It is alleged in the FIR that the informant contacted accused Pankaj Singh with regard to purchase his property situated over Arazi No.695/4 Sub Plot No.51, Rakba 1560 varg fit, Mauza Lalapur, Meerapur Bahsi, Pargana Shivpur Varanasi. Thereafter informant paid Rs.50,000,00/- through cheque and Rs.30,000,00/- in cash but accused Pankaj Singh had not executed sale deed in favour of the informant and sold the disputed property to some other person. It is also stated in the FIR that co-accused Dinesh Singh had given three cheques of amount Rs.70,000,00/- and stated that if he would not execute the sale deed in their favour then he may produce for encashment before bank. The informant put the cheques in bank for encashment but the cheques were dishonored and payment had been stopped.

4. Counsel for the applicants submits that applicant no.1 Smt. Padma Singh is wife of co-accused Dinesh Singh and having no concerned. On perusal of FIR and statements recorded under Section 161 Cr.P.C. there is no allegation 2 A482 No. 16026 of 2020 against the applicants in regard to taking money or assurance given to informant for execution of sale deed. Applicant no.2-Atul Singh is the son of co-accused Dinesh Singh. On perusal of contents of FIR and statement recorded under Section 161 Cr.P.C. there is no allegation against the applicant no.2. Investigating Officer recorded the statement of the informant, sole witness and submitted charge sheet against the five accused persons under the aforesaid sections. The contents of FIR as well as statement of witnesses recorded under Section 161 Cr.P.C. no offence under the aforesaid sections is made out. There is no whisper in regard cheating and breach of trust against the applicants. Applicants have been involved in the present case only for pressurizing the accused to execute the sale deed. It is further submitted that in respect of alleged transaction of money in between opposite party no.2 and Pankaj Singh a Case bearing No.1647 of 2018, under Section 138 N.I. Act has been filed by opposite party no.2 against Pankaj Singh. It is averred that opposite party no.2 lodged multiple first information reports in respect of same transaction of money at different police stations. Applicant no.2 resides in Kolkata and has no concern with the alleged incident and being mother and brother of the accused Pankaj Singh, applicants name have been implicated in the present case. The prosecution against the applicants is illegal, arbitrary and abuse of process of Court. Learned counsel for the applicants next submits that the informant has initiated proceeding under Section 138 N.I. Act against co-accused Pankaj Singh which is pending till date. For consideration, the contents of FIR is being reproduced below :- "नकल तहरीर िहन्दी वादी सेवा में, थाना ्ऺभारी/थानाध्य्ष थाना कै ण्ट वाराणसी वाराणसी महोदय, मैं भूपेन््श िसह पु्ऴ ्शी िशवभ्श िसह, दुगार् काम्पलेक्स िशवपुर वाराणसी में िनवास करता हूँ। आप को अवगत कराना है िक मैंने एक फ्लैट आराजी नं0 695/4 सब प्लाट नं0 51 रकबा 1560 वगर् फीट (वन प्लेस ्षुप में िस्थत) मौजा लालपुर, मीरापुर बसही परगना िशवपुर वाराणसी जो ्शीमती रंजना िसह पत्नी ्शी पंकज िसह के नाम पर िदनांक

