Undisputedly, the petitioner - Committee of Management is an established minority institution known as Khalsa Inter College, Govind Nagar, Kanpur Nagar. The petitioner has approached the Court, seeking direction upon respondents to initiate and conclude the selection process for appointment of 14 Assistant Teachers out of 19 (total) claimed to be lying vacant at the institution. In terms of the amended regulation, the petitioner has further disclosed to have taken steps to advertise the posts on 12.03.2018. Applications received pursuant to such advertisement through online mode had also been forwarded to the DIOS to initiate the necessary selection process. 3. In that regard, the DIOS, Kanpur Nagar appears to have written to the Director of Education, vide communication dated 18.11.2019

confirming such steps being taken by the Committee of Management. It is at that level, the matter has remained pending. 4. Consequently, upon present petition being filed, by last order dated 13.10.2022, learned Standing Counsel was required to obtain written instructions from respondent nos. 2, 3 and 4 as also from respondent no.1 as to the current policy of the State Government and the reasons for delay as also to communicate the timelines within which the State Government proposes to implement its new policy as per the amended regulation. 2 5. Today, written instructions have been received. Copy of the same has been marked as 'X' and retained on record. Consequently, it must be said applications have been invited by the petitioner wholly in accordance with law. They have been forwarded by the DIOS to the Director of Education, long ago. (ii) The competent authority to nominate the private agency who may now proceed to conduct the written examination is the Director of Secondary Education. He is ceased with the matter. (iii) The State Government on its part constituted a High Power Committee for the purposes of nominating the private agency that may conduct the relevant examination. (iv) Further, the written instructions do reveal, the State Government has opted to invite tenders for the purposes of selecting best suited agency. (v) Insofar as tender invitation is concerned, the State Government has invited opinions from the experts and incorporated the same in the tender document. (vi) These steps being complete, the stage is set for the State Government to invite tenders and proceed in accordance with the amended regulation. 7. The amended regulation do not contemplate any further steps to be taken for the purposes of nominating the private agency. Insofar as the 4 State Government has opted to nominate the private agency through tender process, the decision of the State Government cannot be faulted. 8. However, there is no room to entertain any further amendment of regulations to give effect to the aforesaid scheme of the State Government. Thus, reference to amendment required to the Act or regulation as is narrated in paragraph no.7 of the written instruction, is wholly out of context and without any basis. Other than bald/loose statement made in paragraph 7 of the instruction no justification or occasion is shown to exist whereunder any further amendment to the Act or regulation may be required. 9. Plainly, the State Government has to proceed to invite the bids and select the most suitable agency. 10. Therefore, the objection being raised by the Additional Chief Standing Counsel to hold the issuance of writ at this stage is unacceptable. Neither any reason is shown to not allow the State Government to proceed with tender process nor there is shown to exist any real legal impediment warranting any amendment in the Act or the regulation. 11. Accordingly, writ of mandamus is issued to respondent no.1 to forthwith proceed to invite tender to select the private agency for the purpose of conducting the examinations in accordance with the amended regulation. Such invitation/tender may be published not later than one month from today. All further timelines may be fixed accordingly as may be reasonable and appropriate in the facts of the present case, to ensure speedy conclusion of the selection. 12. With the aforesaid observation, present writ petition is disposed of.
