5. Learned Senior Advocate appearing for the petitioner has submitted that the controversy involved in this writ petition is only interpretation of Rules 35 and 36 of the Rules, 2009. Rule 36 has given power to the State for extension of service in special circumstances. Rule 35 stipulates the retirement age of head of institution and teachers and other employees and the second limb of the Rule 35 has general extension given to all head of the institution and teachers. If Rules 35 and 36 read together, it clarifies that power has given to the State to give extension to the teachers in special circumstances. If any extension is given to three category of teachers that should be applicable as per Section 35. Therefore, the Government has given extension to the petitioner after considering that the petitioner is a national awardee. Accordingly, petitioner's services has been extended till the age of 65. If 65 year is taken as the age of retirement as per Rule 35 to second limb of Rule 35 provides the extension till the end of academic session. Accordingly, the petitioner is entitled to continue till the end of academic session i.e.

30.06.2016.

6. In reply to the above submission, learned Standing Counsel has made his submissions based on the assertions made in the counter affidavit. Learned Standing Counsel has submitted that as per the Government Order dated 24.6.2015, teacher has to retire after completing the age of superannuation i.e. extension given upto 65 years only and further extension has not been given by the State. Hence, the petitioner is not entitled for any benefit after completing 65 years of age. As per the above, paragraph, learned Standing Counsel submits that all these benefits to the persons in the Government Order is extended only upto 65 years, hence, the petitioner is not entitled for benefit after 65 years, so he has to retire on completion of 65 years on 1.11.2025. Accordingly, the impugned order was passed based on the Government Order dated 24.6.2015.

Considering the submissions made by learned counsel for the parties and perusal of Rule 35 and 36 of the Rules, 2009, it clarifies that Rule 35 is limb of the rule prescribes the age of superannuation and undoubtedly, the petitioner's case was considered by the respondent-State under Rule 36 and it was given extension of 3 years. If we take the extension given under Rule 36 and fixing the age of superannuation of 65 years, then automatically the petitioner is entitled to the benefit as per second limb of Rule 35, general extension can be given to all head of the institution and teachers.

9. Considering the Rules and on perusal of the Government Order dated

24.06.2015, there is no specific prohibition in the Government Order dated 24.06.2015, where the said Government Order has to be read with Rule 35 of the Rules, 2009. Accordingly, the Court hold that the impugned order dated 13.03.2016 is contrary to the Rule 35 of the Rules. Therefore, the impugned order dated 13.03.2016 is set aside.

10. In view of the above, the respondents are directed to release consequential benefits to the petitioner counting till the end of academic session 30.06.2016, within a period of three months from the date of receipt of certified copy of this order.

As per the above, paragraph, learned Standing Counsel submits that all these benefits to the persons in the Government Order is extended only upto 65 years, hence, the petitioner is not entitled for benefit after 65 years, so he has to retire on completion of 65 years on 1.11.2025. Accordingly, the impugned order was passed based on the Government Order dated 24.6.2015.

Considering the submissions made by learned counsel for the parties and perusal of Rule 35 and 36 of the Rules, 2009, it clarifies that Rule 35 is limb of the rule prescribes the age of superannuation and undoubtedly, the petitioner's case was considered by the respondent-State under Rule 36 and it was given extension of 3 years. If we take the extension given under Rule 36 and fixing the age of superannuation of 65 years, then automatically the petitioner is entitled to the benefit as per second limb of Rule 35, general extension can be given to all head of the institution and teachers.

9. Considering the Rules and on perusal of the Government Order dated

24.06.2015, there is no specific prohibition in the Government Order dated 24.06.2015, where the said Government Order has to be read with Rule 35 of the Rules, 2009. Accordingly, the Court hold that the impugned order dated 13.03.2016 is contrary to the Rule 35 of the Rules. Therefore, the impugned order dated 13.03.2016 is set aside.

10. In view of the above, the respondents are directed to release consequential benefits to the petitioner counting till the end of academic session 30.06.2016, within a period of three months from the date of receipt of certified copy of this order.
