2. Petitioners (seven in numbers) have claimed that they are discharging their respective duties as Teachers in Primary Section of Sri Sundar Vidyapeeth, Tilak Tiwari Ka Hata, Binha Ballia. However, since State-Respondents have not granted approval of their respective appointments, therefore, their salary was not paid from State Exchequer. Petitioners have approached this Court earlier by way of filing Writ-A No. 4170 of 2022, which was disposed of by following order dated
14.10.2022: “Heard learned counsel for the petitioners, Sri Brajesh Kumar Chaturvedi learned counsel for the Committee of Management and the learned Standing Counsel for the State respondents. Present writ petition has been filed by the individual petitioners (seven in numbers) namely, Smt. Kanchan Srivastava, Smt. Manju 2 WRIT-A NO. 14978 OF 2025 Pandey, Ms. Madhu Singh, Smt. Poonam, Km. Renu, Sri Mayank Pandey and Sri Omkar Nath Chaube, all claiming to be Assistant Teachers working at Sri Sunder Vidyapith Tilak Tiwari Ka Hata Binha, Ballia over a long period of time. Petitioners seek sanction of posts of Assistant Teacher at the above described institution. They further claim a right to be absorbed on those posts. It is undisputed, on 18.6.2021, the Director Secondary Education issued Circular No. 351 calling for information pertaining to primary sections attached to aided private sanskrit secondary colleges and degree colleges. Information was also sought with respect to strength of teaching faculty at those institutions. In response thereto, the Principal of the above described institution wrote to the DIOS Ballia vide communication dated 26.6.2021 describing existence of vacancies. That matter has remained pending. Thus, against eight posts of Assistant Teacher in primary section of that institution, two vacancies have been claimed to exist. Further, one vacancy is stated to exist in the subject Sanskrit. Parties are at variance with respect to the right of the petitioners against the above posts set up by the Committee of Management. While the petitioners claim to be working against said posts, counter affidavit filed by the State indicates, barring Smt. Manju (petitioner No. 2), no other petitioner has been included in the list of teachers working from before. Following six persons have been named as existing teaching faculty:
1. Sri Surendra Dev Chaube.
2. Smt. Manju.
3. Sri Sunil Kumar Chaube.
4. Sri Uday Pratap Singh.
5. Sri Umesh Tiwari and
6. Smt. Kiran Tiwari. At present no adjudication is required to be made with respect to the right of the individual petitioners to be absorbed against any of the posts as no sanctioned post appears to have been created. That matter is still pending with respondent No.2. In view of the above, present writ petition is disposed of with a direction, in case a copy of this order is filed either by the petitioners or by the Committee of Management before respondent No. 2 within a period of two weeks from today, the said respondent shall take all consequential action with respect to sanction sought by the Committee of Management and appropriate order be passed in that regard within a further period of three months from the date of compliance shown by the petitioner and/or Committee of Management. 3 WRIT-A NO. 14978 OF 2025 The further rights being claimed by the individual petitioners shall remain subject to the decision to be made in compliance of this order. It is made clear that the Court has not adjudicated the rights of the individual petitioners to be absorbed against any post that may come to be sanctioned by respondent No. 2. That right have to be tested on its own strength at appropriate stage, if need arises.”

In aforesaid circumstances, the matter was reexamined by concerned respondent, i.e., Up Shiksha Nideshak (Sanskrit), however, since concerned Institution has not provided information on 17 points, so far as nature of appointment of petitioners are concerned, therefore, their claims were rejected. 5. Aforesaid order is impugned in present writ petition. Learned counsel for petitioner submits that while disposing of earlier writ petition, Court has directed concerned respondent to consider the issue of sanctioned posts, so far as Primary Section of concerned Institution is concerned. However, without deciding the said issue, representation of petitioners was rejected.
6. Learned Additional Chief Standing Counsel by referring the relevant paragraph of impugned order submits that Institution concerned has not submitted any document which could support the claim of petitioners.

In reply to above submission, learned counsel for petitioners refers few documents annexed alongwith this writ petition such as, photocopies of appointment letters and attendance register, that petitioners were duly appointed and are regularly discharging their duties as Teachers and even today they are working.
9. I have considered the above submissions and perused the record. The claim of petitioners could be considered only when there are documents available in support of their respective claim and the same has to be provided by concerned Institution only. However, as specifically referred in impugned order, the Committee of Management 7 WRIT-A NO. 14978 OF 2025 of concerned Institution has not provided any such documents on ground that originals have lost. Even photocopies of same were not provided. Only on basis of photocopies of documents annexed alongwith this writ petition, in absence of any corroborative evidence, claim of petitioners cannot be considered to be genuine. Therefore, at this stage, in absence of any document which could support the claim of petitioners, relief sought cannot be granted.
