1. Heard Sri S.K. Chaubey, learned counsel for the writ petitioner in leading, connected C1 and connected C2 writ petition and Sri Rahul Malviya, learned Standing Counsel in leading, connected C1 and 2 WRIA No. 61097 of 2015 connected C2 application.
2. A joint statement has been made by learned counsel for the parties that they do not propose to file any affidavit and the petition be decided on the basis of the documents available on record. With the consent of the parties, the petition be decided at the fresh stage.

The case of the writ petitioner is that he was working as Assistant Research Officer, Primary Health Centre, Nagra, District Ballia to the utmost satisfaction of his superior, however, on 31.12.2014 an order came to be passed by Director General, Medical Health transferring the writ petitioner from Ballia to Rampur. The writ petitioner being aggrieved against the said transfer order preferred Writ A No. 44511 of 2015 in which on 10.08.2015, the following orders were passed.- "The petitioner is posted as Assistant Research Officer, Primary Health Centre, Nagra, District Ballia. He has challenged his transfer order dated 31.12.2014, whereby he has been transferred on administrative ground from District Ballia to District Rampur. It is contended on behalf of the petitioner that the impugned order has been passed on
31.12.2014 but it came to the knowledge of the petitioner on 30.7.2015. The grievance of the petitioner is that his transfer order has been passed in the mid of the academic session and his children have got admitted in the educational institution in District Ballia, therefore, the transfer order shall cause hardship to the family of the petitioner. It is a trite law that transfer is a condition of service and in case there is violation of circular/Government order or transfer policy, it does not confer any vested right to the employee to challenge it under Article 226 of the Constitution of India. The appropriate remedy is to approach the higher authority to ventilate his grievance. Reference may be made to the judgements of the Supreme Court in the cases of Union of India & others v. S.L. Abbas, (1993) 4 SCC 357; N.K. Singh v. Union of India and others, (1994) 6 SCC 98, and Rajendra Singh and others v. State of Uttar Pradesh & others, (2009) 15 SCC 178, which have been consistently followed by the Supreme Court and this Court. In so far as the submission of the learned counsel for the petitioner is concerned that the transfer order has been belatedly communicated to him and his family will suffer hardship, in my view, the ends of justice would be subserved by issuing a direction 3 WRIA No. 61097 of 2015 upon the authority concerned to consider the cause of the petitioner and pass appropriate order in accordance with law within six weeks from the date of receipt of a representation alongwith a certified copy of this order. The petitioner is at liberty to move a representation alongwith a certified copy of this order to the authority concerned within two weeks. The writ petition is accordingly disposed of. There shall be no order as to costs. No order as to costs."
4. Thereafter, the writ petitioner preferred a representation dated
13.08.2015 which came to be rejected by the Director General, Medical Health and Family Welfare, U.P., Lucknow on 03.09.2025 and a consequential order came to be passed on 16.10.2015 by him.
5. In the leading writ petition, this Court on 02.11.2015 proceeded to pass the following orders.- "Heard Sri Surendra Kumar Chaubey, learned counsel for petitioner and Sri J.S. Bundela, learned Standing Counsel for the respondents. The petitioner is seeking quashing of the order dated 31.12.2014 whereby he has been transferred from Balia to Rampur as Assistant Research Officer Primary Health Centre. Earlier the petitioner had filed Writ Petition No.44511 of 2015 challenging the same order of transfer which was disposed of by the order dated 10.08.2015 with a direction to the respondents to decide the petitioner's representation. The contention of the petitioner is that his representation was not decided but he was placed under suspension by order dated 26.08.2015 which he challenged in Writ Petition No.52617 of 2015 and the order of suspension was stayed. Thereafter on 03.09.2015 the petitioner's representation has been rejected. The reason given therein is that the order has been passed by the Government after an enquiry. No other reason has been disclosed as to what happened in the enquiry. The allegation is that the transfer was made on a complaint. Who made the complaint and what was the nature of complaint has also not been disclosed in the impugned order. It is not disclosed as to whether the petitioner was a party to the enquiry or whether everything happened behind his back. The impugned order is completely silent. The matter requires consideration. The respondents may file counter affidavit within six weeks. The petitioner will have two weeks thereafter to file rejoinder affidavit. List thereafter. Till the next date of listing the operation of the order dated 31.12.2014 shall remain stayed."

