Heard Sri Akash Mishram, learned counsel for the applicant, Sri Karunakar Singh, learned A.G.A. for the State and perused the material on record. The present bail application has been filed on behalf of applicant Sonu Singh Yadav under Section 439 of the Code of Criminal Procedure, with a prayer to release him on bail in Case Crime No. 61 of 2024 for offence punishable under Sections 419, 420, 120B of the Indian Penal, registered at Police Station Jhunsi, District Prayagraj, during pendency of the trial, after rejecting the bail application of the applicant by Additional Sessions Judge/Additional Special Judge (POCSO Act), Court No. 3, Prayagraj, vide order dated 12.11.2024. Learned counsel for the applicant submits that the applicant is innocent and has falsely implicated in the present case with ulterior motive on the basis of false and frivolous allegations. It is further submitted that the impugned first information report dated 17.2.2024 has been lodged against 12 named persons after about eight hours of the incident. It is further submitted that the name of applicant surfaced on the basis of confessional statement of arrested co-accused persons and he is not named in the FIR. It is further submitted that co- accused Vikas Kumar, Ajay Kumar Vishwakarma have been granted bail by this Court in Criminal Misc. Bail Application Nos. 14066 of 2024 and 43311 of 2024 vide orders dated 19.04.2024 and 03.01.2025 . He has next argued that the applicant has criminal history of six cases.
