Judgment

Heard Shri Raghav Dev Garg, learned counsel for the petitioner; Shri Pranjal Mehrotra, learned counsel for the respondent nos.2 to 3 and Shri Suresh Singh, learned Additional Chief Standing Counsel for State respondent no.4.

The instant writ petition is preferred questioning the validity of the impugned Gazette notification dated 11.03.2024 issued by the respondent no.1. In the alternative, the request has been made to issue direction to the respondents to provide use-able access from the highway to all pockets of the petitioner's remaining land and to realign the highway so as not to obstruct the petitioner's gate, as requested in its applications dated 08.05.2025, 26.05.2025 and 16/17.06.2025 or in absence of such access, to acquire the entire land by awarding just and lawful compensation to the petitioner.

In response to the previous order dated 16.07.2025, Shri Pranjal Mehrotra, learned counsel for the respondents has placed detailed instructions sent by the Project Director, National Highway Authority of India (NHI) dated 21.07.2025, wherein it has been indicated that based on approved alignment for the subject project, the Gazette notifications under Section 3A and 3D of National Highways Act, 1956 (in short, Act, 1956) were published on

06.02.2024 and 11.03.2024, respectively. The Competent Authority has declared the award for Tappal village on 15.02.2025 and the compensation has already been released to the landowners on 06.05.2025. In para 4(vi) of the instruction, it has been indicated that the NHAI has already made provision of service road on both sides of proposed National Highway near the said location. The P&P of the said location is attached along with the instruction for reference and as such, the apprehension, which has been shown by the petitioner, is devoid of merit.

We have proceeded to examine the record in question and also perused the instruction, which has been placed before us. We find that once the Project Director had submitted the detailed instruction, wherein it has already been indicated that the NHAI has already made provision of service road on both sides of proposed National Highway near the petitioner's location, we declined to entertain the instant writ petition.
