This petition, in the nature of public interest litigation, has been filed by a member of Kshetra Panchayat-43 Akbarpur, Development Block-Akbarpur, Kanpur Dehat with a prayer that the respondents be directed to construct BM/BC Pucca ‘Inayatpur Sampark Marg’ from village-Inayatpur to Prabhat Engineering College, Bara, Kanpur Dehat to connect the village with National Highway in the interest of public at large.

As per the pleadings contained in the writ petition, various complaints and representations are being moved for the last 6-7 years requesting the respondents to construct the aforesaid road under Pradhan Mantri Gram Sadak Yojana (PMGSY). Material has been annexed along with petition in support of the plea that construction of the aforesaid road 2 WPIL No.910 of 2025 is necessary for welfare of the people of that area, inasmuch as, various factories are functional in that area and an Engineering College also exists there and that the students pursuing their courses in the said Engineering College are facing difficulties in absence of a metalled road.

4. Learned Standing Counsel was directed to obtain instructions in the matter. Instructions furnished by the Executive Engineer, Construction Division-1, Public Works Department, Kanpur Dehat have been placed on record stating therein that complaints were received in the Department which have been disposed of at the level of the Competent Authority and the conclusion drawn therein is that village Inayatpur is already connected with NH-19 through Bigahi Kamir Road and that there is no Scheme for providing dual connectivity. The instructions contain specific stipulations justifying the decision of the respondents not to construct the additional road in the area, as prayed for by the petitioner. For better understanding of the stand taken by the respondents, relevant clauses of the instructions are reproduced hereunder:- “5. यह कि(cid:5) याची ्ቦी देव नारायण ्ቛारा ्ቚभात इंजीकिनयिሲरग (cid:5)ालेज से ्ቇाम इनायतपुर त(cid:5) नव किनमा(cid:31)ण (cid:5)राये जाने (cid:5)े सम्बन्ध में भारत सर(cid:5)ार(पी०जी० पो्቏(cid:31)ल) पर (cid:5)ी गयी शि*(cid:5)ायतों (cid:5)े सन्दभ(cid:31) किदनां(cid:5) (07.10.2024, 18.03.2025) (cid:5)ाया(cid:31)लय किनमा(cid:31)ण खण्ड-1, लो०किन०किव०, (cid:5)ानपुर देहात (cid:5)ो ्ቚा्቎ हुये थे , जिजन(cid:5)ा किनस्तारण आख्या स्ቌम ्ቚाधिध(cid:5)ारी (cid:5)े स्तर से कि(cid:5)या जा चु(cid:5)ा है। उ्ሹ सन्दभ(cid:31) (cid:5)े किनस्तारण में ही यह अवगत (cid:5)राया जा चु(cid:5)ा है कि(cid:5)-”्ቇाम इनायतपुर पूव(cid:31) से