This is plaintiffs' petition.
In the suit instituted by plaintiffs being Case No. 293 of 2024, a compromise was entered between the plaintiffs and defendant and the same was filed before the court below on 22.11.2024. The said compromise is pending consideration. The sole prayer made in the writ petition is for a direction upon the court below to proceed in the matter in terms of Order XXIII Rule 3 CPC.
As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon court below to proceed in the matter in terms of Order XXIII Rule 3 CPC, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order.
