Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

Learned counsel for the applicant has submitted that the applicant is informant in Case No.13722 of 2024 (State vs. Neha Jaiswal & Ors.) arising out of Case Crime No.9 of 2024 under Section 323, 504, 506, 427, 452 IPC at Police Station- Kotwali, District-Gorakhpur. The said case is pending in the court of Additional Chief Judicial Magistrate-II, Gorakhpur. A cross case against the applicant was lodged by the respondent which is Sessions Trial No.784 of 2022 (State vs. Ajay Jaiswal & Ors.) which is pending in the sessions court. Case No.13722 of 2024 has still not been committed to the court of Sessions which is apparent from the latest report submitted by ACJM- IInd, Gorakhpur. Learned counsel, therefore, prays that a direction be issued to the learned Magistrate to expedite the committal proceedings of Case No.13722 of 2024 (State vs. Nehal Jaiswal) as expeditiously as possible.

Considering the submissions made by the learned counsel for the applicant, the concerned learned Magistrate is directed to expedite the committal proceedings of Case No.13722 of 2 NA529 No. 646 of 2025 2024 by taking all available measures including coercive steps, expeditiously and preferably within a period of one month from the date of production of a certified copy of this order, provided there is no legal impediment.