ही डामरी(cid:5)ृ त माग(cid:31) किबगाही (cid:5)मीर माग(cid:31) से जुड़ा है। वत(cid:31)मान में डबल (cid:5)नेሴኌ@्቏किव्቏ी ्ቚदान (cid:5)रने (cid:5)ी (cid:5)ोई योजना लो(cid:5) किनमा(cid:31)ण किवभाग (cid:5)े ्ቚचलन में नहीं है। इस सम्बन्ध में ्ቚभारी अवर अशिभयन्ता ्ቛारा शि*(cid:5)ायत(cid:5)ता(cid:31) (cid:5)ो दूरभाष पर अवगत (cid:5)रा किदया गया है।” उ्ሹ किनस्तारण आख्याए सሴኌम्मलिलत रूप से संल्ሿ(cid:5) संख्या 01 है। 6. यह कि(cid:5) याधिच(cid:5)ा (cid:5)े संल्ሿ संख्या 7 में वቓኌणत पी०जी० पो्቏(cid:31)ल पर शि*(cid:5)ायत(cid:5)ता(cid:31) ्ቦी ्ቚेम (cid:5)ु मार किनवासी 521, न्यू बस्ती मसवानपुर (cid:5)ी शि*(cid:5)ायत सन्दभ(cid:31) किदनां(cid:5) 28.10.2023 (cid:5)े किनस्तारण आख्या (cid:5)ा अवलम्ब लिलया गया है कि(cid:5) ्ቚ्቞गत इनायतपुर ्ቇाम (cid:5)े सम्प(cid:5)(cid:31) माग(cid:31) (cid:5)े डामरी(cid:5)रण (cid:5)ी किनकिवदा सूचना किदनां(cid:5) 13.08.2018 (cid:5)े बावजूद अभी्ቖ सड़(cid:5) (cid:5)ा किनमा(cid:31)ण नहीं कि(cid:5)या गया है। वस्तुतः उ्ሹ पी०जी० पो्቏(cid:31)ल पर (cid:5)ी गयी शि*(cid:5)ायत (cid:5)े किनस्तारण (cid:5)ी आख्या तथ्यात्म(cid:5) ्ቝम (cid:5)े (cid:5)ारण ्ቔुकि्቏व* इस रूप दे दी गयी कि(cid:5) ई किनकिवदा (cid:5)ा सम्बन्ध किव(cid:5)ासखण्ड-अ(cid:5)बरपुर, (cid:5)े अऩ्तग(cid:31)त आने वाले इनायतपुर ्ቇाम से है। उ्ሹ (cid:5)े सम्बन्ध में यहाँ यह स्प्ቖ (cid:5)रना है कि(cid:5) ई किनकिवदा किदनां(cid:5) 13.08.2018 (cid:5)े ्ቅमां(cid:5) 08 पर जनपद-(cid:5)ानपुर देहात (cid:5)े 'राजस्व ्ቇाम इनायतपुर सम्प(cid:5)(cid:31) माग(cid:31) (cid:5)ा किनमा(cid:31)ण ' (cid:5)ा उ्ቤेख कि(cid:5)या गया है जो वास्तव में किव(cid:5)ासखण्ड-मलासा (cid:5)े राजस्व ्ቇाम इनायतपुर हेतु आ*धियत है अथा(cid:31)त याची ्ቛारा सन्दቓኌभत ्ቇाम इनायतपुर अन्तग(cid:31)त किव(cid:5)ासखण्ड-अ(cid:5)बरपुर हेतु लो(cid:5) किनमा(cid:31)ण किवभाग ्ቛारा ्ቚ्቞गत सम्प(cid:5)(cid:31) माग(cid:31) हेतु (cid:5)भी भी किनकिवदा (cid:5)ा ्ቚ(cid:5)ा*न कि(cid:5)सी रूप में नहीं कि(cid:5)या गया है। 7. यह कि(cid:5) *ासन (cid:5)ी ्ቚाथकिम(cid:5)ता में है कि(cid:5) ्ቚत्ये(cid:5) ्ቇाम (cid:5)ो िሺसगल रोड (cid:5)नेሴኌ@्቏किव्቏ी (cid:5)े माध्यम से जोड़ा जाये, सम््ቚधित जनपद (cid:5)ानपुर देहात में अभी भी सम्प(cid:5)(cid:31) माग(cid:31) से 3 WPIL No.910 of 2025 न जुड़ने वाले ्ቇामों (cid:5)ो ्ቚाथकिम(cid:5)ता पर जोड़ने (cid:5)ी (cid:5)ाय(cid:31)वाही ्ቚचलिलत है। यह भी उ्ቤेखनीय है कि(cid:5) *ीष(cid:31) स्तर पर लिलये गये किनण(cid:31)य (cid:5)े ्ቅम में ऐसे गांव जिजन(cid:5)ी आबादी 150 से अधिध(cid:5) हो, (cid:5)ो धिचሴኌन्हत (cid:5)रते हुये असंतृ्቎ मजरों/बसाव्቏ों (cid:5)ो सम्प(cid:5)(cid:31) माग(cid:31) से जोड़ने (cid:5)ी (cid:5)ाय(cid:31)योजना अमल में लायी जा रही है।

