ), in the Khatauni of Fasli Year1332 have been included in the Khatauni of Fasli Year 1333 in the Khata no. 124 and 27 . It is further submitted here that ¼ share of Late Shri Dirgaj has been separated from Khasra no. 1153 Ka , 1154 , 1157 of Khata no. 299 and Khasra no. 1234 ka , 1433 in the Fasli Year 1359 after depositing 10 times Fee and after the statement of Late Shri Badal because the Fasli Year 1359 is after Zamindari and there was Serdari . It is also submitted here that Khasra No. 1153 , 1155 kha , 1156 , 1234 ka , 1234 kha , 1254 Area about 4 Bigha 4 Bisua has been recorded in the Khata no. 37 in the name of Late Shri Dirgaj as per his ¼ share .

That land of original account holder of Late Shri Mohanlal was being inherited in the Name of the Late Shri Badal without any judicial order and after death of Late Shri Badal , The name of Braj pal son of Late Shri Badal , Late Shri Jalsai Deen son of Late Shri Badal and Late Shri Kanhai son of Late Shri Badal have been recorded in the khatauni . The copy of the Khatauni recorded in the name of Late Shri Badal and Akar – Patra – 45 , recorded in the name of name of Braj pal son of Late Shri Badal , Late Shri Jalsai Deen son of Late Shri Badal and Late Shri Kanhai son of Late Shri Badal are Being Annexed here with as Annexure no. 12 to this writ petition collectively . It is relevant to submit here that in the Gram Sabha Prwar East , Consolidation of Land Holding started in 1984 . Intially Form -5 was created . On the Form – 5 , in 1/3 part the name of Late Shri Ram Bharose and another in 1/3 part the name of Late Shri Mewa Lal were recorded but in the remaining 1/3 part , in the 1/9 part the name of Jalsai , in other 1/9 part the name of Kandhai and in the remaining 1/9 part the name of Braj Pal were recorded , after the statement given by Shri Jalsai, Kandhai , Braj Pal before Assistant Consolidation and Land Management committee . The name of Late Shri Ram Bhrose was recorded in the Khasra no. 1155 , 1216 , 1257 , 1399 , 1463 etc. in the Akar Patra 2 – A and said Khasra no. have been included in the Present Khata No. 124 and 27 . Badlu’s sons used to cultivate Meva Lal’s Share of Land on sharecropping basis because Meva Lal had gone to his in – laws’ House in Unnao District . The ¼ share of Late Shri Dirgaj has been separated from Khasra no. 1153 Ka , 1154 , 1157 of Khata no. 299 and Khasra no. 1234 ka , 1433 in the Fasli Year 1359 after depositing 10 times Fee and after the statement of Late Shri 7 Badal . Whereas Guru Dayal , Shiv Ratan , Badal had divided as 1/3 share to each of their remaining property among themselves after separation of land of Dirgaj but due to his elder age , the land in question was named in the name of Late Shri Badal . Which itself establish that land in – question is ancestral especially when respondent were failed to prove that under what circumstances the disputed khata was transferred in the name of Badal only after the Mohanlal . In the Akar Patra – 45 , the name of sons of real brother Dirgaj was recorded but land was not recorded in the name of other two real brothers and any witness failed to prove that Source of self creation of Land in question by Badal.

