Judgment
Heard Sri Brijesh Kumar Pal, learned counsel for the petitioner and Sri Pramod Kumar Singh, learned Standing Counsel, who appears for Respondents.
The present writ petition has been filed for seeking following reliefs: "I. Issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2/ Assistant Secretary, Railway Recruitment Board, D-79/80, Rail Vihar, Chandrasekharpur, Bhubaneswar, Odisha, PIN-751023 to give effect to the appointment of the petitioner on the post of "NTPC 2024 CBT 1-Good Train Manager" (Marks obtained 38.11583 and cut off 26.91902) as 1st preference or on second preference post of the petitioner "NTPC 2024 CBT 1-Junior Account Assistant Cum Typist" (Marks obtained 38.11583 and cut off 38.06495) in pursuant to the advertisement published by Respondent no. 2 and further be pleased to direct the authorities concerned to make vacant a seat in both categories for the petitioner till pendency of this writ petition, in this regard representation /application dated
23.09.2025 through email communication of the petitioner may be decided. "
Learned counsel for the respondents has raised a preliminary objection that the writ petition cannot be maintainable as the writ petitioner has an alternative efficacious remedy of preferring original application before the Central Administrative Tribunal under Section 19 of the Administrative Tribunal Act, 1985. He seeks to rely upon the judgment of the Hon'ble Apex Court in L. Chandra Kumar v. Union of India, AIR 1997 SC 1125.