8. यह कि(cid:5) ्ቚ्቞गत याधिच(cid:5)ा में याची ्ቛारा ्ቇाम इनायतपुर (cid:5)ो रा्ቖ्रीय राजमाग(cid:31) संख्या- 19 से जोड़ने हेतु प्ሪे सम्प(cid:5)(cid:31) माग(cid:31) (cid:5)ी मांग (cid:5)ी गयी है। ्ቇाम इनायतपुर किव(cid:5)ासखण्ड-अ(cid:5)बरपुर पूव(cid:31) से ही रा्ቖ्रीय राजमाग(cid:31) संख्या-19 से किन(cid:5)लने वाले बारा जिस(cid:5)न्दरा माग(cid:31) से किबगाही माग(cid:31) (्ቇामीण माग(cid:31)) लम्बाई 0.600 कि(cid:5)०मी०, बारा अ(cid:5)बरपुर से किबगाही (cid:5)मीर माग(cid:31) (्ቇामीण माग(cid:31)) लम्बाई 5.000 कि(cid:5)०मी० एवं मन्सूरा से इनायतपुर सम्प(cid:5)(cid:31) माग(cid:31) (्ቇामीण माग(cid:31)) लम्बाई 1.675 कि(cid:5)०मी० होते हुए प्ሪे सम्प(cid:5)(cid:31) माग(cid:31) से जुड़ा है जिजससे तहसील अ(cid:5)बरपुर (cid:5)ानपुर देहात , जिजला मुख्यालय (cid:5)ानपुर देहात, जिजला धिचकि(cid:5)त्सालय (cid:5)ानपुर देहात एवं थाना अ(cid:5)बरपुर (cid:5)ानपुर देहात व मा० न्यायालय, (cid:5)ानपुर देहात पहु ंचने हेतु न्यूनतम दूरी (cid:5)ा माग(cid:31) है यातायात हेतु सुलभ एवं सुगम है जिजसे ्ቇाम इनायतपुर (cid:5)े नागरिर(cid:5)ों ्ቛारा जिजला मुख्यालय आने एवं जाने हेतु ्ቚयोग कि(cid:5)या जाता है। ्ቇाम इनायतपुर (cid:5)े लिलए ्ቚस्ताकिवत माग(cid:31) (cid:5)ी मांग दो तरफ (डबल (cid:5)नेሴኌ@्቏किव्቏ी) (cid:5)ी ्ቦेणी (cid:5)ी है, ्ቚ्቞गत ्ቇाम हेतु लो(cid:5) किनमा(cid:31)ण किवभाग में मजरों एवं ्ቇामों (cid:5)ो दो तरफ (डबल (cid:5)नेሴኌ@्቏किव्቏ी) से जोड़े जाने (cid:5)ी (cid:5)ोई योजना ्ቚचलिलत नहीं है, यह ्ቇाम पूव(cid:31) से ही ए(cid:5) तरफ से प्ሪे सम्प(cid:5)(cid:31) माग(cid:31) से जुड़ा हुआ है। यह भी उ्ቤेखनीय है कि(cid:5) मांग कि(cid:5)ये जाने वाले ्ቚस्ताकिवत माग(cid:31) (cid:5)ा किनमा(cid:31)ण हो जाने से (cid:5)शिथत माग(cid:31) रा्ቖ्रीय राजमाग(cid:31) संख्या-19 पर ሴኌस्थत बाराजोड़ ्቏ोल प्लाजा (cid:5)े बाईपास (cid:5)े रूप में (cid:5)ाय(cid:31) कि(cid:5)ये जाने (cid:5)ी पूरी अधिधसम्भाव्यता है, ऐसी ሴኌस्थधित में भारी एवं अन्य वाहनों (cid:5)े इस माग(cid:31) से गुजरने (cid:5)ी सम्भावना है। उ्ሹ वाहनों (cid:5)े ्ቛारा अऩ्य सम्ब्ቍ ्ቇामीण माग_ (cid:5)ो भी ्ቌधित्ቇस्त कि(cid:5)ये जाने (cid:5)ी ्ቚबल सम्भावना से इन्(cid:5)ार नहीं कि(cid:5)या जा स(cid:5)ता। (cid:5)शिथत माग(cid:31) (cid:5)े ्቏ोल प्लाजा (cid:5)े बाईपास (cid:5)े रूप में ्ቚयोग कि(cid:5)ये जाने (cid:5)ी ሴኌस्थधित में ्቏ोल (cid:5)ी वसूली में राजस्व (cid:5)ी ्ቌधित भी होना स्वाभाकिव(cid:5) है। अतः उ्ሹ (cid:5)े दृकि्ቖगत ्ቚ्቞गत संरेखण(alignment) में माग(cid:31) (cid:5)ा किनमा(cid:31)ण कि(cid:5)या जाना सम््ቚधित औधिचत्यपूण(cid:31) नहीं है। उ्ሹ ሴኌस्थधित (cid:5)े आ(cid:5)लन (cid:5)ो न@*े (cid:5)े माध्यम से धिचकि्ቔत (cid:5)रते हुये संल्ሿ(cid:5) संख्या 02 (cid:5)े रूप में संल्ሿ कि(cid:5)या जा रहा है। ”

