1. Heard Mr. Brijesh Kumar Prajapati, learned counsel for the petitioner, Mr. Shibili Naseem, learneed counsel for respondent No.6 and Dr. Govind Kumar Saxena, learned Additional Chief Standing Counsel for the State- respondents.

2. The instant public interest litigation has been filed for the following relief:- i. To issue a writ, order or direction in the nature of mandamus directing the respondents authorities to restrain the miscreants/ encroachers not to raise illegal construction of Police Chowki and Hanuman Temple in the Gata No. 516Kha area about 0.0120 hectare situated at Village Chandhasi (Ralhupur), Tehsil Pt. Deen Dayal Upadhyay Nagar (Mugalsarai, District Chandauli recorded as Panchayat Bhawan as the earliest and restore the nature of the land in its original position. ii. To issue a writ, order or direction in the nature of mandamus directing the respondent no. 3 to decide the representation of petitioner dated 07.01.2025 within stipulated time as directed by this Hon'ble Court."

3. This court vide order dated 07.07.2025 directed the learned Standing Counsel to obtain instruction. In compliance of the order of this Court dated 07.07.2025, instruction dated 15.07.2025 sent by Sub Divisional Officer, Chandauli is taken on record.

4. Learned counsel for the petitioner submitted that in view of the entry of plot No.516 Kha area 0.0120 hectare, the police Chauki and Hanuman temple cannot be constructed over the same. He submitted that representation dated 07.1.2025 filed on behalf of petitioner along with other villagers is pending before the Court. He submitted that authorities should be restrained from raising construction of police chauki and hanuman temple over plot No.516.

Dr. Govind Kumar Saxena, learned Additional chief Standing Counsel for the State-respondent and Mr. Shibli Naseem, learned counsel for respondent No.6 submitted that the instant public interest litigation has not been filed in public interest, as such same cannot be entertained. They further submitted that the construction of the temple as well as police chauki is in the interest of the villagers of the village, as such the instant public interest litigation is liable to be dismissed. They further submitted that there is no need of construction of panchayat bhawan as Nagar Palika came into existence in the area, as such public interest litigation cannot be entertained.

6. I have considered the arguments advanced by the learned counsel for the parties and perused the record.

7. There is no dispute about the fact that plot No.516 Kha area 0.0120 hectare is recorded as panchayat bhawan in the revenue record.

Perusal of the instruction as quoted above demonstrate that construction of the temple and police chauki is in the interest of the villagers as such instant public interest litigation cannot be entertained. The instruction further demonstrate that representation dated 07.01.2025 Annexure No.2 to the instant public interest litigation has been disposed of by Sub Divisional Officer vide order dated 11.07.2025 recording reason in support of the order that construction of police chauki and temple in the plot in question is in the interest of the villagers of the village in question.
