Judgment
Heard Mr. Ashok Khare, Senior Advocate assisted by Mr. Ravi Kumar Yadav, learned counsel for the petitioner and Mr. Mewa Lal Gupta, Standing Counsel appearing on behalf of respondents.
The petitioner, before this Court, is aggrieved that his appointment on the post of Headmaster was rejected on ground that his experience certificate was not in terms of requisite provisions as it was not from an institution recognized under the provisions of U.P. Basic Education Act, 1972.
Learned Senior Counsel has fairly submitted that in similar circumstances, this Court has taken a view against petitioner in Amit Kumar vs. State of U.P. and Ors. 2024; AHC; 7645 placing reliance on Arun Kumar Chaturvedi vs. State of U.P. and Ors. 2010 (1) ALJ 467.
Learned counsel further submits that the aforesaid judgment is now under challenge before the Division Bench. However, there is no interim order therein.
3. Mr. Mewa Lal Gupta, learned Standing Counsel appearing on behalf of State respondents submitted that since this Court has already taken a view, therefore, this writ petition may be disposed of in terms of the Amit Kumar (supra).
4. I have considered the above submissions. As referred above, this Court had already taken a view against the claim of the petitioner in Amit Kumar (supra) on basis of earlier judgment passed by Division Bench of this Court in Arun Kumar Chaturvedi (supra).
