first information report was lodged against unknown persons. It is further submitted that applicant was connected with the commission of instant crime on the confessional statement of co- accused Ankit Paswan @ Mantu who was arrested by the police on the information received by the informer on 05.02.2025. It is also submitted that co-accused Ankit Paswan @ Mantu during his confessional statement has not assigned any role of firing on the car to the applicant and only stated that applicant was one of the conspirators in the said commission of crime. Learned counsel appearing on behalf of applicant submitted that applicant has one case criminal history which has been explained in para-2 of the second supplementary affidavit filed in support of the bail application and the said case has been roped against him after the present incident. Learned counsel further submitted that in the footage of C.C.T.V. Camera, no picture of the applicant was shown. In support of his contention, he has referred the page no. 32 of the bail application which is part of the case diary. Learned counsel also undertaken that applicant shall abide by all terms and conditions as imposed by this Court while granting the bail. Applicant is the permanent resident of the address mentioned in the application.

Per contra, learned counsel appearing on behalf of State based on the instructions received by the Investigating Officer submitted that applicant name was came in light on the confessional statement of co-accused Ankit Paswan @ Mantu. He has also not denied that after the incident applicant has been implicated in one case which has already been explained in second supplementary affidavit filed on behalf of applicant. It is further submitted that investigation is still going on and therefore, he is opposing the bail at this stage and prayed that bail application may be rejected at this stage till the completion investigation. He further submitted that applicant is the conspirator as stated by the co-accused in his confessional statement but he has not denied the facts that no role has been assigned to the applicant by the co-accused Ankit Paswan. He also admitted that no picture of the applicant has come in the C.C.T.V. footage.

5. Heard learned counsel for the applicant as well as learned A.G.A. for the State and perused the material on record.

6. I have perused the confessional statement of co-accused Ankit Paswan @ Mantu which has been relied on by counsel for the applicant. 7. In the aforesaid statement no role of firing has been assigned to the present applicant. Learned A.G.A. has also not pointed out or shown any apprehension that applicant is not co-operating with the investigation or there is any previous criminal history against the applicant to establish that he is a habitual offender. Applicant is a 26 years old young person. Learned counsel also undertaken that applicant shall abide by all terms and conditions as imposed by this Court while granting the bail. Investigation is still going on and the Investigating Agency is expected to complete the investigation and file the charge sheet expeditiously.

8. Taking into consideration all entirety of the matter as discussed above, I am inclined to grant bail to the applicant. The bail application is allowed.

Let the applicant- Nitin Kumar Mishra, who is involved in aforementioned case crime be released on bail on his furnishing a personal bond of Rs.50,000/-and two sureties each in the like amount to the satisfaction of the court concerned subject to following conditions. Further, before issuing the release order, the sureties be verified. (i) The applicant shall not tamper with evidence. (ii) The applicant shall remain present, in person, before the Trial Court on dates fixed for (1) opening of the case, (2) framing of charge and (3) recording of statement under Section 313 Cr.P.C./351 B.N.S.S. If in the opinion of the Trial Court absence of the applicant is deliberate or without sufficient cause, then it shall be open for the Trial Court to treat such default as abuse of liberty of bail and proceed against him in accordance with law, (4) He will co-operate with the investigating Agency and not changed his address. If he changed his address, he will inform the same to the Investigating Officer, (5) As and when applicant is called by the Investigating Officer, he will appear before him. He has also directed to report the police station concerned on every Wednesday.
