Judgment

The instant writ petition has been filed seeking for the following reliefs:- " i. Issue a writ, order or direction in the nature of Mandamus commanding the Prescribed Authority, respondent no.2 to decide pending reference in terms of Section 25 (1) within shortest period of time which may be stipulated by this Hon'ble Court in exercise of extra-ordinary jurisdiction under Article 226 of the Constitution of India. "
Learned counsel appearing on behalf of petitioners submitted that reference in terms of Section 25 (1) of the Societies Registration Act is pending before respondent no. 2-Prescribed Authority but even notice has not been issued in the said reference. Learned counsel appearing on behalf of petitioner prayed that authority concerned may be directed to decide the said reference expeditiously in time bound manner.
Per contra, Sri Santosh Kumar, learned standing counsel appearing on behalf of respondents has no objection to the prayer made by learned counsel for the petitioners.
Heard Sri Saurabh Tripathi holding brief of Sri Prabhakar Awasthi, learned counsel appearing on behalf of petitioners and Sri Santosh Kumar, learned Standing Counsel and perused the contents made in the writ petition.
Without entering into merits of the case, I am inclined to allow the prayer made by learned counsel for the petitioners. The respondent no.2 is directed to decide the aforesaid pending reference in accordance with law, expeditiously, preferably within a period of six weeks from the date of receipt of certified copy of this order.
