1. Heard Sri Shiv Raj Singh, learned counsel for the applicant and learned A.G.A. for the State.

Learned counsel for the applicant submits that the present application under Section 529 B.N.S.S. of 2023 has been moved by the wife against her husband and in-laws, opposite party nos.2 to 4 with the prayer to expeditious disposal of the Misc. Application no.10012 of 2024 in Case No.1764 of 2018 (Smt. Manisha Vs. Rohit Chaudhary and 3 others), moved under Rule 6(5) of the Protection of Women from Domestic Violence Rule, 2006, pending since 30.04.2024. The further prayer of the applicant is for issuance of direction for disposal of correction application, which is pending since 28.05.2025.

On query, learned counsel for the applicant has submitted that the trial court has passed judgment and order dated 12.03.2024 in favour of the applicant while disposing of the Complaint Case No.1764 of 2018 (Smt. Manisha Vs. Rohit Chaudhary and 3 others), moved under Section 12 of the Protection of Women from Domestic Violence Act, 2005. He further submits that the criminal appeal filed by the opposite parties, bearing Criminal Appeal No.60 of 2024 (Rohit Chaudhary and 2 others Vs. State of U.P. and another) is also dismissed on 19.09.2024, whereby the order dated 12.03.2024 passed by the FTC (CAW Court no.1, Agra) is affirmed. The applicant has moved the application under Rule 6(5) for execution of the award. Hence, seeks intervention of this Court. 2 NA529 No. 3630 of 2025
4. Learned A.G.A. for the State submits that the correction application moved by the applicant is not within the frame of law and is also of delayed. Moreover, the trial court has specifically stated in paragraph 2 of the order that the amount is payable from the date of order instead from the date of application.
5. Countering, the submission of learned A.G.A., learned counsel for the applicant submits that paragraph 5 of the order dated 12.03.2024 has provided that the order is to be complied from the date of moving the application, as such, he has moved the amendment application.
6. This Court does not found it sufficient to issue notice to opposite party nos.2 to 4, as the innocuous prayer in the application is for early disposal of the applications moved by the applicant, which is intrinsic right of the applicant that the matter be decided at an early date.
7. This Court has taken into consideration the rival submissions made by the parties and perused the record.
8. It is by order dated 12.03.2024 that the application moved by the applicant under Section 12 of the Protection of Women from Domestic Violence Act, 2005 has been allowed. The operative portion of the order is reiterated underneath:- " ्ऺािथया ्षारा ्ऺस्तुत ्ऺाथर्ना प्ऴ अंतरगत धारा 12 डीoवीo अिधिनयम स्वीकार करते हुए िनम्न आदेश पािरत िकया जाता है -
1. ्ऺत्यथर्गण संo 1 लगायत 3 को धारा 18 के अन्तगर्त ्ऺािथया के साथ घरेलू िहसा के िकसी ्ऺकार के कायर् करने से रोका जाता है व घरेलू िहसा कािरत करने यह उकसाने से रोका जाता एवं यह भी िनदरॏिशत िकया जाता है िक वह ्ििथता को िकसी ्ऺकार की कोई भी अन्य शारीिरक, आिथक, मौिखक व भावनात्मक यातना न दे और न ही उससे िकसी ्ऺकार की दहेज की मांग करें ।
2. ्ऺत्यथर्गण संo 1 लगायत 3 को धारा 19 के अन्तगर्त आदेिशत िकया जाता है िक वह ्ऺािथया मनीषा व उसके पु्ऴ और अनर्व को साझा गृहस्थ गृह में रखें अथवा ्ऺत्यथर् संo 1 उसे वह पु्ऴ को उसी स्तर की वैकिल्पक आवासन सुिवधा उपलब्ध करायेगा, अन्यथा की िस्थित में ्ऺत्यथर् संo 1 ्ऺािथया व उसके पु्ऴ के आवासन हेतु मुo 5000/- (पाँच हज़ार रुपये) ्ऺितमाह िकराया इस आदेश की ितिथ से संदाय करेगा ।
3. ्ऺत्यथर् संo 1 को धारा 22 के अन्तगर्त आदेिशत िकया जाता है िक वह इस आदेश के छ: माह के अन्दर ्ऺािथया को ्ऺितकर और ्षितपूित के रूप में 1,00,000/- (एक लाख रुo) एकमुश्त ्ऺदान करें । 3 NA529 No. 3630 of 2025
4. ्ऺस्तुत ्ऺाथर्नाप्ऴ ्ऺत्यथर् संo 4 के िवरु्ध िनरस्त िकया जाता है ।
5. आदेश ्ऺाथर्नाप्ऴ की ्ऺस्तुित की ितिथ से लागू होगा । इस आदेश की एक- एक ्ऺित उभयप्ष को िन: शुल्क ्ऺाप्त करायी जाये एवं एक ्ऺित िजला ्ऺोबेशन अिधकारी / संर्षण अिधकारी एवं सम्बिन्धत थानाध्य्ष/ थाना ्ऺभारी को अनुपालनाथर् ्ऺेिषत की जाए । "
9. The opposite party nos.2 to 4 had preferred appeal, which ended in dismissal of the same on merits. There is nothing on record to show whether the order passed in appeal dated 19.09.2024 is assailed in the higher forum or not.

The application for execution has been moved under Rule 6(5) of the Protection of Women from Domestic Violence Rules, 2006, which provides that, "the application under Section 12 shall be dealt with and the orders enforced in the same manner laid down under Section 125 of Code of Criminal Procedure, 1973 (2 of 1974)."
11. The order sheet of the court concerned reveals that the application is pending since 30.04.2024, which has not been disposed of till 11th August, 2025. There is no reason assigned in the orders to show the reason for pendency of the application. As such, this Court is of the view that the court concerned shall dispose of the application moved by the applicant under Rule 6(5) of the Protection of Women from Domestic Violence Rules, 2006 expeditiously. So far as, the disposal of the application dated 28.05.2025 is concerned, the court concerned may look into the order and dispose of the same as per law.
12. With these observations, the application is disposed of.
