posts of CT Grade Teachers were available. One Sri Shankar Dayal Pandey, while working as a teacher in LT Grade was given ad-hoc promotion to the post of Lecturer Grade w.e.f. 17.02.1986. Sri Shyam Behari Singh, who was working as an assistant teacher in LT Grade in the same institution was given ad-hoc promotion as LT Grade in the vacancy caused by promotion of Sri Shankar Dayal Pandey as Lecturer. In view of completion of 10 years of services in LT Grade, the said Shyam Behari Singh has been absorbed into the said post w.e.f.

22.01.1987. As a result of the said appointment, a short term vacancy arose in the fifth respondent institution. Consequently, after following the procedure contemplated under the U.P. Secondary Education Service Commission (Removal of Difficulties) (Second) Order, 1981, the petitioner was selected and appointment orders were issued on

22.04.1991. The same was intimated to the District Inspector of Schools, Kanpur Nagar vide letter dated 6.5.1991. Subsequently, the petitioner has joined the said post on 22.04.1991 and continuously working in the said institution.

4. Sri Shankar Dayal Pandey, who was given ad-hoc promotion to the post of Lecturer stood regularized on the said post w.e.f. 6.4.1991 as per the provisions of Section 33-A of the U.P. Secondary Education Service Selection Board Act, 1982. Accordingly, the order of regularization was passed on 18.07.1996. In view of the abovesaid orders, short term vacancy upon which the petitioner was working stood converted into substantive vacancy on the post of Assistant Teacher in LT Grade.

5. As the petitioner was appointed and working continuously, the 3 management has sent salary bills of the petitioner but the financial approval was not granted. Hence, the petitioner approached this Court by way of Writ A No. 30622 of 1991 for payment of his salary, which was disposed of. Consequent upon, the fourth respondent has passed an order on 22.02.2002 refusing to grant financial approval to the appointment of the petitioner. Left with no option the petitioner has approached this Court once again by means of Writ A No. 16065 of 2002. The said writ petition was disposed of vide order dated 15.05.2006 by quashing the impugned order therein dated 22.02.2002 and declaring that the petitioner is entitled to salary along with arrears. The said order became final.

6. Subsequently, the respondents have passed an order on 29.06.2006 approving the services of the petitioner w.e.f. 22.4.1991 and accordingly, they have released the entire salary, including arrears. But surprisingly, the respondents have not regularized the services of the petitioner despite the papers submitted by respondent no. 5 was in a prescribed format and the said proposal was rejected by the respondents, once again, vide impugned order dated 21.7.2015. Assailing the said orders, present writ petition has been filed.

