Judgment
disposed of with liberty to the petitioner to approach the revenue authorities for demarcation of his holding.
The demarcation exercise is held under Section 24 of the U.P. Revenue Code, 2006. A procedure is prescribed for availing the said remedy. However, the petitioner did not avail the said remedy and instead filed an application before District Magistrate for measurement/spot inspection. It appears that in the spot inspection, it transpired that the land of the petitioner has not got affected by the construction of the dam.
Indisputably, the dam was constructed more than forty five years back and consolidation has been held in the village.
In the aforesaid facts and circumstances, we are not inclined to adjudicate on the factual dispute sought to be raised by the petitioner under Article 226 of the Constitution.