06.05.2016 को खरीदा था। उसको पंकज िसह पु्ऴ िदनेश िसह बेचना चाहते थे, मुझे जानकारी होने पर मैनें पकं ज िसह पु्ऴ िदनेश िसह से सम्पकर् िकया। उ्व फ्लैट को रुपया अस्सी लाख स्तर हजार रुपया (रु०8070000/-) में बेचने का सौदा िदनेश िसह, िदनेश िसह की पत्नी पदमा िसह, पंकज िसह एवं अतुल िसह (पंकज िसह का छोटा भाई) पु्ऴगण िदनेश िसह एवं ्शीमती रंजना िसह (पत्नी पंकज िसह) का सभी की सहमित से बेचना तय हुआ। उन लोगो ्षारा कहा गया िक पैसा रुपया अस्सी लाख स्तर हजार भुगतान के बाद मैं उ्व फ्लैट को आप के नाम से रिजस््िी कर दूंगाँ। मैंने िदनेश से, पंकज िसह, अतुल िसह (पु्ऴगण िदनेश िसह), ्शीमती पदमा िसह (पत्नी िदनेश िसह) के मजर् से एवं रंजना िसह पत्नी पंकज िसह सभी के सहमत के अनुसार उनके घर (्षाम-म़ावा, लमही पाण्डेयपुर वाराणसी) में रुपया तीस 3 A482 No. 16026 of 2020 लाख नगद एवं रुपया पचास लाख स्तर हजार चेक ्षारा सबके सामने मेरे ्षारा भुगतान िकया गया उन सभी ने कहा की कु छ िदन में रिजस््िी कर दुगों। मैने कहा की िलखा प़ाी कु छ हो जाए तो िदनेश िसह ने अपने पु्ऴ पंकज िसह से तीन चेक (भूपेन््श िसह के नाम) िजसकी कीमत रुपया अस्सी लाख स्तर हजार थी मुझे दे िदया और कहा की रिजस््िी के बाद यह चेक आप को मुझे वापस कर देना पड़ेगा। उ्व बातों से सहमत उ्व सभी पांचो लोग थे। परन्तु बाद में उ्व फ्लैट को अन्य ्िि्व को बेच िदया, जब मैंने उन्हे यह बात कही तो उन्होंने कहा अपना पैसा िदये गये चेक से ले लो। परन्तु चेक बैंक में भुगतान हेतु लगाने के बाद पता चला िक बैंक से उ्व चेक का भुगतान रोक (स्टाप) कर िदया गया है। इस तरह मेरे साथ संगिठत अपराध के तहत सािजस की गयी। संगिठत अपराध/सािजस में िदनेश िसह िनवासी (्षाम)-मा़वा लमही पाण्डेयपुर वाराणसी) थाना कै ण्ट वाराणसी, ्शीमती पदमा िसह (पत्नी िदनेश िसह), पंकज िसह, अतुल िसह (पु्ऴ िदनेश िसह) एवं ्शीमती रंजना िसह पत्नी (पत्नी पंकज िसह) सभी पांचों लोग शािमल थे मेरे पैसे की डकै ती डाल, लूट, धोखाधड़ी एवं सगिठत अपराध/सािजस कर मुझे कं गाल कर िदया गया। बाद में सू्ऴों से पता चला िक पंकज एवं अतुल िसह पु्ऴगण िदनेश िसह मेरे ्षारा भुगतान की गयी धनरािश से ्िक इत्यािद खरीद कर दुगार्पुर पि्ाम बंगाल में ्िांस्पोटर् कम्पनी चलाते है पैसा मागने पर मुझे धमकाते हैं। उ्व सभी पांचो लोग ्षाम म़ावा लमही, पाण्डेयपुर वाराणसी अपने भवन में िनवास करते है। सभी लोगो ने अपना मोबाईल बंद रखा है या नं० बदल िदया है अभी अतुल िसह का नया मोबाईल नं0 9093746216 ओ, अभी पता चला है िक चालू है। आप से न्ा िनवेदन है िक उपरो्व िबन्दुओं को सं्ञान में लेते हुए, ्शी िदनेश िसह िनवासी ्षाम म़ावा लमही पाण्डेयपुर वाराणसी, ्शीमती पदमा िसह (पत्नी िदनेश िसह), पंकज िसह, अतुल िसह (पु्ऴगण िदनेश िसह) एवं ्शीमती रंजना िसह (पत्नी पंकज िसह) िजन्होंने मेरे साथ संगिठत अपराध/सािजस, डकै ती, धोखाधड़ी एवं लूट के तहत मुझे ्ऺतािड़त िकया, उ्व पांचो लोगों के िखलाफ आई०पी०सी० धारा के तहत एफ०आई०आर० दजर् कर मेरे ्षारा भुगतान की गयी धनरािश वापस कराने एवं मेरे साथ न्याय िदलाने की कृ पा करें। िदनांक 23/09/2019 भवदीय SD भूपेन््श िसह (भूपेन््श िसह) दुगार् कम्प्लेक्स िशवपुर वाराणसी-22100 नोट- मैं का०मु० राजेश कु मार ्ऺमािणत करता हूँ मेरे ्षारा तहरीर की कायमी व धारा का अंकन कर सीसीटीएनएस पर का० देवेन््श कु मार से अ्षरश िकता कराया गया। नोट में का0मु0 620 अरिबन्द कु मार यादव ्ऺामिणत करता हूं थाना कैं ट जनपद वाराणसी पर पंजीकृ त 1250/ 2019 स्थानान्तिरत होकर थाना िशवपुर वाराणसी पर कायमी मेरे ्षारा थाना िशवपुर वाराणसी कराया ।"

