This application under Article 227 of the Constitution of India has been filed for a direction that the suit being Civil Suit No.1161 of 2011 (new No.4375 of 2017) (Prabhunath Prasad & Ors. vs. Smt. Vimla Prasad & Ors.) be decided expeditiously within a stipulated period of time. It has been stated by learned counsel for the petitioners that issues have been framed on 28.11.2015. Under such circumstances, without going into the merits of the case and without issuing notices to the opposite parties, a direction is being issued that if there are miscellaneous applications pending in the suit, the same be decided within a period of one month from the date of presentation of a certified copy of this order and thereafter after hearing the parties concerned and allowing them to lead evidence, the suit itself be decided within a period of six months. It may be noted that adjournment shall be granted only under very pressing circumstances and after imposing a cost of Rs.2000/- on the party seeking adjournment.