Based on the abovesaid facts, learned counsel for the petitioner has pointed out that the impugned orders are not only contrary to the record, but also to the orders passed by this Court in Writ A No. 16065 of 2002 dated 15.05.2006. To support her contention, learned counsel for the petitioner has taken this Court to the observations made by this Court in the orders passed in earlier Writ A No. 16065 of 2002, which reads as under: “The one of the ground in the impugned order is that appointment was without prior approval. From the fact as noted hereinabove, the approval of ad hoc promotion of Shanker Dayal Pandey to the Lecturer grade necessarily created a short-term vacancy in L.T. grade. After due advertisement, the petitioner was selected and the papers were sent to the District Inspector of Schools on 6.5.1991. This allegation made in 4 para 12 to the writ petition has not been denied in the counter affidavit. It is apparent that in spite of the receiving the papers for granting approval, the District Inspector of Schools did not pass any order. Clause 2 (3) (iii) of the U.P. Secondary Education Service Commission (Removal of Difficulties) Order, 1981 provides as under: "The District Inspector of Schools shall communicate his decision within seven days of date of particulars by him failing which the same will be deemed to have given his approval." A bare perusal of the said provision to show that a mandate has been issued to the District Inspector of Schools to pass orders either approving or disapproving the proposed appointment and in case, the order is not passed within seven days of the receipt of the papers or proposal, a legal fiction has been created by which the said proposal will be deemed to be approved. This ratio has been accepted in several cases including by a Division Bench judgment of this Court in case of Ashika Prasad Shukla Vs. District Inspector of Schools and another reported in 1998(3) UPLBEC 1722 and the said decision has been followed in several cases, therefore, the first ground given in the impugned order cannot be sustained as it was a case of deemed approval. The second ground on which the claim of the petitioner has been rejected that without prior permission the advertisement inviting application for short term appointment could not be issued. In the impugned order or in the counter affidavit or during the argument the reference to any provision of law where such a requirement is mandatory has been disclosed. The appointment to the short term vacancies, at the relevant time, was governed by the Second Removal of Difficulties Order as explained by the Full Bench Decision of this Court in case of Raza Raizada and others Vs. Committee of Management, (1994) 3 UPLBEC 1551. The another ground given in the impugned order is that before filing the vacancy, the Management ought to have obtained financial approval of the post. It is not the case of the respondents that Sri Shanker Dayal Pandey, who was working as L.T. grade teacher was given ad hoc promotion in the Lecturers grade with effect from 17.2.1986. It is also not the case of the respondents that Sri Shayam Bihari Singh, who was working as assistant teacher in L.T. grade was not drawing his salary in L.T. grade. It is also not the case of the respondents that at any time financial approval to that post was withdrawn by the respondents. There is no requirement of law to obtain further approval while making short- term appointment on the post except when the post has been abolished, but it is not the case of the respondents. The Learned Standing Counsel has failed to point out any provision of law by which such a requirement has been placed upon the Management. The next ground taken in the impugned order that in accordance with the actual strength of students only 18 sections were being operated and according to the norms only 13 teachers can be appointed and 26 5 teachers were working in L.T. grade, therefore, there was no vacancy to be filled up. The case set up before the Management was that there were 23-sanctioned post of L.T. grade teachers and 8 posts of C.T. grade teachers in the institution and this fact has not been denied by the respondents in the counter affidavit or during the argument. Further, even the number of students have not been disclosed in the impugned order which hold that only 10 sections were being operated. Even in the counter affidavit, the strength of the students has not been disclosed. Though the petitioner has come with a case that no section has been reduced and the strength of the students is the same and that cannot be a ground for rejection of the claim of the petitioner. It is also to be noted that the management has got no jurisdiction to add or close down any existing sanctioned sections in the institution without previous approval of the Inspector. Assuming for the sake of argument that at the relevant time there were lesser number of students and thus they may not be any necessity to fill up the vacancy but that cannot be a ground to hold that there was, in fact, no vacancy. Thus, the said ground of the rejection by the District Inspector of Schools is not sustainable. The other ground taken in the impugned order is that in view of the circular dated 9.6.1995 no appointment can be made by the Management and appointment could only be made by the Board. The said circular issued by the Directorate of Education stipulates that no appointment should be made on any vacancy by the Management as the Board has been set up for selecting candidates and recommending appointment. This circular appears to relate only to substantial appointments. The appointments to the short-term vacancies are governed by the Removal of Difficulties Order. This view is supported by a Single Judge decision of this Court in the case of Mukesh Kumar Vs. State of U.P. reported in 1996 AWC Page 556. It is well settled that a circular cannot over ride the provision of Second Removal of Difficulties Order, as such, the ground taken by the District Inspector of Schools is also not sustainable. It is also to be noted that the appointment of the petitioner is prior to 9.6.1995 i.e. on 13.5.1991 prior to the issuance of the aforesaid circular. Admittedly, the nature of the said circular is not retrospective. The last ground taken by the District Inspector of Schools to the effect that as Section 18 of the Commission Act and the Second Removal of Difficulties Order having been repealed by the notification dated 29.5.1999, no financial approval relating to the appointment of the petitioner could be granted. Admittedly, the short-term vacancy arose on or after 22.1.1987 and the papers relating to that for obtaining the financial approval was sent to the District Inspector of Schools on 6.5.1991. As such, the subsequent repeal of Second Removal of Difficulties Order would be irrelevant. As on that day the appointment under the short-term vacancy has to be made under the Removal of Difficulty Order. The nature of repealing of the notification-dated 25.1.1999 is not retrospective. It is prospective, therefore, the same is not applicable. The ground to this effect taken by the District Inspector of Schools is not correct. 6 For the reasons given above, the writ petition succeeds and is allowed and the impugned order dated 22.2.2002 (Annexure 4 to the writ petition) is hereby quashed. The petitioner shall be entitled to its salary along with arrears payable to him within a period of two months from the date of submission of the certified copy of the order.”