10. In view of above, I do not find any error in impugned order. However, it is made clear that in case petitioners have sufficient document and advised to pursue any other legal remedy, this order will not come in the way.

2. Petitioners (seven in numbers) have claimed that they are discharging their respective duties as Teachers in Primary Section of Sri Sundar Vidyapeeth, Tilak Tiwari Ka Hata, Binha Ballia. However, since State-Respondents have not granted approval of their respective appointments, therefore, their salary was not paid from State Exchequer. Petitioners have approached this Court earlier by way of filing Writ-A No. 4170 of 2022, which was disposed of by following order dated
14.10.2022: “Heard learned counsel for the petitioners, Sri Brajesh Kumar Chaturvedi learned counsel for the Committee of Management and the learned Standing Counsel for the State respondents. Present writ petition has been filed by the individual petitioners (seven in numbers) namely, Smt. Kanchan Srivastava, Smt. Manju 2 WRIT-A NO. 14978 OF 2025 Pandey, Ms. Madhu Singh, Smt. Poonam, Km. Renu, Sri Mayank Pandey and Sri Omkar Nath Chaube, all claiming to be Assistant Teachers working at Sri Sunder Vidyapith Tilak Tiwari Ka Hata Binha, Ballia over a long period of time. Petitioners seek sanction of posts of Assistant Teacher at the above described institution. They further claim a right to be absorbed on those posts. It is undisputed, on 18.6.2021, the Director Secondary Education issued Circular No. 351 calling for information pertaining to primary sections attached to aided private sanskrit secondary colleges and degree colleges. Information was also sought with respect to strength of teaching faculty at those institutions. In response thereto, the Principal of the above described institution wrote to the DIOS Ballia vide communication dated 26.6.2021 describing existence of vacancies. That matter has remained pending. Thus, against eight posts of Assistant Teacher in primary section of that institution, two vacancies have been claimed to exist. Further, one vacancy is stated to exist in the subject Sanskrit. Parties are at variance with respect to the right of the petitioners against the above posts set up by the Committee of Management. While the petitioners claim to be working against said posts, counter affidavit filed by the State indicates, barring Smt. Manju (petitioner No. 2), no other petitioner has been included in the list of teachers working from before. Following six persons have been named as existing teaching faculty:
1. Sri Surendra Dev Chaube.
2. Smt. Manju.
3. Sri Sunil Kumar Chaube.
4. Sri Uday Pratap Singh.
5. Sri Umesh Tiwari and
6. Smt. Kiran Tiwari. At present no adjudication is required to be made with respect to the right of the individual petitioners to be absorbed against any of the posts as no sanctioned post appears to have been created. That matter is still pending with respondent No.2. In view of the above, present writ petition is disposed of with a direction, in case a copy of this order is filed either by the petitioners or by the Committee of Management before respondent No. 2 within a period of two weeks from today, the said respondent shall take all consequential action with respect to sanction sought by the Committee of Management and appropriate order be passed in that regard within a further period of three months from the date of compliance shown by the petitioner and/or Committee of Management. 3 WRIT-A NO. 14978 OF 2025 The further rights being claimed by the individual petitioners shall remain subject to the decision to be made in compliance of this order. It is made clear that the Court has not adjudicated the rights of the individual petitioners to be absorbed against any post that may come to be sanctioned by respondent No. 2. That right have to be tested on its own strength at appropriate stage, if need arises.”