5. Per contra, learned counsel for the informant vehemently opposed the submission raised by learned counsel for the applicants and submitted that applicant no.1 Smt. Padma Singh is wife of co-accused Dinesh Singh who had promised to execute sale deed in favour of the informant but after taking money i.e. amount of Rs.80,70,000/- from the informant he had not executed sale deed. Since beginning intention of the co-accused Dinesh Singh to cheat the informant and grab the money. Applicants along-with other co-accused took money with intention to cheat, subsequently has cancelled sale deed. Applicant No.1 with the intention to take away from judicial custody as well as escaping from attachment of his property executed a will in favour of his 4 A482 No. 16026 of 2020 elder son, Atul Singh (applicant no.2). Learned counsel for the informant further submitted that proceeding under Section 138 N.I. Act is pending against the co-accused Pankaj Singh and applicants, have criminal history which has been explained in paragraph no.16 of the counter affidavit. Prima- facie offence is made out. Statement of informant recorded under Section 161 Cr.P.C. is being reproduced below :- "बयान मुकदमा वादी: भूपेन््श िसह पु्ऴ िशवभ्श िनवासी दुगार् कामप्लेक्स थाना िशवपुर वाराणसी उ्ा करीब 65 वषर् मो0नं0 9956529209 बदिरयाफ्त पूछने पर बता रहे हैं िक मैने एक फ्लैट आराजी नं. 695/4 प्लाट नं0 51 रकबा 1560 वगर् फीट (वन प्लेस ्षुप में िस्थत) मौजा लालपुर, मीरापुर बसही परगना िशवपुर वाराणसी, जो ्शीमती रंजना िसह पत्नी ्शी पंकज िसह के नाम पर िदनाक 06.05.2016 को खरीदा गया था। उसको पंकज िसह पु्ऴ िदनेश िसह बेचना चाहते थे, इस बात की मुझे जानकारी होने पर मैनें पंकज िसह पु्ऴ िदनेश िसह से सम्पकर् िकया। उ्व फ्लैट को रुपया अस्सी लाख स्तर हजार रुपया (रु0 8070000/-) में बेचने की बातचीत िदनेश िसह, िदनेश िसह की पत्नी पदमा िसह, पंकज िसह एवं अतुल िसह (पंकज िसह का छोटा भाई) पु्ऴगण िदनेश िसह एवं ्शीमती रंजना िसह (पत्नी पंकज िसह) का सभी की सहमित से बेचना तय हुआ। उन लोगों ्षारा कहा गया िक पैसा रुपया अस्सी लाख स्तर हजार भुगतान के बाद मैं उ्व फ्लैट को आप के नाम से रिजस््िी कर दी जायेगा। सभी के सहमती के अनुसार उनके घर (्षाम म़ॿवा, लमही, पाण्डेयपुर वाराणसी) में रुपया तीस लाख नगद एवं रुपया पचास लाख स्तर हजार चेक ्षारा सबके सामने मेरे ्षारा भुगतान िकया गया उन सभी ने कहा की कु छ िदन में रिजस््िी कर िदया जायेगा तथा मेरे पैसे के गारण्टी के एवज िदनेश िसह ने अपने पु्ऴ पंकज िसह से तीन चेक मेरे नाम िदया िजसकी कीमत रुपया अस्सी लाख स्तर हजार थी मुझे दें िदया और कहा की रिजस््िी के बाद यह चेक आपको मुझे वापस कर देना पड़ेगा। उ्व बातों से सहमत उ्व