Learned Senior Advocate for the petitioner contends that if the relevant provisions of old transfer policy dated 07.06.2023 prescribed in clause 12 is taken into consideration in its entirety, it would reflect that earlier the maximum stay for an elected office bearer was for a period two years, therefore, if the term was of two years only, then the words and expression used "for a further period of two years beyond expiry of term" would mean that maximum period of two years, whereas, this rider has not been further prescribed in the transfer policy and hence it would mean that the elected office bearers even if re-elected for the same employees' union in the same district, then he will have the advantage to continue for another term for which he has been elected and therefore, they would fall in the category of exception clause.

Per contra it is argued by learned Standing Counsel Mr. Gaurav Singh that interpretation which is being given to clause 12 of the new policy is absolutely misplaced one for the reason that earlier transfer policy provided more opportunity for an officer bearer to continue at one station beyond the period of last term for which he has been re-elected. He has taken the Court to the relevant provisions of clause 12 of the old transfer policy dated 07.06.2023. 2 WRIA No. 11466 of 2025

Having heard learned counsel for the respective parties and having perused the records, I find it more appropriate to go through the relevant provision and in order to appreciate, I reproduce first the provisions as contained in the old transfer policy dated 07.06.2023 vide clause 12. "12- सरकारी कमर्चािरयों के मान्यता ्ऺाप्तसेवा संघों के पदािधकािरयों के स्थानान्तरणः- सरकारी सेवकों के मान्यता ्ऺाप्त सेवा संघों के ्ऺदेश/मण्डल/िजला स्तर के अध्य्ष एवं सिचव के स्थानान्तरण उनके ्षारा संगठन में पदधािरत करने की ितिथ से 2 वषर् तक न िकये जायें। िकन्तु लापरवाह/्ऽ्िाचार/अपिरहायर् पिरिस्थितयों की दशा में स्षम स्तर के अनुमोदनोपरांत 1- यह शासनादेश इलेक््िािनक्ली जारी िकया गया है इस पर हस्ता्षर की आवश्यकता नहीं है। 2- इस शासनादेश की ्ऺमािणकता वेबसाइट http://shasanadesh.up.gov.in से सत्यािपत की जा सकती है। यथावश्यकता स्थानान्तरण िकया जा सके गा। िजन कािमकों का नीित में अिधकतम कायर्काल (3 वषर् / 7 वषर्) पिरभािषत है, वह कािमक यिद 02 वषर् से अिधक समय के िलये अध्य्ष/सिचव के पद पर िनवार्िचत होता/रहता है, तो उसे स्थानान्तरण नीित में यह छू ट उ्व अिधकतम कायर्काल समाप्त होने के स्ऴ से अिधकतम 02 वषर् तक ही िमल सके गी। समूह 'ग' तथा समूह 'घ' ्शेणी के कािमक यिद 02 वषर् से अिधक समय के िलये अध्य्ष/सिचव के पद पर िनवार्िचत होता/रहता है तो उन्हें यह सुिवधा उनके िकसी जनपद के कायर्काल की अविध के आधार पर इस नीित के अनुसार स्थानान्तरण पिरिध में आने वाले स्ऴ से अिधकतम 02 वषर् तक िमल सके गी। िजन पदािधकािरयों के स्थानान्तरण समयाविध के पूवर् िकये जाने हों, उनके संबंध में मा० िवभागीय मं्ऴी जी से भी िवचार-िवमशर् करके कायर्वाही की जाए।"

Upon a bare reading of the aforesaid provision, it is quite explicit that where the employees are elected for a term ranging between 3 years to 7 years as per their own election rules and if such an office bearer for the post of President/ Secretary is elected for a period beyond two years and/ or consecutively/ keeps electing to such office, then he will be entitled to continue to stay back at that station not more than two years from the last maximum period of term of the elected office and in respect of Group - C and Group - D employees, if an employee is elected for a term more than 3 WRIA No. 11466 of 2025 two years, then he will be entitled to stay back at a station for a maximum period of two years beyond the expiry of last maximum tenure of elected office. However, the words and expression used tend to some confusion.

Now I proceed to examine the relevant clause 12 of the new policy brought into force on 06.05.2025, the relevant provision as contained under clause 12 is reproduced hereunder: "12. सरकारी कमर्चािरयों के मान्यता ्ऺाप्त सेवा संघों के पदािधकािरयों के स्थानान्तरण- सरकारी सेवकों के मान्यता ्ऺाप्त सेवा संघों के ्ऺदेश/मण्डल/िजला स्तर के अध्य्ष एवं सिचव के स्थानान्तरण उनके ्षारा संगठन में पदधािरत करने की ितिथ से 2 वषर् तक न िकये जायें। िकन्तु उ्व पदािधकािरयों को यह सुिवधा देने का अथर् यह नहीं है िक जनिहत के िवरु्ध कायर् करने, कदाचार अथवा ्ऽ्ि आचरण करने पर भी उनका स्थानान्तरण नहीं िकया जा सकता। लापरवाही, ्ऽ्िाचार व आपरािधक कृ त्य, अनुशासनहीनता व दुराचरण में िलप्त होने के पुि्िकारक तथ्य लाये जाने पर या ऐसे मामलों में अनुशासिनक कायर्वाही ्ऺारम्भ होने पर िनम्न ्ऺि्वया का पालन करते हुये उ्व पदािधकािरयों को पूरे स्ऴ में कभी भी स्थानान्तरण िकया जा सके गाः- i. जनपद में तैनात सेवा संघों के पदािधकािरयों का स्थानान्तरण संबंिधत िजलािधकारी एवं मण्डल में कायर्रत पदािधकारी का स्थानान्तरण मण्डलायु्व की संस्तुित पर स्षम स्तर से िकये जा सकें गे। ii. मुख्यालय स्तर पर सेवा संघों के पदािधकािरयों का स्थानान्तरण िवभागाध्य्ष की संस्तुित के उपरांत शासन स्तर से िकया जा सके गा। उपरो्व के अितिर्व सेवा संघों के उ्व पदािधकािरयों का शासनादेश िदनांक 13 मई, 2022 के अनुसार पटल ्षे्ऴ पिरवतर्न अवश्य िकया जायेगा तथा इसकी संपूणर् िजम्मेदारी िनयं्ऴक ्ऺािधकारी की होगी।

From a bare reading of the aforesaid provision, it is clear that the office bearer to the post of President/ Secretary of a recognized employees union whether State level, or Division level or district level, shall not only over stay at a station for more than 2 years of the date of their election.

A comparative study of the two clauses of old and new policies, leads to an inference that not only confusion earlier created is removed but the 4 WRIA No. 11466 of 2025 liberal approach that was given in the earlier policy considering the tenure of an office bearer which may have varied between 3 and 7 years and then his continuance for a further period of two years beyond the last maximum period of tenure of elected office, has completely been done away with.

Now as per the new provisions contained under clause 12 whether an office bearer is elected for a period of 1 year/ 2 year/ 3 year or more, as the case may be, as per election rules, such an office bearer shall not continue to stay back at a station beyond maximum period of two years of his/ her election. This therefore, clearly establishes that elected office bearer cannot continue to remain posted for more than two years, may be they are elected for second consecutive term.
12. In the circumstances, therefore, the argument advanced by learned Senior Advocate appearing for the petitioner that the new transfer policy accommodates the office bearers elected for two consecutive terms, are not to be transferred as they would fall within the exception clause 12, is absolutely untenable.
