Heard learned counsel appearing on behalf of the parties.
This is a writ petition under Article 226 of the Constitution of India wherein the writ petitioner has prayed for the following substantial reliefs: "I. Issue a writ, order or direction in the nature of certiorari quashing the impugned undated rejection order whereby the application for obtaining the Police Character Certificate (P.C.C.) from the concern police station has been illegally rejected (Annexure No.1 to this writ petition). II. Issue a writ, order or direction in the nature of mandamus directing the respondent no.3 to issue the Police Character Certificate (P.C.C.) in favour of the petitioner. "
Upon perusal of the documents available on record, we are of the view that unreasoned rejection order is required to be quashed and set aside with direction upon the authority concerned.
Accordingly, the unreasoned order impugned in the present petition is quashed and set aside with a direction upon the authority concerned to once again consider the application of the petitioner and pass a reasoned order in accordance with law within a period of twelve weeks from the date of production of a certified copy of this order. Before passing the order, an opportunity of hearing should be provided to the petitioner.
