Judgment

1. Heard learned counsel for the petitioner and Ms. Deepshikha, learned Chief Standing Counsel for the respondent-State.

2. The petitioner, by means of this petition, has assailed the impugned order dated 04.04.2024, the transfer order dated 28.06.2024 passed by opposite party no. 3, as well as the relieving order dated

04.03.2025.

4. Perused the record. Perusal of Annexure-2 shows that at Sl. No. 21, the petitioner has been transferred from CBCID Headquarters, Lucknow to the Lucknow Zone.

5. Further perusal of Annexure-1 indicates that the transfer order was passed considering the fact that the petitioner was left with approximately one year before retirement. 2

Learned Chief Standing Counsel has drawn the attention of this Court to the impugned order (Annexure-1), from which it is evident that the petitioner has been posted in District Lucknow as a Sub-Inspector since 01.10.1984 till date. Thus, he cannot be allowed to remain posted at one place indefinitely. Considering his nearing retirement, a sympathetic view has already been taken, and he has been transferred within the Lucknow Zone itself.

It is well settled law that the transfer is an incident of service. The petitioner cannot claim a right to remain posted at one place for over 40 years during the course of his service.

9. In the case of Shilpi Bose v. State of Bihar (1991 Supp (2) SCC 659) it has been held by Apex court that transfer is an incident of service and should not be interfered with unless it is vitiated by mala fides or is in violation of any statutory rule or is passed by an incompetent authority. 4

10. In the case of State of U.P. v. Gobardhan Lal (2004) 11 SCC 402 the Apex Court held that a government servant has no vested right to remain posted at one place or the other. He is liable to be transferred in the administrative exigencies.

11. In the case of Union of India v. H.N. Kirtania (1989) 3 SCC 445 the Apex court held that unless the transfer order is passed in violation of any mandatory rule or on extraneous considerations, the courts should not interfere.

12. Also in the case of National Hydroelectric Power Corp. Ltd. v. Shri Bhagwan (2001) 8 SCC 574, the Apex Court held that interference by courts in transfer orders should be rare and only if the transfer is mala fide or arbitrary.

13. Considering the above as well as the pronouncements of Hon'ble Supreme Court and the fact that the petitioner has also been relieved, there appears to be no illegality in the impugned transfer order as well as in the order dated 04.04.2024 (Annexure-1), which is a reasoned and speaking order.
