Heard learned counsel for the petitioner and learned Standing counsel for the State respondents. With the consent of learned counsel for the parties, the amendment application is allowed. Necessary amendment be carried out during the course of the day. Order on Writ Petition The petitioner is a fisheries co-operative society having registration no. 1074 of 1981 dated 01.10.1981. The newly impleaded respondent no.5 is also a fisheries co-operative society having registration no. 423 of 1999 dated 18.5.1999. Thus, both the aforesaid co-operative societies are registered under the U.P. Co-operative Societies Act, 1965. Pursuant to the Government Order dated 10.1.2019, steps were taken by the respondent no.4 as Chairman of the Tehsil Level Fishing Committee and an advertisement dated 10.6.2022 was issued by him for auction of fishing rights in river Yamuna and river Betwa with reference to certain village panchayats of Tehsil Sadar, District Hamirpur for one year excluding the prohibited period from 1st June to 31st August. The respondent no.5 was declared ineligible to participate in any bid vide order dated 8.10.2020 passed by the Director Fisheries, Uttar Pradesh, Lucknow, a copy of which has been filed as Annexure-5 to the writ petition. Thus, the petitioner being an eligible fishing co-operative society participated in the bid process and was successful being the only bidder. The bid of the petitioner was Rs. 4,18,000/- for river Yamuna and Rs. 50,142/- for river Betwa. The petitioner deposited 25% of the bid amount with respect to River Yamuna and the entire amount with respect to river Betwa vide receipts dated 6.7.2022. The balance amount was deposited within the stipulated time on 11.7.2022. Thus, in terms of the paragraphs 6,7 and 8 of the Government Order dated 10.1.2019 read with advertisement dated 12.5.2022, the petitioner society deposited the entire bid amount. After the bid and the deposit of the amount by the petitioner, the newly impleaded respondent no.5 raised certain objections to the bid, and thereupon the Assistant Director Fisheries, Hamirpur passed an order dated 13.10.2022 directing for refund of the money of the petitioner, as under:- "काኋा(cid:4)लኋ-सहाኋक नि(cid:10)देशक मत्सኋ, हमीरपुर प्ቔांक 427 / मत्स्ኋ आखेट/ 2022-23 सचि(cid:27)व/अध्ኋ्ቌ मत्स्ኋ जीवी सहकारी सनिमचि! लिल०- कु रारा निद(cid:10)ांक 13/10/2022 निवषኋः - मत्स्ኋ आखेट प्ሾा आवंट(cid:10) ध(cid:10)राशिश वापसी के सम्बन्ध में। 2 उपरो्ሹ निवषኋक आपको सूचि(cid:27)! निकኋा जा!ा है निक निव्ቈीኋ वष(cid:4) 2022- 23 में निद(cid:10)ांक 06.07.2022 को !हसील सभागार में आኋोजिज! (cid:10)निदኋों / जलधारा में मत्स्ኋ आखेट प्ሾा/ठेका आवंट(cid:10) शिशनिवर का आኋोज(cid:10) निकኋा गኋा था। जिजसमें आपके ्ቛारा शिशनिवर में ्ቚचि!भाग कर!े हुኋे 25 ्ቚचि!श! ध(cid:10)राशिश !त्काल जमा की गई एवं एक स्ाह के अन्दर अवशेष 75 ्ቚचि!श! ध(cid:10)राशिश जमा कराई गኋी। !दोपरान्! आपके ्ቌे्ቔ में उत्प्ቐ निववाद के नि(cid:10)स्!ारण हे!ु गनिठ! सनिमचि! के ्ቛारा निद(cid:10)ांक 22.08.2022 एवं 27.09.2022 को आኋोजिज! बैठकों में जिजसमें सनिमचि! की ओर से ्ቦी राजकु मार ्ቛारा स्वኋं ्ቚचि!भाग भी निकኋा गኋा है। निववाद नि(cid:10)स्!ारण सनिमचि! ्ቛारा लिलኋे गኋे नि(cid:10)ण(cid:4)ኋ के ्ቅम में आपके ्ቛारा मत्स्ኋ आखेट प्ሾा आवंट(cid:10) हे!