सभी पांचों लोग थे। परन्तु बाद में उ्व फ्लैट को अन्य ्िि्व को बेच िदया, जब मैने उन्हें यह बात कही तो उन्होंने कहा अपना पैसा िदये गये चेक से ले लो। परन्तु चेक बैंक में भुगतान हेतु लगाने के बाद पता चला िक बैंक से उ्व चेक का भुगतान रोक िदया गया है। इस तरह मेरे साथ संगिठत अपराध के तहत सािजस की गयी। संगिठत अपराध/सािजस में िदनेश िसह िनवासी (पाण्डेयपुर, म़ावा लमही पाण्डेयपुर वाराणसी) थाना कै ण्ट वाराणसी, ्शीमती पदमा िसह (पत्नी िदनेश िसह), पंकज िसह, अतुल िसह (पु्ऴ िदनेश िसह) एवं ्शीमती रंजना िसह पत्नी (पत्नी पंकज िसह) सभी पांचों लोग सािमल थे मेरे पैसे की डकै ती डाल, लूट, धोखाधड़ी एवं संगिठत अपराध/सािजस कर मुझे कं गाल कर िदया गया। बाद में सू्ऴों से पता चला िक पंकज एवं अतुल िसह पु्ऴगण िदनेश िसह मेरे ्षारा भुगतान की गयी धनरािश से ्िक इत्यािद खरीट कर दुगार्पुर पि्ाम बंगाल में ्िान्सपोटर् कम्पनी चलाते है पैसाने मांगने पर मुझे धमकाते हैं। उ्व सभी पांचो लोग ्षाम म़ावा लमही, पाण्डेयपुर वाराणसी अपने भवन में िनवास करते है। सभी लोगों ने अपना मोबाईल बंद रखा है या नं० बदल िदया है अभी अतुल िसह का नया मोबाईल नं0 9093746216 जो अभी पता चला है िक चालू है। आप से न्ा िनवेदन है िक उपरो्व िबन्दुओं को सं्ञान में लेते हुए, ्शी िदनेश िसह िनवासी ्षाम म़ाया लमही पाण्डेयपुर वाराणसी ्शीमती पदमा िसह (पत्नी िदनेश िसह), पंकज िसह, अतुल िसह (पु्ऴगण िदनेश िसह) एवं ्शीमती रंजना िसह (पत्नी पंकज िसह) िजन्होंने मेरे साथ संगिठत अपराध/सािजश, डकै ती, 5 A482 No. 16026 of 2020 धोखाधड़ी एवं लूट के तहत मुझे ्ऺतािड़त िकया, उ्व पांचो लोगों के िखलाफ आई०पी०सी० धारा के तहत एफ० आई० आर० दजर् कराया हूँ। तत्प्ाात वादी मुकदमा को साथ लेकर घटनास्थल पर आया हूँ जहां पर वादी मुकदमा की िनशानदेही पर िनरी्षण घटनास्थल िकया गया तो पूवर् िववेचक ्षारा बनाया गया नक्शा नजरी बिलहाज मौका दुरुस्त पाया गया।"

Considering the arguments raised by learned counsel for the parties and on perusal of contents of FIR and statement of witnesses recorded under Section 161 Cr.P.C. wherein allegations are alleged against the Pankaj Singh and Dinesh Singh. There is no substantive material to prosecute the applicants under the aforesaid sections. There is no whisper in the contents of FIR and statement recorded under Section 161 Cr.P.C. that applicants took money from the informant or promise the informant to execute the sale deed. From the record it appears that the applicant no.1 Smt. Padma Singh is wife of co-accused Dinesh Singh and Applicant no.2-Atul Singh is the son of co-accused Dinesh Singh have been implicated due to wife and son of the co-accused Dinesh Singh.

7. Considering the facts and circumstances of the case, the proceedings against the applicants under the aforesaid sections are not supported by any material evidence and liable to be set aside.

Accordingly, the Case No.8830 of 2020, (State versus Dinesh Singh and others), arising out of Case Crime No.591 of 2019, under Sections 420, 406, 506 IPC, Police Station Shivpur, District Varanasi, pending in the Court of VIth ACJM, Varanasi as well as charge sheet dated 07.06.2020 are hereby quashed.

