Judgment

Heard learned counsel for the petitioner and perused the record.

The instant writ petition has been filed for following relief: " (a) To pass suitable order or direction, directing the Civil Judge (Junior Division) Mirzapur to decide the application dated 21.08.2024 under order 39 rule 1 of C.P.C. in case No.570/2021 (Vikas Bahadur Vs. State of U.P. and others), within stipulated period which may be fixed by this Hon'ble Court. (b) To pass suitable order or direction, directing the respondent No.4 not to interfere in the peaceful possession of the petitioner and maintain the status quo over the land in dispute during the pendency of the application under order 39 rule 1 of C.P.C. pending before the No.4 not to respective authority. "

Contention of learned counsel for the petitioner is that an application dated 21.08.2024 is pending before Civil Judge (Junior Division) Mirzapur and the same has not been decided despite several dates have been fixed. He prayed that the same may be decided, expeditiously.

In view of above, no useful purpose would be served in keeping this petition pending.

Accordingly, the present petition stands disposed of finally with a direction to the Civil Judge (Junior Division) Mirzapur to consider and law, decide expeditiously, preferably within a period of twelve weeks from the date the aforementioned application, in accordance with 2 A227 No. 11439 of 2025 of production of a certified copy of this order after ensuring service upon all the concerned parties as well as giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided that there is no other legal impediment.
