Judgment

Even in the revised call no one has appeared on behalf of petitioner to press the writ petition, however, Sri Alok Kumar Yadav, learned counsel, is present for the respondents.

It is a case where the plaintiff respondent no. 1 had instituted a civil suit in which an application for grant of temporary injunction was moved, which was allowed by the trial court. Aggrieved defendant petitioner had filed a misc. civil appeal under Order XLIII Rule 1 (d) CPC, which was also dismissed.

I have heard learned counsel for respondents and perused the material on record. No case is made out for interfering with the interim injunction order granted by trial court and affirmed by the appellate court.

Writ petition fails and is hereby dismissed.
