Heard Sri Anil Kumar Srivastava, learned counsel for the petitioner, Sri Vikram Bahadur Singh, learned counsel appearing for respondents 2 to 4 and learned Standing Counsel for the State and perused the material available on record. By means of this writ petition under Article 226 of the Constitution, the petitioner has prayed for (I) issuance of a writ, order or direction in the nature of Mandamus commanding respondents to make payments of salary to the petitioner as per the Government orders dated 09.06.2014 & 01.12.2014 along with the arrears on that account, (II) issue a writ, order or direction in the nature of Mandamus commanding respondent no. 3 to decide representation dated 31.05.2022. Learned counsel for the petitioner has submitted that petitioner seeks a writ of Mandamus commanding the respondents to make payment of salary to the petitioner, who was appointed as Assistant Teacher in the year 2005, as per the Government orders dated 09.06.2014 & 01.12.2014. In this regard, petitioner moved a representation before the District Basic Education Officer, Etawah on 31.05.2022 but respondent no. 3 has not taken any action and the matter is still pending. The said representation of the petitioner may be directed to be decided expeditiously in accordance with law. Sri Vikram Bahadur Singh, learned counsel appearing for respondents 2 to 4 has no objection to the same and learned Standing Counsel does not dispute the aforesaid contention and states that in case the said representation is still pending, the same shall be considered and disposed of in accordance with law. Having considered the facts and circumstances of the case but without prejudice to the merits of the case, the writ petition is finally disposed of with direction to the respondent no.4 to consider and decide the representation dated 31.05.2022 pending before it, in accordance with law, within a period of two months from the date of production of copy of this order.
