Smt. Pushpa Rathuar);"

2. On 18.07.2024, the matter was referred to Mediation and Conciliation Centre of this Court and following order was passed:- "1. Heard learned counsel for the petitioner.

2. Present petition has been filed with the following prayers: (i) To exercise it powers of superintendence as enshrined under Article 227 of the Constitution of India to annul/set aside the impugned order dated 01.05.2024 , by which interim maintenance of Rs. 5,000/- per month and expenses of Rs. 10,000/- towards expenses of litigation and Rs. 300/- for appearance before the court below on each date has been directed. (ii) To exercise it powers of superintendence as enshrined under Article 227 of the Constitution of India to direct Principal Judge, Family court, Pilibhit not to take any coercive measure and to give effect the impugned order dated 01.05.2024 passed by the Additional Principal Judge, Family Court, Pilibhit on Application 12-Kha under Section 24 of the Hindu Marriage Act in Matrimonial Case No. 53 of 2023."

It is submitted by learned counsel for the petitioner that petitioner has filed Divorce Petition under Section 13 of the Hindu Marriage Act, 1955, being Divorce Petition No. 53 of 2023, in which vide impugned order dated 01.05.2024, petitioner has been directed to pay interim maintenance to respondent-wife. It is next submitted that respondent-wife of petitioner has also filed application under Section 9 of the Hindu Marriage Act, 1955 for restitution of conjugal rights and as matter relates to a matrimonial dispute between husband and wife, the said matter can be well considered by Mediation Centre of this Court. It is further contended that there are chances of reconciliation between the parties, therefore the matter may be referred to the Mediation Centre of this Court.

4. At present, prima facie, it does appear that the present proceedings do arise out of the matrimonial dispute between the parties. Therefore, it further appears, if the parties were to be offered assistance of mediation, they may be able to resolve their differences and bring an end to all disputes and differences between them, amicably.

5. It is directed that petitioner shall deposit a sum of Rs. 15,000/- within two weeks from today with the Mediation Centre of which Rs. 10,000/- shall be paid to the respondent for appearance before the Mediation Centre on a date to be fixed by the mediation center. Balance Rs. 5,000/- shall be retained by the mediation center towards its expenses.

6. The matter is referred to the Mediation Centre with the direction that same may be tried to be resolved after giving notices to both the parties.

7. It is directed that Mediation Centre shall proceed in the matter expeditiously preferably within a period of three months. Thereafter the case shall be listed before appropriate Bench.

8. Subject to the petitioner depositing the amount of Rs. 15,000/- as above, till the next date of listing, effect and operation of impugned order dated 01.05.2024 passed Divorce Petition No. 53 of 2023 shall be kept in abeyance.

9. After depositing the amount, aforesaid, notice shall be issued to the parties and in the case the aforesaid amount is not deposited within the aforesaid period, the interim protection granted above shall automatically be vacated."

3. A report dated 21.01.2025 has been submitted by Mediation Centre to this Court wherein it has been stated that mediation has been completed and copy of agreement has been enclosed. 4. As the parties have entered into an agreement and the report of Mediation and Conciliation Centre of this Court has been submitted to this Court and is on record, this Court finds that no dispute remains between the parties.

5. In view of said fact, the impugned order dated 01.05.2024 passed by Additional Principal Judge, Family Court, Pilibhit on application 12B under Section 24 of Hindu Marriage Act is hereby set aside.