06.05.2016 को खरीदा था। उसको पंकज िसह पु्ऴ िदनेश िसह बेचना चाहते थे, मुझे जानकारी होने पर मैनें पकं ज िसह पु्ऴ िदनेश िसह से सम्पकर् िकया। उ्व फ्लैट को रुपया अस्सी लाख स्तर हजार रुपया (रु०8070000/-) में बेचने का सौदा िदनेश िसह, िदनेश िसह की पत्नी पदमा िसह, पंकज िसह एवं अतुल िसह (पंकज िसह का छोटा भाई) पु्ऴगण िदनेश िसह एवं ्शीमती रंजना िसह (पत्नी पंकज िसह) का सभी की सहमित से बेचना तय हुआ। उन लोगो ्षारा कहा गया िक पैसा रुपया अस्सी लाख स्तर हजार भुगतान के बाद मैं उ्व फ्लैट को आप के नाम से रिजस््िी कर दूंगाँ। मैंने िदनेश से, पंकज िसह, अतुल िसह (पु्ऴगण िदनेश िसह), ्शीमती पदमा िसह (पत्नी िदनेश िसह) के मजर् से एवं रंजना िसह पत्नी पंकज िसह सभी के सहमत के अनुसार उनके घर (्षाम-म़ावा, लमही पाण्डेयपुर वाराणसी) में रुपया तीस 3 A482 No. 16026 of 2020 लाख नगद एवं रुपया पचास लाख स्तर हजार चेक ्षारा सबके सामने मेरे ्षारा भुगतान िकया गया उन सभी ने कहा की कु छ िदन में रिजस््िी कर दुगों। मैने कहा की िलखा प़ाी कु छ हो जाए तो िदनेश िसह ने अपने पु्ऴ पंकज िसह से तीन चेक (भूपेन््श िसह के नाम) िजसकी कीमत रुपया अस्सी लाख स्तर हजार थी मुझे दे िदया और कहा की रिजस््िी के बाद यह चेक आप को मुझे वापस कर देना पड़ेगा। उ्व बातों से सहमत उ्व सभी पांचो लोग थे। परन्तु बाद में उ्व फ्लैट को अन्य ्िि्व को बेच िदया, जब मैंने उन्हे यह बात कही तो उन्होंने कहा अपना पैसा िदये गये चेक से ले लो। परन्तु चेक बैंक में भुगतान हेतु लगाने के बाद पता चला िक बैंक से उ्व चेक का भुगतान रोक (स्टाप) कर िदया गया है। इस तरह मेरे साथ संगिठत अपराध के तहत सािजस की गयी। संगिठत अपराध/सािजस में िदनेश िसह िनवासी (्षाम)-मा़वा लमही पाण्डेयपुर वाराणसी) थाना कै ण्ट वाराणसी, ्शीमती पदमा िसह (पत्नी िदनेश िसह), पंकज िसह, अतुल िसह (पु्ऴ िदनेश िसह) एवं ्शीमती रंजना िसह पत्नी (पत्नी पंकज िसह) सभी पांचों लोग शािमल थे मेरे पैसे की डकै ती डाल, लूट, धोखाधड़ी एवं सगिठत अपराध/सािजस कर मुझे कं गाल कर िदया गया। बाद में सू्ऴों से पता चला िक पंकज एवं अतुल िसह पु्ऴगण िदनेश िसह मेरे ्षारा भुगतान की गयी धनरािश से ्िक इत्यािद खरीद कर दुगार्पुर पि्ाम बंगाल में ्िांस्पोटर् कम्पनी चलाते है पैसा मागने पर मुझे धमकाते हैं। उ्व सभी पांचो लोग ्षाम म़ावा लमही, पाण्डेयपुर वाराणसी अपने भवन में िनवास करते है। सभी लोगो ने अपना मोबाईल बंद रखा है या नं० बदल िदया है अभी अतुल िसह का नया मोबाईल नं0 9093746216 ओ, अभी पता चला है िक चालू है। आप से न्ा िनवेदन है िक उपरो्व िबन्दुओं को सं्ञान में लेते हुए, ्शी िदनेश िसह िनवासी ्षाम म़ावा लमही पाण्डेयपुर वाराणसी, ्शीमती पदमा िसह (पत्नी िदनेश िसह), पंकज िसह, अतुल िसह (पु्ऴगण िदनेश िसह) एवं ्शीमती रंजना िसह (पत्नी पंकज िसह) िजन्होंने मेरे साथ संगिठत अपराध/सािजस, डकै ती, धोखाधड़ी एवं लूट के तहत मुझे ्ऺतािड़त िकया, उ्व पांचो लोगों के िखलाफ आई०पी०सी० धारा के तहत एफ०आई०आर० दजर् कर मेरे ्षारा भुगतान की गयी धनरािश वापस कराने एवं मेरे साथ न्याय िदलाने की कृ पा करें। िदनांक 23/09/2019 भवदीय SD भूपेन््श िसह (भूपेन््श िसह) दुगार् कम्प्लेक्स िशवपुर वाराणसी-22100 नोट- मैं का०मु० राजेश कु मार ्ऺमािणत करता हूँ मेरे ्षारा तहरीर की कायमी व धारा का अंकन कर सीसीटीएनएस पर का० देवेन््श कु मार से अ्षरश िकता कराया गया। नोट में का0मु0 620 अरिबन्द कु मार यादव ्ऺामिणत करता हूं थाना कैं ट जनपद वाराणसी पर पंजीकृ त 1250/ 2019 स्थानान्तिरत होकर थाना िशवपुर वाराणसी पर कायमी मेरे ्षारा थाना िशवपुर वाराणसी कराया ।"

