Judgment
Sri P.N. Rai, learned counsel for respondent no. 1 and Sri Rajiv Gupta, learned Additional Chief Standing Counsel for the State, submit that the petitioner has alternative remedy of challenging the arbitration award by filing objection under Section 34 of the Arbitration and Conciliation Act, 1996, read with Section 3G(6) of the National Highways Act, 1956 before the District Judge. The said legal position has not been disputed before us by learned counsel for the petitioner.
In the aforesaid facts and circumstances, we are not inclined to examine the challenge and it is left open to the petitioner to challenge the said awards in the manner stipulated under the statute, if so advised.
