10. Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that incident occurred on

23.03.2024 and in the information given to the police on the same day, the informant stated that his father had gone to charsadi baazaar at about 09:00 a.m. on 23.03.2024 to deliver milk but he did not come back and upon search, the dead body of his father was found near karbala whereas in the F.I.R. lodged on 29.03.2024, he alleged that the applicant had taken his father from his house at about 09:00 a.m.; that no person has witnessed the incident; that the post-mortem report mentioned a solitary injury and the applicant in his custodial statement has confessed that the injury has been inflicted by him on the head of the victim; co-accused namely Vinod Yadav has been released on bail by this Court; I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid crime.

11. Accordingly, this bail application stands allowed.

12. Let the applicant- Fakiray Yadav be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of magistrate/court concerned, subject to following conditions:- (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial court.