Along with instructions, a map has also been attached, a perusal whereof indicates that village Inayatpur is well connected with NH-19 through connecting road called 'Bara Akbarpur Marg to Bigahi Kamir Marg.' On perusal of the red-marking depicting proposed road, we find that the same passes through one Prabhat Engineering College, about which the petitioner has made averments in the writ petition but, at the same time, we notice that on NH-19, there also exists a toll plaza namely 'Barajod Toll Plaza' and the topography of location clearly indicates that if the commuters, by using the already existing 'Bara Akbarpur Marg to Bigahi Kamir Marg', reach at NH-19, they will certainly have to cross the said toll plaza but, in case the proposed road is constructed, the commuters would be able to have access to NH-19 without passing through the toll plaza and, thereby avoiding payment of toll charges. It may be one of those considerations, apart from other, for which the 4 WPIL No.910 of 2025 proposed road is being sought to be constructed through intervention by this Court.

6. A supplementary affidavit filed on behalf of the petitioner is also on record which is accompanied by a disposal report of some IGRS complaint. It is clearly indicated in the said report (Annexure SA-2) that steps were taken in the year 2018-19 for construction of the metalled road (as prayed for by the petitioner) and intimation regarding e-tender was also floated but the same was cancelled on account of non-sanction by the State Government and, therefore, no construction could be done. Along with the same supplementary affidavit, photographs of building of Prabhat Engineering College have also been annexed.

We may observe that Annexure SA-2 to the supplementary affidavit has already been annexed as Annexure No.7 to the writ petition and, in that regard, the stand taken by the respondents in the aforequoted instructions is that the disposal report dated 28.10.2023 relating to IGRS complaint erroneously refers to village-Inayatpur falling under development block ‘Akbarpur’ and, in fact, the e-tender dated

13.08.2018 was related to revenue village Inayatpur falling under development block ‘Malasa’ and that no tender was ever published in any form concerning village Inayatpur, development block ‘Akbarpur.’ In this view of the matter, we find that reliance placed by the petitioner on publication of e-tender is fallacious and, even otherwise, if at all what the petitioner says is accepted as correct, though denied by the respondents, the situation would be that no sanction from the Government was ever received qua the e-tender notice.

8. The overall material on record indicates that the respondents, after analyzing the feasibility of laying down the proposed metalled road, have found it “non-feasible” or “not required”. The decision of the respondents is explicit in the instructions furnished before this Court. We are of the view that the matter in issue being in realm of the respondents and they being the appropriate Authorities to analyze the pros and cons of laying down the proposed road, this Court, in exercise of writ jurisdiction under Article 226 of the Constitution of India, would not 5 WPIL No.910 of 2025 overturn the wisdom of the respondents, unless there are compelling reasons to arrive at a conclusion that the action of the respondents in not laying down the road suffers from arbitrariness or any other alike reason. However, we do not find any such circumstances borne out from the record of the present case and, therefore, we decline to issue any direction in the matter.