8. In the abovesaid order, this Court has considered the appointment of the petitioner. As per clause 2(3)(iii) of the U.P. Secondary Education Service Commission (Removal of Difficulties) Order, 1981 clearly stipulates that the District Inspector of Schools has to pass an order for approval of the appointment within seven days of the date of receipt of particulars. Once the orders are not passed by the competent authority within that period, it is deemed to the approval. In the instant case, after selection of the petitioner, the papers were sent to the District Inspector of Schools on 6.5.1991 by the fifth respondent, but the competent authority i.e. District Inspector of Schools has not passed any order within the period as stipulated in clause 2(3)(iii) of the U.P. Secondary Education Service Commission (Removal of Difficulties) Order, 1981 and declared that the appointment of the petitioner is deemed to be approved. On the query raised by the authorities in rejecting the payment of salary that prior permission from the competent authority has not taken before advertisement and calling applications of short term appointment, the said contention was also negated. The third ground raised by the respondents are that the management ought to have obtained financial approval before filling up of the vacancy. The Court held that there is no requirement of law to obtain further approval by making short term appointment on the post when the post has been abolished. Finally as per Section 18 of the Commission Act and the Second Removal of Difficulties Order having been repealed by notification dated 29.05.1999, no financial approval relating to the appointment of the petitioner could be granted. Admittedly, the short term vacancy arose on or after 22.01.1987 and the papers relating to financial approval was sent to the District Inspector of Schools on

6.5.1991. As such, the subsequent repeal of the Second Removal of 7 Difficulties Order itself would be irrelevant. The said contention was also negated by the Court in the above referred judgment and the impugned orders therein dated 22.02.2002 was set aside declaring that the petitioner is entitled for salary along with arrears. Learned counsel for the petitioner has also brought to the notice of Court that the said orders are became final and no appeal has been preferred by the authorities. Hence, whatever the findings in the said judgment are binding on the authorities.

की बैठक दिनांक ा। समिति के समक्ष श्री सुभाष चन्द्र त्रिपाठी मिनय समिति की बैठक दिनांक ुमिक्(cid:9) के सम्बन्( में आज दिनांक अमि(मिनय समिति की बैठक दिनांक म में आज दिनांक वमिण समिति की बैठक आहूत की गयी जिसमें(cid:18)(cid:9) व्य समिति की बैठक दिनांक वस्*ा के मिवपर मण्डल कानपुर की अध्यक्षता में आज दिनांकी(cid:9)कीगय समिति की बैठक दिनांक ीमिनय समिति की बैठक दिनांक ुमिक्(cid:9)य समिति की बैठक दिनांक ो मण्डलीय विनियमितीकरण समिति की बैठक आहूत की गयी जिसमेंंके मिवमिनय समिति की बैठक दिनांक मिम(cid:9)ीकर मण्डल कानपुर की अध्यक्षता में आज दिनांकण समिति की बैठक आहूत की गयी जिसमेंकर मण्डल कानपुर की दिनांक मो मण्डलीय विनियमितीकरण समिति की बैठक आहूत की गयी जिसमेंं के अन्(cid:9)ग(cid:18)(cid:9) न हो मण्डलीय विनियमितीकरण समिति की बैठक आहूत की गयी जिसमेंनेके कार मण्डल कानपुर की अध्यक्षता में आज दिनांकण समिति की बैठक आहूत की गयी जिसमेंमिवमिनय समिति की बैठक दिनांक मिम(cid:9)ीकर मण्डल कानपुर की अध्यक्षता में आज दिनांकण समिति की बैठक आहूत की गयी जिसमेंनहींमिकय समिति की बैठक दिनांक ाज दिनांकासक(cid:9)ाहै। समिति के समक्ष श्री सुभाष चन्द्र त्रिपाठी ”

10. Learned counsel for the petitioner has submitted that the abovesaid orders are contrary to the findings of this Court. Once again the respondents have taken an objection that the ad-hoc appointment not having been approved by the District Inspector of Schools by relying on Clauses 2 to 5 of the U.P. Secondary Education Service Commission (Removal of Difficulties) (Second) Order, 1981. This Court in the abovesaid order dated 15.05.2006 has categorically held that the appointment of the petitioner is in accordance with the provisions of the Act and held that the petitioner is entitled for salary along with arrears. Further it also held that the appointment of the petitioner is deemed to be approved. In view of the same, the respondents again and again cannot take the same grounds for rejection of the claim for regularization.

