Heard learned counsel for the applicants, learned A.G.A. for opposite party no. 1 and Sri Amrit Mishra for opposite party no. 2.
This application has been filed challenging the charge-sheet dated
07.09.2021 submitted in Case Crime No. 71 of 2021, Police Station- Chirgaon, District- Jhansi and cognizance/summoning order dated
26.04.2022 passed by the learned Chief Judicial Magistrate, Jhansi as well as entire proceedings of ST No. 1199 of 2022 (State vs. Gautam and others) arising out of Case Crime No. 71 of 2021, under Sections 147, 148, 149, 452, 323, 352, 504, 506, 427, 308 I.P.C., Police Station- Chirgaon, District- Jhansi, pending in the court of Additional District and Sessions Judge, Court No.-1, Jhansi on the basis of compromise verified by Additional District and Sessions Judge, Court No.-1, Jhansi dated
19.02.2025.
It is jointly stated that pursuant to the directions issued by this Court in previous application, being Application U/S 528 BNSS No.- 4033 of 2025, the compromise has been verified by the court concerned on
19.02.2025. The said order is appended at page 144 of the paper-book.
Considering the amicable settlement of dispute between the parties, nature of allegations and in view of the law laid down by the Hon'ble Supreme Court in Gian Singh vs. State of Punjab and another; (2012) 10 SCC 303 and Nikhil Merchant vs. Central Bureau of Investigation and another; (2008) 9 SCC 677, the application deserves to be allowed. 2 NA528 No. 15981 of 2025
Accordingly, the application is allowed.