In the meantime, an order came to be passed on 26.08.2015 by the Director General, Medical Health and Family Welfare, U.P., Lucknow placing the writ petitioner under suspension on the ground that he did not 4 WRIA No. 61097 of 2015 join the transferred place. The same led to filing of the connected C1 application in which on 21.09.2015 the following orders were passed.- "The petitioner is an Assistant Research Officer, Primary Health Centre, Nagra, District Ballia. He was transferred vide order dated 31.12.2012 on the administrative ground from Ballia to Rampur. The said order was challenged by the petitioner on several grounds. This Court has refused to interfere in the order and left it open to him to make representation to the higher authority. In compliance thereof, the petitioner has made a representation on 13.08.2015. It is stated in paragraph no.16 of the writ petition that the said representation has not been decided and is still pending. In the meantime, the petitioner has been placed under suspension vide order dated 26.08.2015 on the ground that he has not complied the order of transfer and insubordination. It is contended on behalf of the petitioner that so far as the insubordination is concerned no opportunity has been given and only a general remark has been made. Matter needs consideration. Learned Standing Counsel is granted four weeks time to file counter affidavit. Rejoinder affidavit, if any, may be filed within a week thereafter. List this case on 23.11.2015. Till the next date of listing, the effect and operation of the suspension order dated 26.08.2015 passed by the respondent no.2 shall remain stayed."
7. Since the writ petitioner was being paid salary till 28.01.2018 since the writ petitioner was not being paid the salary for the period from
01.05.2015 to 19.01.2018 thus, the writ petitioner preferred the connected C2 writ petition seeking following reliefs.- "i) issue a writ order or direction in the nature of mandamus commanding and directing the respondents to pay the salary to the petitioner from 01.05.2015 to 19.01.2018 forthwith along with interest within stipulated period as fixed by this Hon'ble Court. ii) issue any other writ order or direction in the like nature which this Hon'ble Court may deem fit and proper in the circumstances of the case. iii) award the costs of the writ petition to the petitioner."
8. This Court on 18.05.2023 proceeded to pass the following orders.- "1. Heard learned counsel for the petitioner and Ms. Shilpi Singh, learned Brief Holder for the State-respondents. 2. The grievance of the petitioner is that his salary for the period from 01.05.2015 to 19.01.2018 has not been paid. 3. It is submitted by the learned counsel for the petitioner that Deputy Chief Medical 5 WRIA No. 61097 of 2015 Officer (IInd), Ballia has directed the Superintendent/In-Charge, Primary Health Centre, Nagra, Ballia vide letter dated 16.03.2022 to submit salary bills of the petitioner to Sri Manoj Singh, Senior Assistant in the office of Chief Medical Officer, Ballia so that payment could be made. 4. It is contended that despite the letter being sent by Deputy Chief Medical Officer (IInd), Ballia, the salary of the petitioner has not been released. 5. List this case in top ten cases on 30.05.2023 on which date, Superintendent/In- Charge, Primary Health Centre, Nagra, Ballia shall remain present before the Court and explain as to why salary bill has not been prepared and forwarded to Sri Manoj Singh, Senior Assistant in the office of Chief Medical Officer, Ballia despite the letter/order of Deputy Chief Medical Officer (IInd), Ballia dated 16.03.2022."
9. Thereafter another order was passed on 30.05.2023.- "1. This Court on 18.05.2023 passed the following order:- "1. Heard learned counsel for the petitioner and Ms. Shilpi Singh, learned Brief Holder for the State-respondents. 2. The grievance of the petitioner is that his salary for the period from 01.05.2015 to 19.01.2018 has not been paid. 3. It is submitted by the learned counsel for the petitioner that Deputy Chief Medical Officer (IInd), Ballia has directed the Superintendent/In-Charge, Primary Health Centre, Nagra, Ballia vide letter dated 16.03.2022 to submit salary bills of the petitioner to Sri Manoj Singh, Senior Assistant in the office of Chief Medical Officer, Ballia so that payment could be made. 4. It is contended that despite the letter being sent by Deputy Chief Medical Officer (IInd), Ballia, the salary of the petitioner has not been released. 5. List this case in top ten cases on 30.05.2023 on which date, Superintendent/In- Charge, Primary Health Centre, Nagra, Ballia shall remain present before the Court and explain as to why salary bill has not been prepared and forwarded to Sri Manoj Singh, Senior Assistant in the office of Chief Medical Officer, Ballia despite the letter/order of Deputy Chief Medical Officer (IInd), Ballia dated 16.03.2022." 2. Ms. Shachi Srivastava, learned Standing Counsel on instructions which is taken on record states that since the Chief Medical Officer, Ballia is not giving appropriate instructions, therefore, salary bill of the petitioner could not be prepared. 3. In such view of the fact, the Court is constrained to summon the Chief Medical Officer, Ballia on the next date to explain as to why he is not responding to the letter of the Superintendent/Incharge, Medical Officer, Primary Health Centre, Nagra, District Ballia. 4. List Superintendent/Incharge, Medical Officer, Primary Health Centre, Nagra, District Ballia shall also be present in the Court." ten cases. On which date, this case on 11.07.2023