11. Further, learned counsel for the petitioner has stressed her arguments that the petitioner’s case has to be considered for regularization as per the provisions contained under Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order,

1981. To consider the case, the said provision is extracted hereinunder: 10 “33-B. Regularization of certain other appointments- (1) Any teacher, other than the Principal or Headmaster, who- (a)(i) was appointed by promotion or by direct recruitment in the lecturer grade or Trained Graduate grade on or before May 14, 1991 or in the Certificate of Teaching grade on or before May 13, 1989 against a short term vacancy in accordance with Paragraph 2 of the Uttar Pradesh Education Services Commission (Removal of Difficulties) Second Order, 1981 and such vacancy was subsequently converted into a substantive vacancy.”

According to the abovesaid clause, regularization of certain appointments, which were made before May 14th, 1991 as against the short term vacancy and subsequently, it was converted into substantial vacancy. Admittedly, in the instant case, the petitioner has been appointed on 22.04.1991 i.e. prior to 14th May, 1991 and further as per the orders passed by the competent authority, services of Shankar Dayal Pandey on the post of Lecturer w.e.f. 18.7.1996, the vacancy of the assistant teacher in LT Grade became a substantive vacancy. So that being the case, the petitioner is entitled for regularization as per Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981. But surprisingly, the respondents have rejected the claim of the petitioner by mentioning clause 5 of the Uttar Pradesh Secondary Education Services Commission (Removal of Difficulties) Order, 1981, which is not applicable to the instant case.

13. Finally, learned counsel for the petitioner has also relied on the orders passed this Court in Writ A No. 15410 of 2014, which was disposed of

7.1.2020 by applying Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981 and finally set aside the rejection order therein, holding that teachers, who are appointed on or before 14th May, 1991 in a short term vacancy before the cut-off provided under Section 33-B of the U.P. 11 Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981 are entitled to the benefit of the said section. As held by this Court in Writ A No. 15410 of 2014, the petitioner was also appointed on 22.04.1991 i.e. before the cut-off date 14.05.1991 and the respondents have also approved the appointment from such date complying the order dated 15.05.2006 passed by this Court in Writ A No. 16065 of 2002. Hence, the rejection of petitioner’s case for regularization is not only contrary to the provisions of Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981, but also contrary to the observations made by this Court Writ A No. 16065 of 2002. Consequently, requested to direct the respondents to regularize the services of the petitioner as per Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981.

14. Replying to the said contentions, though there are specific denials except such denial made by the respondents to the assertions made in the writ petition, they have only stated that in compliance to the order dated

15.05.2006, the order for payment of arrears has been passed, but no approval for appointment has been given to the petitioner. Further, it has been stated that the appointment of the petitioner has not been made in accordance with the provisions of the Act as stated hereinabove and that as per Rule 33 kha, it is provided that the appointments through direct recruitment in the Second Gazette, 1981 have been made in accordance with the procedure, will be regularized under Rule 33 kha. But it was found by the Divisional Committee that the appointment of the petitioner is contrary to the abovesaid provision.

15. I have considered the submissions made by learned counsel for the parties and perused the averments made in the writ petition and counter filed by the respondents.

16. As contended by learned counsel for the petitioner that once the 12 Government has passed the second removal order by notification, more particularly Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981, any teacher appointed in the short term vacancy before 14th May, 1991, is eligible for regularization and when the facts are not disputed as the petitioner is appointed prior to the cut-off date and in fact, his services are also approved vide orders dated 29.09.2006 by releasing the salaries pursuant to the directions of this Court. The respondents ought not to have rejected the claim of the petitioner for regularization by applying clause 5 of the Uttar Pradesh Secondary Education Services Commission (Removal of Difficulties) Order, 1981.

Admittedly, this Court has considered elaborately while deciding the Writ A No. 16065 of 2002 and held that the petitioner’s appointment is deemed to be approved and is entitled to salary from the date of initial appointment. Once, the Court has declared the appointment of the petitioner is deemed to be approved as per the provisions of the Act, the respondents cannot reject the claim of the petitioner stating that the appointment was not approved. When the finding of the Court has not been challenged in an appeal, the respondents are estopped to take such grounds again and again. As held by this Court in Writ A No. 15410 of 2014, once the appointment was made prior to 14.05.1991, they are entitled for the benefits, which were provided under Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981.

