This writ petition has been filed with the following prayer: "I. issue order or direction to the civil Judge (Jr division) nagina Bijnor to decide the temporary injunction application in the original suit number 1090 of 2024 Liyakat Hussain versus Sayyad Hussain and others within such time as may be fixed by the honourable court. II. issue order or direction to the parties of the suit to maintain status quo with regard to the nature and possession of the land in dispute during the pendency of the original suit number 1090 of 2024 Liyakat Hussain versus Sayyad Hussain and others. III. issue order or direction to the civil Judge (Jr division) nagina Bijnor to decide the objection dated 8/10th/2024 under section 47 in execution case number 5/2009 Sayyad Ali Haidar versus Mohd Hanif." The prayer nos.II and III, made in the writ petition, cannot be granted to the petitioner and the same is declined. However, the temporary injunction application is said to be pending in Suit No.1090 of 2024. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Civil Judge (Junior Division), Nagina, Bijnor to decide the temporary injunction application filed in Suit No. 1090 of 2024 (Liyakat Hussain vs. Sayyad Hussain and others), in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