5. Per contra, learned counsel for the informant vehemently opposed the submission raised by learned counsel for the applicants and submitted that applicant no.1 Smt. Padma Singh is wife of co-accused Dinesh Singh who had promised to execute sale deed in favour of the informant but after taking money i.e. amount of Rs.80,70,000/- from the informant he had not executed sale deed. Since beginning intention of the co-accused Dinesh Singh to cheat the informant and grab the money. Applicants along-with other co-accused took money with intention to cheat, subsequently has cancelled sale deed. Applicant No.1 with the intention to take away from judicial custody as well as escaping from attachment of his property executed a will in favour of his 4 A482 No. 16026 of 2020 elder son, Atul Singh (applicant no.2). Learned counsel for the informant further submitted that proceeding under Section 138 N.I. Act is pending against the co-accused Pankaj Singh and applicants, have criminal history which has been explained in paragraph no.16 of the counter affidavit. Prima- facie offence is made out. Statement of informant recorded under Section 161 Cr.P.C. is being reproduced below :- "बयान मुकदमा वादी: भूपेन््श िसह पु्ऴ िशवभ्श िनवासी दुगार् कामप्लेक्स थाना िशवपुर वाराणसी उ्ा करीब 65 वषर् मो0नं0 9956529209 बदिरयाफ्त पूछने पर बता रहे हैं िक मैने एक फ्लैट आराजी नं. 695/4 प्लाट नं0 51 रकबा 1560 वगर् फीट (वन प्लेस ्षुप में िस्थत) मौजा लालपुर, मीरापुर बसही परगना िशवपुर वाराणसी, जो ्शीमती रंजना िसह पत्नी ्शी पंकज िसह के नाम पर िदनाक 06.05.2016 को खरीदा गया था। उसको पंकज िसह पु्ऴ िदनेश िसह बेचना चाहते थे, इस बात की मुझे जानकारी होने पर मैनें पंकज िसह पु्ऴ िदनेश िसह से सम्पकर् िकया। उ्व फ्लैट को रुपया अस्सी लाख स्तर हजार रुपया (रु0 8070000/-) में बेचने की बातचीत िदनेश िसह, िदनेश िसह की पत्नी पदमा िसह, पंकज िसह एवं अतुल िसह (पंकज िसह का छोटा भाई) पु्ऴगण िदनेश िसह एवं ्शीमती रंजना िसह (पत्नी पंकज िसह) का सभी की सहमित से बेचना तय हुआ। उन लोगों ्षारा कहा गया िक पैसा रुपया अस्सी लाख स्तर हजार भुगतान के बाद मैं उ्व फ्लैट को आप के नाम से रिजस््िी कर दी जायेगा। सभी के सहमती के अनुसार उनके घर (्षाम म़ॿवा, लमही, पाण्डेयपुर वाराणसी) में रुपया तीस लाख नगद एवं रुपया पचास लाख स्तर हजार चेक ्षारा सबके सामने मेरे ्षारा भुगतान िकया गया उन सभी ने कहा की कु छ िदन में रिजस््िी कर िदया जायेगा तथा मेरे पैसे के गारण्टी के एवज िदनेश िसह ने अपने पु्ऴ पंकज िसह से तीन चेक मेरे नाम िदया िजसकी कीमत रुपया अस्सी लाख स्तर हजार थी मुझे दें िदया और कहा की रिजस््िी के बाद यह चेक आपको मुझे वापस कर देना पड़ेगा। उ्व बातों से सहमत उ्व सभी पांचों लोग थे। परन्तु बाद में उ्व फ्लैट को अन्य ्िि्व को बेच िदया, जब मैने उन्हें