1. Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondent and Mr. Bhupendra Kumar Tripathi learned counsel for Gram Sabha. 2. Brief facts of the case are that village-Chitaudi, Pargana- Rari, Tehsil-Sadar, District-Jaunpur was brought under consolidation operation by way of notification dated 30.9.1991 issued under section 4 of U.P. Consolidation of Holdings Act, 1953 (hereinafter referred to as U.P.C.H. Act). The village in question was notified under section 9 of U.P.C.H. Act on 30.4.1998 and publication under section 10 of U.P.C.H. Act in respect to aforementioned village in question was made on 20.03.2012. The publication under section 20 of U.P.C.H. Act was made on 27.7.2013 and confirmation under section 23 of U.P.C.H. Act was made on 13.11.2013 . According to the petitioner, the possession of his plot as well as other tenure holder was not given by the respondent authorities accordingly petitioner as well as gram pradhan moved application before the authorities for taking necessary steps in the matter but no steps were taken by the authorities hence petitioner filed Writ B No.847 of 2021 before this Court, which was disposed of vide order dated 21.06.2021 with direction to petitioner to represent his grievance before the Collector who shall examine the grievance in accordance with law. Decision
2021 Collector/District Deputy Commissioner, Jaunur passed the order dated 01.06.2022 deciding the representation dated 1.4.2022/26.5.2022. Petitioner filed a contempt application before this Court for compliance of the order passed by Writ Court dated 21.06.2021 accordingly this Court disposed of the contempt application No.4829 of 2022 with certain direction by granting three months' further time to collector to take steps in the matter. The Consolidation Commissioner accordingly passed an order dated 05.09.2022 by which previous consolidation proceeding was cancelled and fresh consolidation proceeding was directed to be made by authorities. Hence this writ petition for the following relief: "i) issue, a writ, order or direction in the nature of certiorari quashing the impugned order dated 5.9.2022 passed by the Consolidation Commissioner/Respondent No.2 (Annexure No.7 to this petition). ii) issue, a writ, order or direction in the nature of mandamus staying the further proceedings in pursuance to impugned order dated 5.9.2022 passed by Consolidation Commissioner/ Respondent No.2 during pendency of present petition before this Hon'ble Court. . iii) issue, a writ, order or direction in the nature of mandamus directing the respondent authorities to deliver the possession of the Plot No.714 situated in Village Chitaudi, Pargana Rari, Tehsil Sadar, District Jaunpur to the petitioner forthwith." 3. Learned counsel for the petitioner submitted that impugned order has been passed in illegal and arbitrary manner as such the same is liable to be set aside. He further submitted that by passing the impugned order cancelling the previous consolidation proceeding, Consolidation Commissioner has failed to consider the fact that by fresh consolidation proceeding, dispute will again arisen among villagers which will not be proper. He further submitted that previous proceeding was initiated in the year 1991 and same was completed in 2013 as such initiation of consolidation proceeding afresh is wholly illegal. He submitted that impugned order has been passed in mechanical manner as such the same is liable to be set aside. He submitted that impugned order dated 05.09.2022 should be set aside and respondent authority should be directed to deliver the possession of plot number 714 in favour of petitioner. 4. Learned Standing Counsel and learned counsel for the Gaon Sabh submitted that there is no illegality in the impugned order passed by Consolidation Commissioner. They further submitted that village has been notified under Section 4 of U.P.C.H. Act on 30.09.1991 but due to obstruction created by petitioner along with other villagers, consolidation operation has not been concluded even after expiry of more than 34 years. 5. I have considered arguments advanced by learned counsel for the petitioner, learned Standing counsel for the State, learned counsel for the gaon sabha and and perused the record. 6. There is no dispute about the fact that village was notified under section 4 of U.P.C.H. Act vide notification dated 30.09.1991 but consolidation operation has not been completed till date. 7. Perusal of the impugned order demonstrate that in pursuance of the earlier order of this Court, thorough enquiry was conducted by the authorities and it has been found that fresh consolidation scheme should be prepared after cancelling the earlier consolidation Scheme within stipulated period. The enquiry report prepared by the authorities dated 29.7.2022 is annexed along with personal affidavit dated 1.12.2022 9. Considering the impguend order dated 05.09.2022 as well as other evidence on record, there is no scope of interference against the impugned order dated 5.9.2022 passed by Additional Commissioner/ Commissioner Consolidation U.P. Lucknow. 10. The writ petition is dismissed and authorities are directed to proceed according to the impugned order dated 5.9.2022 expeditiously and strictly according to the provisions of the Act and Rules framed thereunder.
