1. Heard Sri Lal Mani Singh, learned counsel for the petitioner and Sri Tarun Gaur, learned standing counsel for the state-respondents.

2. Brief facts of the case are that impleadment application filed by petitioner in the proceeding under Section 21 of the U.P. Urban Premises Tenancy Regulation Act, 2021 has been rejected vide order dated 16.12.2024. Hence, the instant writ petition has been filed for the following relief:- "I. issue a writ order or direction in the nature of certiorari quashing the impugned order dated 16.12.2024 passed by the Respondent No.2, Additional District Magistrate, Kanpur Nagar in Rent Computerized Case No.D202303410000958 (Masood Jamal and others versus Kamar Ali), Under Section 21 of U.P. Urban Premises Tenancy Regulation Act, 2021. No.958 of 2023, Suit II. issue a writ order or direction in the nature of mandamus, directing the landlord/respondent nos.3 to 5 to implead the name of the petitioner in Rent Suit No.958 of 2023, computerized Case No.D202303410000958 (Masood Jamal and others vs. Kamar Ali), under Section 21 of the U.P. Urban Premises Tenancy Regulation Act, 2021, pending before the Additional District Magistrate, Kanpur Nagar."

Counsel for the petitioner submitted that the impleadment application filed on behalf of the petitioner in the pending proceeding, has been rejected in arbitrary manner, without considering the case of the petitioner as set up in the application. He submitted that the right of the petitioner will be affected if the pending proceeding is decided, without impleading the petitioner as well as without affording opportunity of hearing to the petitioner. He submitted that the impugned order should be set aside and the application for impleadment filed on behalf of the petitioner should be allowed.

Sri Tarun Gaur, learned standing counsel submitted that reason has been assigned while passing the impugned order for rejecting the impleadment application filed by the petitioner, as such, no interference is required in the matter. He submitted that two cases, one filed by the petitioners' father and another filed by the petitioner has been consolidated along with instant case wherein hearing is going on in all the cases, as such, application for impleadment filed by the petitioner has been rightly rejected under the impugned order.

5. I have considered the arguments advanced by learned counsel for the parties and perused the records.

6. There is no dispute about the fact that the proceeding under Section 21(2) of the U.P. Urban Premises Tenancy Regulation Act, 2021 is pending before the court concerned and the impleadment application filed by the petitioner has been rejected under the impugned order during pendency of the proceeding.