In aforesaid circumstances, the matter was reexamined by concerned respondent, i.e., Up Shiksha Nideshak (Sanskrit), however, since concerned Institution has not provided information on 17 points, so far as nature of appointment of petitioners are concerned, therefore, their claims were rejected. 01.07.98 ्ቦीम(cid:23)ी कंचन ्ቦी(cid:17)ास्(cid:23)(cid:17) (cid:17) 06 अन्् ्ቛारा माननी् उ्ሴ न््ा्ाल् इलाहा(cid:27)ाद में रिरट ्ातिचका संख््ा-4170/2022 ्ቦीम(cid:23)ी कंचन ्ቦी(cid:17)ास्(cid:23)(cid:17) (cid:17) 06 अन्् (cid:27)नाम उ०्ቚ० राज्् (cid:17) अन्् ्ोजि%(cid:23) की ग्ी, जि%समें ्ाचीग्ቓों का वि(cid:17)(cid:17)र्ቓ विनम्न(cid:17)(cid:23)् है- 1-्ቦीम(cid:23)ी कंचन ्ቦी(cid:17)ास्(cid:23)(cid:17), 2-्ቦीम(cid:23)ी मं%ू पाण्डे्, 3-मं%ू िሺसह, 4-्ቦीम(cid:23)ी पूनम, 5- कुमारी रेनू, 6-म्ंक पाण्डे् ए(cid:17)ं 7- ओमकार नाथ चौ(cid:27)े शासनादेश संख््ा-102/15-09-14-25(3)/2007 विदनांक 07.02.2014 में (cid:17)ቓኌ्ቓ(cid:23) व्््स्था के अनुरूप अनुदान सूची पर आने (cid:17)ाले वि(cid:17)्ቕाल्ों में मण्डल स्(cid:23)री् / राज्् स्(cid:23)रा् सविमति(cid:23) को ्ቚा् ्ቚस्(cid:23)ा(cid:17)ों में सस्थातिधकारी (्ቚ(cid:27)न्धक) ्ቛारा ्ቚेविष(cid:23) मूल एम०आर० के शिश्ቌकों के नाम से इ(cid:23)र (शिभ्ቐ) माननी् उ्ሴ न््ा्ाल् में रिरट ्ातिचका संख््ा-4170/2022 ्ቦीम(cid:23)ी कंचन ्ቦी(cid:17)ास्(cid:23)(cid:17) (cid:17) 06 अन्् (cid:27)नाम उ०्ቚ० राज्् (cid:17) अन्् ्ोजि%(cid:23) की ग्ी, जि%ससे परिरलति्ቌ(cid:23) है विक संस्थातिधकारी (्ቚ(cid:27)ंधक) ्ቛारा ्ቚेविष(cid:23) मूल एम०आर० में ्ाचीग्ቓ (1-्ቦीम(cid:23)ी कंचन ्ቦी(cid:17)ास्(cid:23)(cid:17), 2-्ቦीम(cid:23)ी मं%ू पाण्डे्, 3-मं%ू िሺसह, 4-्ቦीम(cid:23)ी पूनम, 5-कुमारी रेनू, 6- म्ंक पाण्डे् ए(cid:17)ं 7- ओमकार नाथ चौ(cid:27)े) के नाम सቝኌम्मलिल(cid:23) नहीं हैं। चूँविक शासन ्ቛारा पू(cid:17)(cid:9) मध््मा स्(cid:23)र के वि(cid:17)्ቕाल् में 01 ्ቚधानाचा्(cid:9) ए(cid:17)ं 03 शिश्ቌकों के पद सृजि%(cid:23) विकए गए हैं। ऐसी ቝኌस्थति(cid:23) में ्विद संस्थातिधकारी ्ቛारा का्(cid:9) लिल्ा %ा रहा है (cid:23)ो संस्थातिधकारी उ्ቈरदा्ी हैं, राज्् सरकार उ्ቈरदा्ी नहीं है। संस्थातिधकारी ्ቛारा वि(cid:27)ना शासन ए(cid:17)ं वि(cid:17)भाग के स्ቌम अतिधकारी की अनुमति(cid:23) से संस्था में अविन्विम(cid:23) रूप से रखकर का्(cid:9) लिल्ा %ा रहा है (cid:23)ो संस्थातिधकारी स्(cid:17)्ं अपने विन%ी ्ቨो(cid:23)ों से सम्(cid:27)ቝኌन्ध(cid:23) ्ाचीग्ቓों का (cid:17)े(cid:23)न (cid:17) मानदे् का भुग(cid:23)ान करेंगे। विन्ቓ(cid:9)् माननी् उ्ሴ न््ा्ाल् इलाहा(cid:27)ाद में ्ोजि%(cid:23) रिरट ्ातिचका संख््ा (ए)-4170/2022 ्ቦीम(cid:23)ी कंचन ्ቦी(cid:17)ास्(cid:23)(cid:17) (cid:17) अन्् (cid:27)नाम उ्ቈर ्ቚदेश राज्् (cid:17) 03 अन्् में मा० उ्ሴ न््ा्ाल् ्ቛारा पारिर(cid:23) आदेश विदनांक- 14.10.2022 के अनुपालन में ्ቚकर्ቓ का सम््क अ(cid:17)लोकन विक्ा ग्ा। परी्ቌ्ቓोपरान्(cid:23) विनम्न ቝኌस्थति(cid:23) पा्ी ग्ी- 1- शासनादेश संख््ा-784/पन््ቖह-9-15-25(3)/2007 टी०सी० विदनांक 11 अगस्(cid:23), 2015 ्ቛारा ्ቦी सुंदर वि(cid:17)्ቕापीठ ति(cid:23)लक ति(cid:23)(cid:17)ारी का हा(cid:23)ा, वि(cid:27)नहा, (cid:27)लिल्ा पू(cid:17)(cid:9) मध््मा स्(cid:23)र को शासन ्ቛारा 01 ्ቚधानाध््ापक ए(cid:17)ं ०3 अध््ापक के पद सृजि%(cid:23) / मान्् कर सቝኌम्मलिल(cid:23) विक्ा ग्ा। 