Considering the submissions of both the counsel and materials placed on record, it is not in dispute that the petitioner was appointed as an assistant teacher against the short term vacancy prior to 14th May, 1991. And in terms of Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981, any teacher appointed in a short term vacancy before 14th May, 1991 is 13 entitled to be considered for regularization.

19. As the Court already held that the petitioners’ appointment is deemed to be approved in Writ A No. 16065 of 2002 dated 15.5.2006, the said orders are became final and implemented by releasing the salaries from the date of initial appointment.

20. In view of the above findings, the impugned order dated 21.07.2015 is quashed. The respondents are directed to regularize the appointment of the petitioner, in accordance with Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981, within a period of three months from the date of receipt of certified copy of this order.

posts of CT Grade Teachers were available. One Sri Shankar Dayal Pandey, while working as a teacher in LT Grade was given ad-hoc promotion to the post of Lecturer Grade w.e.f. 17.02.1986. Sri Shyam Behari Singh, who was working as an assistant teacher in LT Grade in the same institution was given ad-hoc promotion as LT Grade in the vacancy caused by promotion of Sri Shankar Dayal Pandey as Lecturer. In view of completion of 10 years of services in LT Grade, the said Shyam Behari Singh has been absorbed into the said post w.e.f.

22.01.1987. As a result of the said appointment, a short term vacancy arose in the fifth respondent institution. Consequently, after following the procedure contemplated under the U.P. Secondary Education Service Commission (Removal of Difficulties) (Second) Order, 1981, the petitioner was selected and appointment orders were issued on

22.04.1991. The same was intimated to the District Inspector of Schools, Kanpur Nagar vide letter dated 6.5.1991. Subsequently, the petitioner has joined the said post on 22.04.1991 and continuously working in the said institution.

4. Sri Shankar Dayal Pandey, who was given ad-hoc promotion to the post of Lecturer stood regularized on the said post w.e.f. 6.4.1991 as per the provisions of Section 33-A of the U.P. Secondary Education Service Selection Board Act, 1982. Accordingly, the order of regularization was passed on 18.07.1996. In view of the abovesaid orders, short term vacancy upon which the petitioner was working stood converted into substantive vacancy on the post of Assistant Teacher in LT Grade.

5. As the petitioner was appointed and working continuously, the 3 management has sent salary bills of the petitioner but the financial approval was not granted. Hence, the petitioner approached this Court by way of Writ A No. 30622 of 1991 for payment of his salary, which was disposed of. Consequent upon, the fourth respondent has passed an order on 22.02.2002 refusing to grant financial approval to the appointment of the petitioner. Left with no option the petitioner has approached this Court once again by means of Writ A No. 16065 of 2002. The said writ petition was disposed of vide order dated 15.05.2006 by quashing the impugned order therein dated 22.02.2002 and declaring that the petitioner is entitled to salary along with arrears. The said order became final.

6. Subsequently, the respondents have passed an order on 29.06.2006 approving the services of the petitioner w.e.f. 22.4.1991 and accordingly, they have released the entire salary, including arrears. But surprisingly, the respondents have not regularized the services of the petitioner despite the papers submitted by respondent no. 5 was in a prescribed format and the said proposal was rejected by the respondents, once again, vide impugned order dated 21.7.2015. Assailing the said orders, present writ petition has been filed.

