Judgment
Heard learned counsel for the petitioner. This petition has been filed seeking the following reliefs:- "(i) direct the Civil Judge, (Senior Division), Mathura to decide the Application under Order 39 Rule 1 & 2 of C.P.C. numbered as No.7C (Annexure No.3 to the present petition) as well as 24-C and 27C pending bearing Original Suit No.165 of 2022 (Narayan Agrawal Vs. Radharani & others) as early as possible protecting the subject matter. (ii) to direct the defendants/respondents to not to alienate/create any third party interest in respect of the property in question and not to change the nature of the property. " Learned counsel for the petitioner states that the relief sought for in the present petition was granted to the petitioner by an order dated 15.05.2023 in Matters under Article 227 No.4691 of 2022 and as such he would like to withdraw this petition at this stage.