In order to consider the contention of the learned Counsel for the petitioner, based upon the aforesaid, it would be apt to indicate the following facts:- (i) The Mohan Lal was not the absolute owner/recorded tenure holder of the land in dispute. It is in view of the admitted fact that the land in dispute was recorded either as Jiman-4 or Jiman-5 or Jiman-8 in 1304 Fasli, which shows that Mohan Lal and Ram Deen, both sons of Nohri, were only the occupant(s) of the land indicated in Khatauni of 1304 Fasli and not the landlord/recorded tenure holder. (ii) Aforesaid is evident from the following documents on record:- (a) Copy of Khatauni of 1304 Fasli, (1895 C.E.) (Annexure No.4) related to Mohan Lal. (b) Copy of khatauni of 1332 Fasli, (1923 C.E.) (Annexure No.6) related to Badal s/o Mohan Lal. (c) Copy of khatauni of 1347 Fasli (1938 C.E.) (Annexure No.7) related to Guru Dayal s/o Mohan Lal, on which the following is mentioned, "og yksx tks cxSj fdlh gd ds vkjkth ij dkfct gks". (d) Copy of Khatauni of 1347 Fasli (1938 C.E.) (Annexure No.8) related to Badal and Shiv Ratan, both sons of Mohan Lal. (e) Copy of Khatauni of 1356 Fasli (1947 C.E.) (Annexure No.9) related to Badal and Shiv Ratan, both sons of Mohan Lal. 8 (f) Copy of khatauni of 1356 Fasli (1950 C.E.) (Annexure No.10) related to Badal S/o Mohan Lal. (g) Copy of khatauni 1359 Fasli (1952 C.E.) (Annexure No. 10) related to Dirgaj S/o Mohan Lal. (iii) From aforesaid documents it is evident that Badal was also in possession of the land of recorded tenure holder/Zamindar. (iv) Copy of the Khatauni of 1362-Fasli on record at page 130 of paper book indicates that Dirgaj Ram s/o Mohan Lal was having Bhoomidhar rights with regard to gata nos. 1153, 1155, 1156, 1234, 1234d, 1254 and 1433. According to khatauni of 1304 Fasli these gatas were in possession of Mohan Lal, father of Dirgaj, who was not recorded tenure holder. (v) From the aforesaid, it appears that Dirgaj after the death of Mohan Lal entered into the possession of the aforesaid gatas independently of recorded tenure holder and upon enforcement of U.P.Z.A. & L.R. Act, 1950 ( in short 'Act of 1950') the Drigaj got bhoomidari rights. (vi) Before the concerned Circle Officer (in short 'CO'), Settlement Officer of Consolidation (in short 'SOC') and Deputy Director of Consolidation (in short 'DDC'), the objectors namely Ram Bharosey S/o Gurudayal S/o Mohan Lal and Mewa Lal S/o Shiv Ratan S/o Mohan Lal pleaded that Dirgaj got his share in terms of an order passed in the case instituted by him. However, the authorities namely SOC and DDC declined to accept the said contention of the objectors for the reason that to establish this fact no evidence was placed on record. (vii) In regard to aforesaid, it would be relevant to indicate that for the purposes of partition, no suit was maintainable as if the case of the petitioners is taken on its face value, they were occupier of land of recorded tenure holder/Zamindar. (viii) In the aforesaid facts of the case, this Court finds that Dirgaj was independently in possession of gatas indicated in paragraph no.3(v) of this judgment and thereafter, bhoomidhar rights were provided to 9 Dirgaj after payment of requisite amount in terms of Section 134 of the Act of 1950. (ix) Copy of khatauni of 1332 Fasli, (1923 C.E.) (Annexure No.6), indicates that Badal was occupant of the land/gatas mentioned therein, under category Jiman-4 of recorded tenure holder/zamindar on record. (x) Copy of Khatauni of 1347 Fasli, (1938 C.E.) (Annexure No.7), indicates that Gurudayal was in possession over the land indicated i.e. gata nos. 1501d and 1502[k, for a period of 12 years and this khatauni also indicates that Gurudayal was in possession of the land of recorded tenure holder as on this khatauni following is mentioned "og yksx tks cxSj fdlh gd ds vkjkth ij dkfct gks" . (xi) Copy of Khatauni of 1347 Fasli (1938 C.E.) (Annexure No.8), indicates that Badal and Shiv Ratan, both sons of Mohan Lal, were in possession of gata no. 1216 of recorded tenure holder/zamindar under category Jiman-4 (b). (xii) Copy of Khatauni of Khata No. 146 of 1356 Fasli (1947 C.E.) (Annexure No.9), indicates that Badal and Shiv Ratan, both sons of Mohan Lal, were occupants of some part of Gata No.1213, 1234, 1251, 1256, 1426, 1433 and Badal S/o Mohan Lal was independently occupying some part of Gata Nos.1213o,1501o, 1502o, 1161/1 and 1399 of recorded tenure holder/zamindar. It would be apt to indicate that this khatauni indicates that ",sls dkfctku vkjkth ftUgksaus ,sls 'kDl dh jtkeUnh gkfly fd, cxSj vkjkth ij dCtk dj fy;k gks ftls fdlh 'kDl dks crkSj vlkeh ds nkf[ky djus dk gd gkfly gks". (xiii) From the aforesaid as also copy of the Khatauni of 1356 Fasli (1947 C.E.) (Annexure No.10) it is apparent that plots/gatas 1213o, 1501o, 1502 o , 1161/1, 1154, 1153/1, 1156, 1155[k, 1226, 1230/1, 1241 and 1153[k were in possession of Badal s/o Mohan Lal independently. (xiv) Copy of Khatauni of Khata No. 151 of 1356 Fasli (1947 C.E.) has not been placed on record. (xv) According based upon the aforesaid as also the observations in the order dated 02.02.2016 passed by the Consolidation Officer (in short 10 "C.O.") in case No. 151/15-16, under Section 9 A (2) of the U.P. Consolidation of Holdings Act, 1953 (in short "Act of 1953") this Court finds that Badal S/o Mohan Lal was independently in possession of Gata Nos. 1155, 1161, 1213, 1216, 1226, 1241, 1256, 1257, 1399, 1427, 1463, 1501, 1502, land in issue as indicated in order dated