Based on the abovesaid facts, learned counsel for the petitioner has pointed out that the impugned orders are not only contrary to the record, but also to the orders passed by this Court in Writ A No. 16065 of 2002 dated 15.05.2006. To support her contention, learned counsel for the petitioner has taken this Court to the observations made by this Court in the orders passed in earlier Writ A No. 16065 of 2002, which reads as under: “The one of the ground in the impugned order is that appointment was without prior approval. From the fact as noted hereinabove, the approval of ad hoc promotion of Shanker Dayal Pandey to the Lecturer grade necessarily created a short-term vacancy in L.T. grade. After due advertisement, the petitioner was selected and the papers were sent to the District Inspector of Schools on 6.5.1991. This allegation made in 4 para 12 to the writ petition has not been denied in the counter affidavit. It is apparent that in spite of the receiving the papers for granting approval, the District Inspector of Schools did not pass any order. Clause 2 (3) (iii) of the U.P. Secondary Education Service Commission (Removal of Difficulties) Order, 1981 provides as under: "The District Inspector of Schools shall communicate his decision within seven days of date of particulars by him failing which the same will be deemed to have given his approval." A bare perusal of the said provision to show that a mandate has been issued to the District Inspector of Schools to pass orders either approving or disapproving the proposed appointment and in case, the order is not passed within seven days of the receipt of the papers or proposal, a legal fiction has been created by which the said proposal will be deemed to be approved. This ratio has been accepted in several cases including by a Division Bench judgment of this Court in case of Ashika Prasad Shukla Vs. District Inspector of Schools and another reported in 1998(3) UPLBEC 1722 and the said decision has been followed in several cases, therefore, the first ground given in the impugned order cannot be sustained as it was a case of deemed approval. The second ground on which the claim of the petitioner has been rejected that without prior permission the advertisement inviting application for short term appointment could not be issued. In the impugned order or in the counter affidavit or during the argument the reference to any provision of law where such a requirement is mandatory has been disclosed. The appointment to the short term vacancies, at the relevant time, was governed by the Second Removal of Difficulties Order as explained by the Full Bench Decision of this Court in case of Raza Raizada and others Vs. Committee of Management, (1994) 3 UPLBEC 1551. The another ground given in the impugned order is that before filing the vacancy, the Management ought to have obtained financial approval of the post. It is not the case of the respondents that Sri Shanker Dayal Pandey, who was working as L.T. grade teacher was given ad hoc promotion in the Lecturers grade with effect from 17.2.1986. It is also not the case of the respondents that Sri Shayam Bihari Singh, who was working as assistant teacher in L.T. grade was not drawing his salary in L.T. grade. It is also not the case of the respondents that at any time financial approval to that post was withdrawn by the respondents. There is no requirement of law to obtain further approval while making short- term appointment on the post except when the post has been abolished, but it is not the case of the respondents. The Learned Standing Counsel has failed to point out any provision of law by which such a requirement has been placed upon the Management. The next ground taken in the impugned order that in accordance with the actual strength of students only 18 sections were being operated and according to the norms only 13 teachers can be appointed and 26 5 teachers were working in L.T. grade, therefore, there was no vacancy to be filled up. The case set up before the Management was that there were 23-sanctioned post of L.T. grade teachers and 8 posts of C.T. grade teachers in the institution and this fact has not been denied by the respondents in the counter affidavit or during the argument. Further, even the number of students have not been disclosed in the impugned order which hold that only 10 sections were being operated. Even in the counter affidavit, the strength of the students has not been disclosed. Though the petitioner has come with a case that no section has been reduced and the strength of the students is the same and that cannot be a ground for rejection of the claim of the petitioner. It is also to be noted that the management has got no jurisdiction to add or close down any existing sanctioned sections in the institution without previous approval of the Inspector. Assuming for the sake of argument that at the relevant time there were lesser number of students and thus they may not be any necessity to fill up the vacancy but that cannot be a ground to hold that there was, in fact, no vacancy. Thus, the said ground of the rejection by the District Inspector of Schools is not sustainable. The other ground taken in the impugned order is that in view of the circular dated 9.6.1995 no appointment can be made by the Management and appointment could only be made by the Board. The said circular issued by the Directorate of Education stipulates that no appointment should be made on any vacancy by the Management as the Board has been set up for selecting candidates and recommending appointment. This circular appears to relate only to substantial appointments. The appointments to the short-term vacancies are governed by the Removal of Difficulties Order. This view is supported by a Single Judge decision of this Court in the case of Mukesh Kumar Vs. State of U.P. reported in 1996 AWC Page 556. It is well settled that a circular cannot over ride the provision of Second Removal of Difficulties Order, as such, the ground taken by the District Inspector of Schools is also not sustainable. It is also to be noted that the appointment of the petitioner is prior to 9.6.1995 i.e. on 13.5.1991 prior to the issuance of the aforesaid circular. Admittedly, the nature of the said circular is not retrospective. The last ground taken by the District Inspector of Schools to the effect that as Section 18 of the Commission Act and the Second Removal of Difficulties Order having been repealed by the notification dated 29.5.1999, no financial approval relating to the appointment of the petitioner could be granted. Admittedly, the short-term vacancy arose on or after 22.1.1987 and the papers relating to that for obtaining the financial approval was sent to the District Inspector of Schools on 6.5.1991. As such, the subsequent repeal of Second Removal of Difficulties Order would be irrelevant. As on that day the appointment under the short-term vacancy has to be made under the Removal of Difficulty Order. The nature of repealing of the notification-dated 25.1.1999 is not retrospective. It is prospective, therefore, the same is not applicable. The ground to this effect taken by the District Inspector of Schools is not correct. 6 For the reasons given above, the writ petition succeeds and is allowed and the impugned order dated 22.2.2002 (Annexure 4 to the writ petition) is hereby quashed. The petitioner shall be entitled to its salary along with arrears payable to him within a period of two months from the date of submission of the certified copy of the order.”