6 WRIT-A NO. 14978 OF 2025 2- शिश्ቌा विनदेशाल्, उ्ቈर ्ቚदेश, इलाहा(cid:27)ाद के प्ቔांक-सामान्् (2) वि(cid:17)स्(cid:23)ार / 3120-30/2015-10 विदनांक 25.01.2016 ्ቛारा का्(cid:9)र(cid:23) शिश्ቌकों में से अनुमन््(cid:23)ा हे(cid:23)ु अह(cid:9) पाए %ाने पर 01 ्ቚधानाध््ापक ए(cid:17)ं ०2 अध््ापकों (०1 सहा्क अध््ापक संस्कृ(cid:23) ए(cid:17)ं 01 सहा्क अध््ापक-आधुविनक) के (cid:17)े(cid:23)न भुग(cid:23)ान की अनुमन््(cid:23)ा/स्(cid:17)ीकृति(cid:23) ्ቚदान की ग्ी। 3- शासन ्ቛारा सृजि%(cid:23) पद के अति(cid:23)रिर्ሹ ्विद संस्थातिधकारी ्ቛारा विकसी अन्् से का्(cid:9) लिल्ा %ा रहा है (cid:23)ो राज्् सरकार उ्ቈरदा्ी नहीं है। संस्थातिधकारी स्(cid:17)्ं अपने विन%ी ्ቦो(cid:23)ों से भुग(cid:23)ान करें। अ(cid:23)ः उपरो्ሹानुसार माननी् उ्ሴ न््ा्ाल् इलाहा(cid:27)ाद में ्ोजि%(cid:23) रिरट ्ातिचका संख््ा (ए)-4170/2022 ्ቦीम(cid:23)ी कंचन ्ቦी(cid:17)ास्(cid:23)(cid:17) (cid:17) अन्् (cid:27)नाम उ्ቈर ्ቚदेश राज्् (cid:17) 03 अन्् में माननी् उ्ሴ न््ा्ाल् ्ቛारा पारिर(cid:23) आदेश विदनांक 14-10-2022 के अनुपालन में ्ाचीग्ቓ ्ቦीग(cid:23)ी कंचन ्ቦी(cid:17)ास्(cid:23)(cid:17) (cid:17) 6 अन्् का ्ቚत््ा(cid:17)ेदन (cid:27)लहीन होने के कार्ቓ अमान््/अस्(cid:17)ीकार करा(cid:23)े हुए विनस्(cid:23)ारिर(cid:23) विक्ा %ा(cid:23)ा है।"
5. Aforesaid order is impugned in present writ petition. Learned counsel for petitioner submits that while disposing of earlier writ petition, Court has directed concerned respondent to consider the issue of sanctioned posts, so far as Primary Section of concerned Institution is concerned. However, without deciding the said issue, representation of petitioners was rejected.
6. Learned Additional Chief Standing Counsel by referring the relevant paragraph of impugned order submits that Institution concerned has not submitted any document which could support the claim of petitioners.

In reply to above submission, learned counsel for petitioners refers few documents annexed alongwith this writ petition such as, photocopies of appointment letters and attendance register, that petitioners were duly appointed and are regularly discharging their duties as Teachers and even today they are working.
9. I have considered the above submissions and perused the record. The claim of petitioners could be considered only when there are documents available in support of their respective claim and the same has to be provided by concerned Institution only. However, as specifically referred in impugned order, the Committee of Management 7 WRIT-A NO. 14978 OF 2025 of concerned Institution has not provided any such documents on ground that originals have lost. Even photocopies of same were not provided. Only on basis of photocopies of documents annexed alongwith this writ petition, in absence of any corroborative evidence, claim of petitioners cannot be considered to be genuine. Therefore, at this stage, in absence of any document which could support the claim of petitioners, relief sought cannot be granted.
10. In view of above, I do not find any error in impugned order. However, it is made clear that in case petitioners have sufficient document and advised to pursue any other legal remedy, this order will not come in the way.