यह बात कही तो उन्होंने कहा अपना पैसा िदये गये चेक से ले लो। परन्तु चेक बैंक में भुगतान हेतु लगाने के बाद पता चला िक बैंक से उ्व चेक का भुगतान रोक िदया गया है। इस तरह मेरे साथ संगिठत अपराध के तहत सािजस की गयी। संगिठत अपराध/सािजस में िदनेश िसह िनवासी (पाण्डेयपुर, म़ावा लमही पाण्डेयपुर वाराणसी) थाना कै ण्ट वाराणसी, ्शीमती पदमा िसह (पत्नी िदनेश िसह), पंकज िसह, अतुल िसह (पु्ऴ िदनेश िसह) एवं ्शीमती रंजना िसह पत्नी (पत्नी पंकज िसह) सभी पांचों लोग सािमल थे मेरे पैसे की डकै ती डाल, लूट, धोखाधड़ी एवं संगिठत अपराध/सािजस कर मुझे कं गाल कर िदया गया। बाद में सू्ऴों से पता चला िक पंकज एवं अतुल िसह पु्ऴगण िदनेश िसह मेरे ्षारा भुगतान की गयी धनरािश से ्िक इत्यािद खरीट कर दुगार्पुर पि्ाम बंगाल में ्िान्सपोटर् कम्पनी चलाते है पैसाने मांगने पर मुझे धमकाते हैं। उ्व सभी पांचो लोग ्षाम म़ावा लमही, पाण्डेयपुर वाराणसी अपने भवन में िनवास करते है। सभी लोगों ने अपना मोबाईल बंद रखा है या नं० बदल िदया है अभी अतुल िसह का नया मोबाईल नं0 9093746216 जो अभी पता चला है िक चालू है। आप से न्ा िनवेदन है िक उपरो्व िबन्दुओं को सं्ञान में लेते हुए, ्शी िदनेश िसह िनवासी ्षाम म़ाया लमही पाण्डेयपुर वाराणसी ्शीमती पदमा िसह (पत्नी िदनेश िसह), पंकज िसह, अतुल िसह (पु्ऴगण िदनेश िसह) एवं ्शीमती रंजना िसह (पत्नी पंकज िसह) िजन्होंने मेरे साथ संगिठत अपराध/सािजश, डकै ती, 5 A482 No. 16026 of 2020 धोखाधड़ी एवं लूट के तहत मुझे ्ऺतािड़त िकया, उ्व पांचो लोगों के िखलाफ आई०पी०सी० धारा के तहत एफ० आई० आर० दजर् कराया हूँ। तत्प्ाात वादी मुकदमा को साथ लेकर घटनास्थल पर आया हूँ जहां पर वादी मुकदमा की िनशानदेही पर िनरी्षण घटनास्थल िकया गया तो पूवर् िववेचक ्षारा बनाया गया नक्शा नजरी बिलहाज मौका दुरुस्त पाया गया।"

Considering the arguments raised by learned counsel for the parties and on perusal of contents of FIR and statement of witnesses recorded under Section 161 Cr.P.C. wherein allegations are alleged against the Pankaj Singh and Dinesh Singh. There is no substantive material to prosecute the applicants under the aforesaid sections. There is no whisper in the contents of FIR and statement recorded under Section 161 Cr.P.C. that applicants took money from the informant or promise the informant to execute the sale deed. From the record it appears that the applicant no.1 Smt. Padma Singh is wife of co-accused Dinesh Singh and Applicant no.2-Atul Singh is the son of co-accused Dinesh Singh have been implicated due to wife and son of the co-accused Dinesh Singh.

7. Considering the facts and circumstances of the case, the proceedings against the applicants under the aforesaid sections are not supported by any material evidence and liable to be set aside.

Accordingly, the Case No.8830 of 2020, (State versus Dinesh Singh and others), arising out of Case Crime No.591 of 2019, under Sections 420, 406, 506 IPC, Police Station Shivpur, District Varanasi, pending in the Court of VIth ACJM, Varanasi as well as charge sheet dated 07.06.2020 are hereby quashed.