8. यह कि(cid:5) ्ቚ्቞गत याधिच(cid:5)ा में याची ्ቛारा ्ቇाम इनायतपुर (cid:5)ो रा्ቖ्रीय राजमाग(cid:31) संख्या- 19 से जोड़ने हेतु प्ሪे सम्प(cid:5)(cid:31) माग(cid:31) (cid:5)ी मांग (cid:5)ी गयी है। ्ቇाम इनायतपुर किव(cid:5)ासखण्ड-अ(cid:5)बरपुर पूव(cid:31) से ही रा्ቖ्रीय राजमाग(cid:31) संख्या-19 से किन(cid:5)लने वाले बारा जिस(cid:5)न्दरा माग(cid:31) से किबगाही माग(cid:31) (्ቇामीण माग(cid:31)) लम्बाई 0.600 कि(cid:5)०मी०, बारा अ(cid:5)बरपुर से किबगाही (cid:5)मीर माग(cid:31) (्ቇामीण माग(cid:31)) लम्बाई 5.000 कि(cid:5)०मी० एवं मन्सूरा से इनायतपुर सम्प(cid:5)(cid:31) माग(cid:31) (्ቇामीण माग(cid:31)) लम्बाई 1.675 कि(cid:5)०मी० होते हुए प्ሪे सम्प(cid:5)(cid:31) माग(cid:31) से जुड़ा है जिजससे तहसील अ(cid:5)बरपुर (cid:5)ानपुर देहात , जिजला मुख्यालय (cid:5)ानपुर देहात, जिजला धिचकि(cid:5)त्सालय (cid:5)ानपुर देहात एवं थाना अ(cid:5)बरपुर (cid:5)ानपुर देहात व मा० न्यायालय, (cid:5)ानपुर देहात पहु ंचने हेतु न्यूनतम दूरी (cid:5)ा माग(cid:31) है यातायात हेतु सुलभ एवं सुगम है जिजसे ्ቇाम इनायतपुर (cid:5)े नागरिर(cid:5)ों ्ቛारा जिजला मुख्यालय आने एवं जाने हेतु ्ቚयोग कि(cid:5)या जाता है। ्ቇाम इनायतपुर (cid:5)े लिलए ्ቚस्ताकिवत माग(cid:31) (cid:5)ी मांग दो तरफ (डबल (cid:5)नेሴኌ@्቏किव्቏ी) (cid:5)ी ्ቦेणी (cid:5)ी है, ्ቚ्቞गत ्ቇाम हेतु लो(cid:5) किनमा(cid:31)ण किवभाग में मजरों एवं ्ቇामों (cid:5)ो दो तरफ (डबल (cid:5)नेሴኌ@्቏किव्቏ी) से जोड़े जाने (cid:5)ी (cid:5)ोई योजना ्ቚचलिलत नहीं है, यह ्ቇाम पूव(cid:31) से ही ए(cid:5) तरफ से प्ሪे सम्प(cid:5)(cid:31) माग(cid:31) से जुड़ा हुआ है। यह भी उ्ቤेखनीय है कि(cid:5) मांग कि(cid:5)ये जाने वाले ्ቚस्ताकिवत माग(cid:31) (cid:5)ा किनमा(cid:31)ण हो जाने से (cid:5)शिथत माग(cid:31) रा्ቖ्रीय राजमाग(cid:31) संख्या-19 पर ሴኌस्थत बाराजोड़ ्቏ोल प्लाजा (cid:5)े बाईपास (cid:5)े रूप में (cid:5)ाय(cid:31) कि(cid:5)ये जाने (cid:5)ी पूरी अधिधसम्भाव्यता है, ऐसी ሴኌस्थधित में भारी एवं अन्य वाहनों (cid:5)े इस माग(cid:31) से गुजरने (cid:5)ी सम्भावना है। उ्ሹ वाहनों (cid:5)े ्ቛारा अऩ्य सम्ब्ቍ ्ቇामीण माग_ (cid:5)ो भी ्ቌधित्ቇस्त कि(cid:5)ये जाने (cid:5)ी ्ቚबल सम्भावना से इन्(cid:5)ार नहीं कि(cid:5)या जा स(cid:5)ता। (cid:5)शिथत माग(cid:31) (cid:5)े ्቏ोल प्लाजा (cid:5)े बाईपास (cid:5)े रूप में ्ቚयोग कि(cid:5)ये जाने (cid:5)ी ሴኌस्थधित में ्቏ोल (cid:5)ी वसूली में राजस्व (cid:5)ी ्ቌधित भी होना स्वाभाकिव(cid:5) है। अतः उ्ሹ (cid:5)े दृकि्ቖगत ्ቚ्቞गत संरेखण(alignment) में माग(cid:31) (cid:5)ा किनमा(cid:31)ण कि(cid:5)या जाना सम््ቚधित औधिचत्यपूण(cid:31) नहीं है। उ्ሹ ሴኌस्थधित (cid:5)े आ(cid:5)लन (cid:5)ो न@*े (cid:5)े माध्यम से धिचकि्ቔत (cid:5)रते हुये संल्ሿ(cid:5) संख्या 02 (cid:5)े रूप में संल्ሿ कि(cid:5)या जा रहा है। ”

