Heard learned counsel for the applicant; learned A.G.A. for the State and perused the record.

The present 482 Cr.P.C. application has been filed with a prayer to direct the Special Judge, SC/ST Act, Gorakhpur to decide the application dated 19.12.2022 under Section 156(3)Cr.P.C. filed by the applicant within stipulated period,

Counsel for the applicants submits that applicant's application under Section 156(3) Cr.P.C. dated 19.12.2022 has not been decided by the trial court.

Learned A.G.A. vehemently opposed the prayer of the applicant and submits that applicant has moved application under section 156(3) through Indian post and the application is not supported by any evidence that application has been received by court and there is no evidence that the court has received application on any specific date.