In order to appreciate the controversy involved in the matter, perusal of the impugned order dated 16.12.2024 will be relevant which is as under:- "आददेश प्ቔक नययययलय अपर जजलयजधकयरर सपलयई मणडल कयनपपर जनपद तहसरल वयद ससखयय:- 958/2023 कस पययटररकक त वयद ससखयय :- D202303410000958 मसयद जमयल आदद बनयम कमर अलर अनतररत धयरय :- 21 (2), अजधदनयम :- उ०प० नरररय पररसर दकरययदेदयरर दवदनयमन अजधदनयम, 2021 ददनयनक : 16.12.2024 :- पसतपत वयद ससखयय- 958/2023 मसयद जमयल आदद बनयम कमर अलर अनतररत धयरय- 4(3), 21(2) कक वयद प्ቔयवलर मम अकबर अलर पप्ቔ कमर अलर दयरय अपनदे अजधवकय शर नयर आलम कदे मयधयम सदे पककयर बनययदे जयनदे कय आवदेदन ददनयसक 10.10.2024 कक दकयय रयय हह। इस पयररनय प्ቔ पर उभय पक कक सपनय रयय। इस पयररनय प्ቔ कदे दनसतयरण कदे कम मम वयद प्ቔयवलर कय अवलककन दकयय रयय। मसयद जमयल आदद दयरय पशनरत भवन कदे परम ददनयसक 04.05.2023 कक एसव ददतरय खणड ससरत दकरययदेदयरर पररसर कदे समबनध मम मम वयद दयजखल दकयय रयय हह जजस पर पदतवयदर/आवदेदक अजधदनयम कक धयरय 4(3), 21(2) दपतय शर कमर अलर दयरय अपनदे अजधवकय शर नयर आलम कदे मयधयम सदे अकबर अलर कदे ददनयसक 24.07.2023 कक आपजत प्ቔ दयजखल दकयय रयय। पदतवयदर कमर अलर कदे आवदेदन प्ቔ पर उसदे सयकय / बहस दयजखलय दकयदे जयनदे हदेतप वयद प्ቔयवलर मम ददनयसक 10.10.2024 कक दतजर दनयत कक रयर। दनयत ददनयसक 10.10.2024 कक कमर अलर कदे पक मम सयकय बहस दयजखल नहर दकयय रयय परनतप पदतवयदर कमर अलर कदे पप्ቔ शर अकबर अलर कक पककयर बनययदे जयनदे हदेतप पयररनय प्ቔ पसतपत दकयय रयय। पसतपत पयररनय प्ቔ पर वयदर अजधवकय दयरय आपजत जतयतदे हहए करन दकयय रयय दक दवपकर जयनबयझकर दवदभन तररकक सदे वयद कदे दनसतयरण कक दवलसमबत करनदे कय पययस कर रहय हह इसर कम मम शर अकबर अलर दयरय दबनय दकसर आधयर कदे पयररनय प्ቔ पसतपत दकयय रयय हह। आवदेदक अकबर अलर सदे उसकय दकरययदेदयरर कय ककई समबनध नहर हह। समपयणर दकरययदेदयरर वयलदे भयर पर आवदेदक कदे दपतय कमर अलर हर दकरययदेदयर हह। कक वयद मम उपससरत आयदे एसव ददनयसक 27.10. 2023 वयदर अजधवकय दयरय यह भर अवरत करययय रयय हह दक इस बयद कक शरघ दनणरत दकयदे जयनदे कदे समबनध मम मयननरय उचच नययययलय इलयहयबयद दयरय ययदचकय ससखयय- 3368/2024 मम पयररत आददेश ददनयसक 04.03.2024 दयरय दनदरदशत दकयय रयय हह। इसकदे अदतररक यह भर जलए शर कमर अलर एसव शर अकबर अवरत करययय रयय दक पशनरत दकरययदेदयरर पररसर कदे अलर दयरय अजधदनयम कक धयरय-14(1) वयद दयजखल अलर 02 व (3) दकयदे रयदे हह। जजनकक सपनवयई इसर वयद कदे सयर कक जय रहर हह। वयदर अजधवकय कय करन हह दक उक वयद कदे मयधयम सदे आवदेदक अकबर अलर कय करन नययययलय कदे समक पयवर सदे हर दयजखल हह वयद कक लसमबत करनदे कदे उदददेशय सदे पसतपत पयररनय प्ቔ ददनयसक 10. 10.2024 दनरसत दकयय जययदे। अजधदनयम कक धयरय- 14 (1) व (3) कदे अनतररत आवदेदक अकबर अलर दयरय दयजखल वयद ससखयय-357/2023 कदे मयधयम सदे उसदे अपनय पक रखनदे कय पययप अवसर पयप हह ऐसर ससरदत मम आवदेदक शर अकबर अलर पप्ቔ कमर अलर कक अलर सदे पककयर बनययदे कय परम दषयय ककई औदचतय नहर पययय जयतय। कदे अनतररत अलर- कदे समयक अनपपयलन मम दववयददत पररसर कदे उपरकक तथयक कदे आलकक मम आवदेदक शर अकबर अलर पप्ቔ कमर अलर दयरय पसतपत पयररनय प्ቔ ददनयसक 10.10.2024 दनसतयररत दकयय जयतय हह। मय० उचच नययययलय दयरय पयररत आददेश ददनयसक 04.03.2024 दकरययदेदयरर कदे समबनध मम दवचयरयधरन पकरण कक असनतम रप सदे दनणरत दकयदे जयनदे कदे ददषरत वयद ससखयय 356/2023, वयद ससखयय- 357/2023 कदे पककयरक कक दनदरदशत दकयय जयतय हह। दक दकरययदेदयरर कदे बयवत अपनदे- अपनदे दयवय एसव आपजत कक पपदष करनदे हदेतप अपदेदकत समसत अदभलदेखरय सयकयक कक पमयदणत एसव मयल पदतयक कदे सयर ददनयसक 23.12.2024 तरय वयद ससखयय- 958/2023 कक बहस पसतपत करनय सपदनसशचत करम। ह०अ०

Perusal of the impugned order as quoted above fully demonstrate that petitioner is son of Kamar Ali and Kamar Ali is party in the instant proceeding as well as separate proceeding initiated under Section 14(1) and (3) by petitioner-Akbar Ali and petitioner's father Kamar Ali are connected with the instant case, as such, petitioner has full opportunity to contest the proceedings rather impleadment application in order to linger on the pending proceeding.

9. It is also material to mention that this court in Misc. Petition No.3368 of 2024 has expedited the proceeding of instant case which is mentioned in the impugned order as quoted above.

10. Considering the entire facts and circumstances of the case, no interference is required against the impugned order dated 16.12.2024 rejecting the impleadment application filed by petitioner.
