Heard learned counsel for the petitioner, Ms. Archana Srivastava, learned counsel for the respondent nos. 1 and 3 and learned Standing counsel for the respondent no. 2.

Pursuant to order of this Court dated 10.4.2025, Ms. Archana Srivastava, learned counsel for the respondent nos. 1 and 3, has obtained instructions dated 15.4.2025, which is taken on record.

Based on instructions, she informed that passport of the petitioner is impounding under Section 10 sub-section 3 (b) under provisions of the Passport Act, 1967. She further informed that against the impounding of the passport, the petitioner is having remedy to file appeal before the Chief Passport Officer under Section 11 of the Act, 1967.

Learned counsel for the petitioner could not dispute the aforesaid fact and submitted that there is some delay in filing the appeal which may be condoned.

Accordingly, writ petition is dismissed with liberty to file appeal under Section 11 of the Act, 1967, before Competent Authority.