8. In the abovesaid order, this Court has considered the appointment of the petitioner. As per clause 2(3)(iii) of the U.P. Secondary Education Service Commission (Removal of Difficulties) Order, 1981 clearly stipulates that the District Inspector of Schools has to pass an order for approval of the appointment within seven days of the date of receipt of particulars. Once the orders are not passed by the competent authority within that period, it is deemed to the approval. In the instant case, after selection of the petitioner, the papers were sent to the District Inspector of Schools on 6.5.1991 by the fifth respondent, but the competent authority i.e. District Inspector of Schools has not passed any order within the period as stipulated in clause 2(3)(iii) of the U.P. Secondary Education Service Commission (Removal of Difficulties) Order, 1981 and declared that the appointment of the petitioner is deemed to be approved. On the query raised by the authorities in rejecting the payment of salary that prior permission from the competent authority has not taken before advertisement and calling applications of short term appointment, the said contention was also negated. The third ground raised by the respondents are that the management ought to have obtained financial approval before filling up of the vacancy. The Court held that there is no requirement of law to obtain further approval by making short term appointment on the post when the post has been abolished. Finally as per Section 18 of the Commission Act and the Second Removal of Difficulties Order having been repealed by notification dated 29.05.1999, no financial approval relating to the appointment of the petitioner could be granted. Admittedly, the short term vacancy arose on or after 22.01.1987 and the papers relating to financial approval was sent to the District Inspector of Schools on

6.5.1991. As such, the subsequent repeal of the Second Removal of 7 Difficulties Order itself would be irrelevant. The said contention was also negated by the Court in the above referred judgment and the impugned orders therein dated 22.02.2002 was set aside declaring that the petitioner is entitled for salary along with arrears. Learned counsel for the petitioner has also brought to the notice of Court that the said orders are became final and no appeal has been preferred by the authorities. Hence, whatever the findings in the said judgment are binding on the authorities.

10. Learned counsel for the petitioner has submitted that the abovesaid orders are contrary to the findings of this Court. Once again the respondents have taken an objection that the ad-hoc appointment not having been approved by the District Inspector of Schools by relying on Clauses 2 to 5 of the U.P. Secondary Education Service Commission (Removal of Difficulties) (Second) Order, 1981. This Court in the abovesaid order dated 15.05.2006 has categorically held that the appointment of the petitioner is in accordance with the provisions of the Act and held that the petitioner is entitled for salary along with arrears. Further it also held that the appointment of the petitioner is deemed to be approved. In view of the same, the respondents again and again cannot take the same grounds for rejection of the claim for regularization.

11. Further, learned counsel for the petitioner has stressed her arguments that the petitioner’s case has to be considered for regularization as per the provisions contained under Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order,

1981. To consider the case, the said provision is extracted hereinunder: 10 “33-B. Regularization of certain other appointments- (1) Any teacher, other than the Principal or Headmaster, who- (a)(i) was appointed by promotion or by direct recruitment in the lecturer grade or Trained Graduate grade on or before May 14, 1991 or in the Certificate of Teaching grade on or before May 13, 1989 against a short term vacancy in accordance with Paragraph 2 of the Uttar Pradesh Education Services Commission (Removal of Difficulties) Second Order, 1981 and such vacancy was subsequently converted into a substantive vacancy.”