02.02.2006. (xvi) Aforesaid documents including the entries therein indicates that Badal s/o Mohan Lal on the time of date of vesting i.e. 01.07.1952 was independently in possession of land of recorded tenure holder/ Zamindar. From the aforesaid, it is apparent that Gurudayal and Dirgaj, both sons of Mohan Lal, were also independently in possession of land of recorded holder/Zamindar. (xvii) According to the statement of Mewa Lal, Badal died in the year 1976 i.e. 1983 Fasli and after the death of Badal the name (s) of his successors/legal heirs namely Jalsaideen, Brij Pal and Kandhai were entered in the revenue records. In the light of procedure prescribed under the U.P. Land Revenue Act 1901. (xviii) At this stage, it would be apt to indicate that neither Shiv Ratan nor Guru Dayal, both sons of Mohan Lal, raised their claim with regard to land in dispute, during life time of Badal i.e. till 1976 the year of death of Badal and till 1987, the year in which the objection(s) under Section 9-A(2) of the Act of 1953 were filed, Mewa Lal and Ram Bharosey never objected with regard to recording the names of legal heirs/sons of Badal S/o Mohan Lal namely Jalsaideen, Brij Pal and Kandhai.

5. In the aforesaid background of the case the present petition has been filed to adjudicate the issue involved in the instant case.

According to the petitioners and their predecessors in interest namely Ram Bharose and Mewa Lal, the land in dispute, indicated above, was in the name of Mohan Lal (predecessor in interest of Badal, Ram Bharose and Mewa Lal, Jodha, who died issueless, and Dirgaj, who never raised any claim with regard to land in dispute,) and after the death of Mewa Lal land 11 in dispute, was recorded in the name of Badal, who was eldest in the family being 'Karta' of the family and therefore, after the death of Badal, the right in land in dispute would be available to legal heirs of Badal, Shiv Ratan namely Mewa Lal and Guru Dayal namely Ram Bharose and not to Ram Aasrey s/o Dirgaj as share of the Dirgaj was separated.

7. Learned counsel for the petitioners says that the CO allowed the claim vide order dated 02.02.2016 passed in case no.151/15-16 (Ram Bharose Vs. Jalsaideen), under Section 9A(2) of U.P. Consolidation of Holdings Act, 1953 (in short 'Act 1953') and the SOC while dismissing the appeal no.52 (Shiv Prakash & others Vs. Ayodhya & others) under Section 11(1) of 1953 vide impugned order dated 20.11.2020 and also the Revision No.194 of 2024, Computerized Case No.202153140600001 (Ayodhya Vs. Shiv Prakash others) as also Revision No.37 of 2025 under Section 48 (1) of Act 1953 the SOC and DDC committed material irregularity of facts as they failed to take note of documentary and oral evidence in its true spirit as such the indulgence in the matter is required.

Shri Hemant Kumar Pandey, learned Counsel appearing for the State stated that in the instant case no indulgence is required as the SOC and DDC have rightly considered the evidence on record which includes the documentary and oral evidence. He also states that the claimants/objectors, namely, Mohan Lal and Ram Bharosey failed to prove the essential ingredients based upon which the co-tenancy can be provided.