Along with instructions, a map has also been attached, a perusal whereof indicates that village Inayatpur is well connected with NH-19 through connecting road called 'Bara Akbarpur Marg to Bigahi Kamir Marg.' On perusal of the red-marking depicting proposed road, we find that the same passes through one Prabhat Engineering College, about which the petitioner has made averments in the writ petition but, at the same time, we notice that on NH-19, there also exists a toll plaza namely 'Barajod Toll Plaza' and the topography of location clearly indicates that if the commuters, by using the already existing 'Bara Akbarpur Marg to Bigahi Kamir Marg', reach at NH-19, they will certainly have to cross the said toll plaza but, in case the proposed road is constructed, the commuters would be able to have access to NH-19 without passing through the toll plaza and, thereby avoiding payment of toll charges. It may be one of those considerations, apart from other, for which the 4 WPIL No.910 of 2025 proposed road is being sought to be constructed through intervention by this Court.

6. A supplementary affidavit filed on behalf of the petitioner is also on record which is accompanied by a disposal report of some IGRS complaint. It is clearly indicated in the said report (Annexure SA-2) that steps were taken in the year 2018-19 for construction of the metalled road (as prayed for by the petitioner) and intimation regarding e-tender was also floated but the same was cancelled on account of non-sanction by the State Government and, therefore, no construction could be done. Along with the same supplementary affidavit, photographs of building of Prabhat Engineering College have also been annexed.

We may observe that Annexure SA-2 to the supplementary affidavit has already been annexed as Annexure No.7 to the writ petition and, in that regard, the stand taken by the respondents in the aforequoted instructions is that the disposal report dated 28.10.2023 relating to IGRS complaint erroneously refers to village-Inayatpur falling under development block ‘Akbarpur’ and, in fact, the e-tender dated

13.08.2018 was related to revenue village Inayatpur falling under development block ‘Malasa’ and that no tender was ever published in any form concerning village Inayatpur, development block ‘Akbarpur.’ In this view of the matter, we find that reliance placed by the petitioner on publication of e-tender is fallacious and, even otherwise, if at all what the petitioner says is accepted as correct, though denied by the respondents, the situation would be that no sanction from the Government was ever received qua the e-tender notice.

8. The overall material on record indicates that the respondents, after analyzing the feasibility of laying down the proposed metalled road, have found it “non-feasible” or “not required”. The decision of the respondents is explicit in the instructions furnished before this Court. We are of the view that the matter in issue being in realm of the respondents and they being the appropriate Authorities to analyze the pros and cons of laying down the proposed road, this Court, in exercise of writ jurisdiction under Article 226 of the Constitution of India, would not 5 WPIL No.910 of 2025 overturn the wisdom of the respondents, unless there are compelling reasons to arrive at a conclusion that the action of the respondents in not laying down the road suffers from arbitrariness or any other alike reason. However, we do not find any such circumstances borne out from the record of the present case and, therefore, we decline to issue any direction in the matter.