A personal affidavit has been filed on behalf of fourth respondent in the connected C2 writ petition sworn by Chief Medical Officer, Ballia dated 11.07.2023 wherein the following has been asserted.- 6 WRIA No. 61097 of 2015 "2. That, the petitioner was transferred vide order dated 31.12.2014 from Ballia to Rampur by Director General, Family Welfare, U.P. and was relieved by the deponent on 31.01.2015 petitioner got salary till April, 2015. Against the transfer order dated 31.12.2014 passed by Director General, Family Welfare, U.P. He filed a writ petition no. 44511 of 2015 challenging the transfer order dated 31.12.2014 which was disposed of vide order dated 10.08.2015 with a direction to decide the representation of the petitioner. A copy of order dated 10.08.2015 is annexed herewith and is marked as Annexure-1 to this affidavit.
14. That the deponent again disclosing all the facts and circumstances along with copy of orders passed by Hon'ble Court in different writ petitions and contempt application requested to the Director General, Medical Health, U.P. to reconsider and clear cut direction regarding payment of salary of the petitioner for period 01.05.2015 to 19.01.2018 and for further action in the matter to whom and under which provision proceeding may be taken. A copy of letter dated 05.07.2023 is annexed herewith and is marked as Annexure-13 to this affidavit."

Learned counsel for the writ petitioner has submitted that though in pursuance of the order passed in the leading writ petition, the transfer order to be stayed on 02.11.2015 and the writ petition is still posted in Ballia on the post from where he was being sought to be transferred it has been stayed and even the suspension order has been stayed in connected C1 writ petition and no inquiry proceedings have been conducted and the writ petitioner is getting the salary, however, the grievance in this regard is to the effect that the writ petitioner has not been paid salary and the benefits from 01.05.2015 to 19.01.2018. Submission is that it is not a case wherein the writ petitioner was unauthorizedly absent as the writ petitioner took recourse to the legal remedies and the said stand stood endorsed by virtue of interim order so passed in the leading and the connected C1 writ petition then it is not open for the respondents to withhold the payment of salary from 01.05.2015 to 19.01.2018. He submits that it is for the respondents to take a decision in that regard and even otherwise according to him in view of the personal affidavit so filed by the CMO in the connected C2 writ petition, no decision has been enclosed, however, what is happening is this that the documents are being sent from one place to another. He submits that let a conscious decision be taken by the Competent Authority after putting to notice the writ petitioner.

Sri Malviya, learned Standing Counsel for the respondents submits that whatever might be since the transfer order has been stayed and 7 WRIA No. 61097 of 2015 suspension order has also been stayed and as per the saying of the writ petitioner, no inquiry proceedings have been conducted post issuance of the charge sheet, thus, a conscious decision would be taken by the authorities after putting to notice the writ petitioner. Bearing in mind the aforesaid fact situation and the stand taken by the respective parties, writ petition is being decided in the following terms:- (a) petitioner a comprehensive representation/application along with self attested copy of the leading, connected C1 connected C2 writ petition and the personal affidavit before the second respondent, Director General, Medical Health and Family Welfare, U.P., Lucknow by 31.10.2025; (b) on the said motion, the Director General, Medical Health and Family Welfare, U.P., Lucknow shall put to notice the writ petitioner while fixing a date in the second week of November, 2025; (c) on the said date, writ petitioner shall present himself before the Director General, Medical Health and Family Welfare U.P., Lucknow; (d) thereafter, a decision would be taken by the Director General, Medical Health and Family Welfare, U.P., Lucknow upon the claim of the writ petitioner.
13. The interim protection so accorded in the leading and connected C1 writ petition shall continue till the passing of the order.

Bearing in mind the aforesaid fact situation and the stand taken by the respective parties, writ petition is being decided in the following terms:- (a) petitioner a comprehensive representation/application along with self attested copy of the leading, connected C1 connected C2 writ petition and the personal affidavit before the second respondent, Director General, Medical Health and Family Welfare, U.P., Lucknow by 31.10.2025; (b) on the said motion, the Director General, Medical Health and Family Welfare, U.P., Lucknow shall put to notice the writ petitioner while fixing a date in the second week of November, 2025; (c) on the said date, writ petitioner shall present himself before the Director General, Medical Health and Family Welfare U.P., Lucknow; (d) thereafter, a decision would be taken by the Director General, Medical Health and Family Welfare, U.P., Lucknow upon the claim of the writ petitioner.
13. The interim protection so accorded in the leading and connected C1 writ petition shall continue till the passing of the order.