In order to come to the conclusion, this Court finds it appropriate to extract the relevant portion of the impugned order dated 20.11.2020 passed by SOC, Lucknow/opposite party no.2 reads as under:- लिनेगर(cid:11)ने(cid:17)कीतु(cid:11)/गण की(cid:14) लिनेगर(cid:11)ने(cid:17) लिनेरस्तु किकीया(cid:4) @(cid:11)ने(cid:4) या+ग्या ह:। आदा(cid:4)श ्ቇ(cid:11)ैሰ परवर प?रब परगने(cid:11) विब@ने!र तुहसा(cid:17)ल सार+@ने(cid:17)नेगर व खि@ल(cid:11) ल(cid:31)नेऊ की(cid:4) आध(cid:11)र व्ቧ/ की(cid:4) (cid:31)(cid:11)तु(cid:11) सा0० 27 व 124 की(cid:4) साम्बन्ध ैሰ7 अया+ध्या(cid:11) ्ቚसा(cid:11)दा आकिदा की(cid:14) लिनेगर(cid:11)ने(cid:17) किदाने(cid:11)0की 17- 12-2020 उपर+्ሹ लिनेष्की्ቧ} की(cid:4) आध(cid:11)र पर विवलिध रकिहतु ह+ने(cid:4) की(cid:4) की(cid:11)रण लिनेरस्तु की(cid:14) @(cid:11)तु(cid:17) ह: अप(cid:17)ल(cid:17)या न्या(cid:11)या(cid:11)लया की(cid:11) आदा(cid:4)श किदाने(cid:11)0की 20-11-2020 प?व/वतु दा@/ एव0 ैሰ(cid:11)न्या रह(cid:4)ग(cid:11)। पቔኋ(cid:11)वल(cid:17) ब(cid:11)दा आवश्याकी की(cid:11)या/व(cid:11)ह’ दा(cid:11)खि(cid:31)ल दाफतुर ह+।"

Upon due consideration of the facts of the case as also the submissions advanced by learned counsel for the parties, this Court finds that no interference in the impugned order(s) is required because the claimants/objectors Mohan Lal and Ram Bharosey, failed to establish their claim. It is for the following facts/reason(s) :- 17 (i) Admittedly Mohan Lal was not the absolute owner/recorded tenure holder of the land in dispute. (ii) In view of the observations made by the Full Bench of this Court in the case of Jagdamba Singh Vs. Dy. Director of Consolidation, 1984 (2) LCD 398 [LB], in order to claim to co-tenancy, it will be necessary for the party laying the said claim to establish that the land in question was recorded in the name of common ancestor and, thereafter it has to be shown that the area, identity and the nature of the land has remained unchanged throughout and only after establishing the aforesaid can claim of co-tenancy succeed. In the instant case, the same are missing as would appear from the facts narrated herein above including rights acquired by Guru Dayal and Dirgaj, both sons of Mohan Lal, and also the real brothers of Badal son of Mohan Lal, over some gatas indicated in copy of 1304 Fasli (1895 C.E.) related to Mohan Lal. The relevant paragraphs of the judgment passed in the case of Jagdamba Singh Vs. Dy. Director of Consolidation (supra) is extracted herein under :- "....14. It is fairly well settled that in order to entitle a party to claim co- tenancy rights in the holding on the ground of its being ancestral the unbroken identity of the holding has got to be established throughout the period. If the identity has changed of the holding the claim cannot succeed. This view has been expressed in several decisions of Board of Revenue and also of this Court in the cases noted below:- (1) 1943 RD 567 (BR) Jodhia v. Bhikwa. (2) 1942 RD 379 (BR) Hamid Ali v. Benares Bank. (3) 1942 RD 401 (BR) Mohd. Yasin v. Mohd. Shafi. (4) 1945 RD 122 (BR) Rajaram v. Narain Singh. (5) 1969 RD 175 (BR) Abhai Narain v. Ram Manorath. (6) 1973 RD 242 (BR) Aminuddin v. Kamuruddin. (7) 1975 RD 195 (BR) Ram Narain v. Buddhu. (8) 1963 RD 37 (BR) Mahadeo Singh v. Sunder Kewat. (9) 1979 RD 125 (BR) Balwanti v. Bhaiya Ram. (10) 1983 (1) Lucknow Civil Decision, 40 (HC) Jhagroo v. The Deputy Director of Consolidation.