According to the abovesaid clause, regularization of certain appointments, which were made before May 14th, 1991 as against the short term vacancy and subsequently, it was converted into substantial vacancy. Admittedly, in the instant case, the petitioner has been appointed on 22.04.1991 i.e. prior to 14th May, 1991 and further as per the orders passed by the competent authority, services of Shankar Dayal Pandey on the post of Lecturer w.e.f. 18.7.1996, the vacancy of the assistant teacher in LT Grade became a substantive vacancy. So that being the case, the petitioner is entitled for regularization as per Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981. But surprisingly, the respondents have rejected the claim of the petitioner by mentioning clause 5 of the Uttar Pradesh Secondary Education Services Commission (Removal of Difficulties) Order, 1981, which is not applicable to the instant case.

13. Finally, learned counsel for the petitioner has also relied on the orders passed this Court in Writ A No. 15410 of 2014, which was disposed of

7.1.2020 by applying Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981 and finally set aside the rejection order therein, holding that teachers, who are appointed on or before 14th May, 1991 in a short term vacancy before the cut-off provided under Section 33-B of the U.P. 11 Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981 are entitled to the benefit of the said section. As held by this Court in Writ A No. 15410 of 2014, the petitioner was also appointed on 22.04.1991 i.e. before the cut-off date 14.05.1991 and the respondents have also approved the appointment from such date complying the order dated 15.05.2006 passed by this Court in Writ A No. 16065 of 2002. Hence, the rejection of petitioner’s case for regularization is not only contrary to the provisions of Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981, but also contrary to the observations made by this Court Writ A No. 16065 of 2002. Consequently, requested to direct the respondents to regularize the services of the petitioner as per Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981.

14. Replying to the said contentions, though there are specific denials except such denial made by the respondents to the assertions made in the writ petition, they have only stated that in compliance to the order dated

15.05.2006, the order for payment of arrears has been passed, but no approval for appointment has been given to the petitioner. Further, it has been stated that the appointment of the petitioner has not been made in accordance with the provisions of the Act as stated hereinabove and that as per Rule 33 kha, it is provided that the appointments through direct recruitment in the Second Gazette, 1981 have been made in accordance with the procedure, will be regularized under Rule 33 kha. But it was found by the Divisional Committee that the appointment of the petitioner is contrary to the abovesaid provision.

15. I have considered the submissions made by learned counsel for the parties and perused the averments made in the writ petition and counter filed by the respondents.

16. As contended by learned counsel for the petitioner that once the 12 Government has passed the second removal order by notification, more particularly Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981, any teacher appointed in the short term vacancy before 14th May, 1991, is eligible for regularization and when the facts are not disputed as the petitioner is appointed prior to the cut-off date and in fact, his services are also approved vide orders dated 29.09.2006 by releasing the salaries pursuant to the directions of this Court. The respondents ought not to have rejected the claim of the petitioner for regularization by applying clause 5 of the Uttar Pradesh Secondary Education Services Commission (Removal of Difficulties) Order, 1981.

Admittedly, this Court has considered elaborately while deciding the Writ A No. 16065 of 2002 and held that the petitioner’s appointment is deemed to be approved and is entitled to salary from the date of initial appointment. Once, the Court has declared the appointment of the petitioner is deemed to be approved as per the provisions of the Act, the respondents cannot reject the claim of the petitioner stating that the appointment was not approved. When the finding of the Court has not been challenged in an appeal, the respondents are estopped to take such grounds again and again. As held by this Court in Writ A No. 15410 of 2014, once the appointment was made prior to 14.05.1991, they are entitled for the benefits, which were provided under Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981.

Considering the submissions of both the counsel and materials placed on record, it is not in dispute that the petitioner was appointed as an assistant teacher against the short term vacancy prior to 14th May, 1991. And in terms of Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981, any teacher appointed in a short term vacancy before 14th May, 1991 is 13 entitled to be considered for regularization.

19. As the Court already held that the petitioners’ appointment is deemed to be approved in Writ A No. 16065 of 2002 dated 15.5.2006, the said orders are became final and implemented by releasing the salaries from the date of initial appointment.

20. In view of the above findings, the impugned order dated 21.07.2015 is quashed. The respondents are directed to regularize the appointment of the petitioner, in accordance with Section 33-B (1) (a) (i) of the U.P. Secondary Education Services Commission (Removal of Difficulties) Second Order, 1981, within a period of three months from the date of receipt of certified copy of this order.