ु जमा की गई सम्पूण(cid:4) ध(cid:10)राशिश वापस की जा(cid:10)ी है जिजस हे!ु आप सनिमचि! का खा!ा की पासबुक की छाኋा ्ቚचि! काኋा(cid:4)लኋ में उपलब्ध करा(cid:10)ा सुनि(cid:10)चिG! करें !ानिक ससमኋ ध(cid:10)राशिश वापसी की काኋ(cid:4)वाही अमल में लाई जे सके । (निगरीश नि्ቔपाठी) सहाኋक नि(cid:10)देशक मत्स्ኋ हमीरपुर प्ቔांक व निद(cid:10)ांक उपरो्ሹ(cid:10)ुसार। ्ቚचि!लिलनिपः- उपजिजलाचिधकारी, सदर को सू(cid:27)(cid:10)ाथ(cid:4) ्ቚेनिष!। ह०अप सहाኋक नि(cid:10)देशक मत्स्ኋ हमीरपुर" Consequently, the petitioner has filed the present writ petition praying for the following relief:- "(a) Issue a writ order or direction in the nature of Mandamus directing the Respondent No.4 to permit the petitioner for fishing rights in the River Yamuna and River Betawa. (b) Issue such other and further writ, order or direction that this Hon'ble Court may deems fit and proper in the nature and circumstances of present case. (c) Issue writ order or direction in the nature of Mandamus directing the Respondent No.4 to execute Fisheries Lease in pursuance to the Auction Notice dated 05.07.2022." So far as the dispute being raised by the respondent no.5 against

the bid in question is concerned, we find that his objections in the writ petition are not entertainable inasmuch as if the bid is accepted then in terms of clause 10 of the Government Order dated 10.01.2019, the respondent no.5 may have a right of appeal before the Divisional Commissioner. 3 So far as the case of the petitioner is concerned, we find that clause 7 and 8 of the Government Order dated 10.01.2019 provides as under:- “7- उ्ሴ!म बोली की ध(cid:10)राशिश जमा कर दी गኋी हो, !ो पा्ቔ!ा सू(cid:27)ी, (cid:10)ीलामी ्ቚप्ቔ और बोली की ध(cid:10)राशिश को जमा कर(cid:10)े संबंधी निववरण सनिह! !हसील स्!रीኋ मत्स्ኋ आखेट सनिमचि! अप(cid:10)ी आख्ኋा सम्बኌन्ध! जिजलाचिधकारी को अ्ቇसारिर! करेगी। 8- ኋनिद जिजलाचिधकारी का समाधा(cid:10) हो जा!ा है निक मत्स्ኋ आखेट ्ቌे्ቔ को आवंनिट! कर(cid:10)े का नि(cid:10)ण(cid:4)ኋ नि(cid:10)ኋमों के उपबन्धों के अ(cid:10)ुसार निकኋा गኋा है !ो जिजलाचिधकारी प्ሾा/नि(cid:10)लामी की स्वीकृ चि! निबन्दु संख्ኋा -12 में नि(cid:10)धा(cid:4)रिर! श!O के अधी(cid:10) ्ቚदा(cid:10) कर देंगे।" As per clause 7 of the aforesaid Government Order, after deposit of the bid amount by the highest bidder, the entire papers along with reports of the Tehsil Level Committee was to be submitted to the District Magistrate which has not been done and instead the Assistant Director, Fisheries, Hamirpur proceeded to pass the order dated 13.10.2022 directing for refund of the amount on account of some dispute raised by the newly impleaded respondent no.5.
Decision
Therefore, we direct the respondent no.4 to submit entire papers to the respondent no.3 in terms of clause 7 of the Government Order dated 10.1.2019, within a week from the date of presentation of certified copy of this order before him. On receipt of the report of the respondent no.4-Sub-Divisional Officer, Sadar, District- Hamirpur/Tehsil Level Committee, the respondent no.3-District Magistrate, Hamirpur shall proceed to pass an order in accordance with the aforesaid clause 8 of the Government Order dated 10.1.2019, within one week thereafter.