In all the aforesaid decisions it has been consistently held that in order to uphold the claim of co-tenancy rights on the ground of land being ancestral it is essential that the entire land of the holding of the common ancestor must have come down in the identical form an it must have remained unchanged and intact. It would, however, be correct to say that where as a result of survey made during settlements, the area of some plots might have decreased or increased or that some plot or plots are eliminated for some explained reason from the holding in question viz. having fallen in the bed of river due to the alluvial and diluvial action 18 of the river or by the construction of the canal etc., then in such event it cannot be said that there is break in the identity of the holding in dispute. The slight change like elimination of certain plot or the increase or decrease in the area of certain plots for the aforesaid reasons shown would not operate to destroy the identity of the holding coming down in identical form in the family from the time of common ancestor. But in order to uphold the claim of co- tenancy rights on the ground of land being ancestral it must be established by the claimant that the holding has come down intact and in identical form that it has not been sub-divided or resettled with one or some of the heirs or with the strangers. Thus, where the disputed holding has not come intact in the identical form and only some of the plots of the holding belonging to common ancestor are found included as in the present disputed holding it would not make it ancestral holding so as to give a share in it to the claimants on that ground nor it would be permissible to pick up those plots from the holding and declare them to be ancestral property and give a share in those plots to the claimant. * * * *

22. Learned counsel for the opposite parties Sri. Hargun Charan, however, urged that even if the claim of the opposite parties 5 to 8 cannot be sustained on the ground that the disputed holding is ancestral, yet their claim is sustainable on the ground that the entire land of the disputed Khata No. 36 is joint family property and the name of Mata Dihal Singh was recorded in the representative capacity as he was head and Karta of the joint family. His further contention was that even if it be held that the holding in dispute consisting of 84 plots with an area of 44 bighas, 9 biswas, 14 biswansis was settled afresh by the landlord with Mata Dihal Singh, the same would be deemed to be joint family property as at the time of acquisition he was head and Karta of the family being elder brother. Learned counsel pointed out that the opposite parties 1 to 3 have recorded a finding to the effect that at the time of second settlement in the year 1301 F., both these brothers Mata Dihal Singh and Ram Baran Singh formed joint family and on the basis of this finding learned counsel urged that even if land of the disputed holding was acquired by Mata Dihal Singh, but the same would be treated to be joint family property and the opposite parties 5 to 8 would get half share in all the plots of the disputed holding-Khata No. 36.1 am unable to agree with this contention as well.

23. It is well settled that the creation of tenancy in respect of agricultural land is a matter of contract between the landlord and the tenant. Even in the joint Hindu family a member of the joint family could acquire land for himself and unless it is proved that the land was acquired by him in the representative capacity and for the benefit of the family, it cannot be held to be joint family land merely because it was acquired by him when he formed joint family with other members. Even a Karta of joint Hindu family can acquire land in his name for his own benefit and it cannot be treated to be joint family property merely because he happens to be Karta of the family at the time of the alleged acquisition of the property. It has to be positively proved that when the land was acquired by the Karta of the joint family he had acquired it in the representative capacity for the entire body of coparceners and it is treated as such by the members of the family." (iii) There is no evidence on record whcih could indicate or establish that the families of Badal and Shiv Ratan, Dirgaj and Guru Dayal, all sons of Mohan Lal or families of their legal heirs including objectors namely Meva Lal son of Shiv Ratan and Ram Bharose son of Gurudayal and sons of Badal namely Jalsai Deen, Kanhai and Brujpal were joint in mess and affairs. (iv) Neither Shiv Ratan nor Guru Dayal, both sons of Mohan Lal, raised their claim with regard to land in dispute, during life time of Badal i.e. till 1976 the year of death of Badal and till 1987, the year in 19 which the objection(s) under Section 9-A(2) of the Act of 1953 were filed, Mewa Lal and Ram Bharosey never objected with regard to recording the names of legal heirs/sons of Badal S/o Mohan Lal namely Jalsaideen, Brij Pal and Kandhai. (v) Entries indicated in the preceding paragraphs of this judgment indicate that Bhumidhari rights were provided to Dirgaj. (vi) From the entries in Khataunies of 1356 Fasli (1947 C.E.), (Annexure No.9 and Annexure No.10), which have not been refuted and therefore upon which reliance can be placed, it is evident that Badal s/o Mohan Lal on the time of date of vesting i.e. 01.07.1952 was independently in possession of land of recorded tenure holder/ Zamindar. From the aforesaid, it is apparent that Gurudayal and Dirgaj, both sons of Mohan Lal, were also independently in possession of land of recorded holder/Zamindar.
