Judgment
Learned counsel for the petitioner Sri Om Prakash Singh has submitted that very stale bill could not be pressed for by the Electricity Department under section 56(2) of the Electricity Act, 2003.
Sri Narendra Kumar Tiwari, learned counsel appearing for the Electricity Department, however, states that if the petitioner approaches the appropriate forum, as has been provided under the Government Order dated 4.11.2023 for a one time settlement, then all the grievances of the petitioner can be considered by the forum itself.
Under such circumstances, we provide that if the petitioner approaches the appropriate forum by 20.12.2023 then the grievances of the petitioner shall be looked into and shall be considered sympathetically in accordance with law. However, till a decision is taken by the forum, as has been provided under the Government Order dated 4.11.2023, no coercive action shall be taken against the petitioner.
With these observations, the writ petition stands disposed of. Order Date :- 11.12.2023 GS (Shekhar B. Saraf, J.) (Siddhartha Varma, J.) GAUTAM SONI High Court of Judicature at Allahabad
