Ashok Kumar v. Kokil Jaitly And 2 Others

#1. Heard learned counsel for the petitioner and perused the record.

#2. The instant writ petition has been filed for following reliefs: " 1. Issue an order or direction to the Civil Judge (Senior Division) Mathura to decide the 7(C) Application of the petitioner for granting injunction filed in the original suit no. 229 of 2024 (Ashok Kumar vs. Kokil Jaitly and others) pending before him within stipulated time as may be directed by this Hon'ble Court. (Annexure no.5 to the petition)

#2. Issue a order or direction to the defendant/ respondent not to interfere in the peaceful possession of the petitioner over the flat no. 1/G-4,LIG, Sector- 2, Rukmani Vihar, Vrindavan Tehsil and District- Mathura, during pendency of suit."

#3. Contention of the learned counsel for the petitioner is that an application for interim injunction (7C Application) is pending since 2024 and the same has not been decided despite several dates have been fixed. He prayed that the same may be decided, expeditiously.

#4. In view of above, no useful purpose would be served in keeping this petition pending.

Accordingly, the present petition stands disposed of finally with a direction to the Civil Judge (Senior Division) Mathura to consider and decide the aforementioned interim injunction application (7C Application), 2 A227 No. 12482 of 2025 in accordance with law, expeditiously, preferably within a period of twelve weeks from the date of production of a certified copy of this order after ensuring service upon all the opposite parties, giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided that there is no other legal impediment.
