3. Learned counsel for the petitioner has relied upon Government Order issued in this regard on 18.03.2024. Accordingly this Court on 11.03.2024 directed the learned Standing Counsel to obtain instruction in the matter by passing following order: "1. The contention advanced on behalf of the petitioner is that in respect of those Rozgar Sevak who died in harness after Covid-2019, the guidelines issued by the Central Government as well as the State Government for offering appointment to the dependents are not being followed in terms of the Government Order dated 18.03.2024 whereas in other districts these guidelines are being followed.

2. In respect of submission so advanced, learned counsel for the petitioner has drawn the attention of the Court to the letter issued by the C.D.O. Sravasti dated 20.01.2025 whereby the dependents of the deceased Rozgar Sewak has been offered appointment.

3. Let the District Magistrate/District Programme Coordinator, MNREGA, District Maharajganj file a detailed afÏdavit meeting the points raised in this petition specially discrimination in the matters of compassionate appointment of dependents of the deceased Rozgar Sevak on the next date fixed failing which, the District Magistrate/District Programme Coordinator, MNREGA, District Maharajganj shall appear in person before this Court.

Gram Rozgar Sewak, Sangh has approached this Court for a direction in general to all the districts for complying with the Government Order dated 18.03.2024 which provides for claim of the dependents of deceased Rozgar Sewak for relevant compassionate appointment. In this petition it has been claimed that Chief Development OfÏcer, Sravasti has passed order on 20.01.2025 giving compassionate appointment to the dependent of the deceased as Gram Rozgar Sewak in his district. Interestingly, in the personal afÏdavit filed by the District Magistrate, Maharajganj it has come to be averred vide Paragraph 6 that in absence of guidelines and in absence of any specific direction issued to the district authorities for giving compassionate appointment in terms of the Government Order dated 18.03.2024 no such appointments are being considered in his district Maharajganj. Paragraph-6 has been reproduced hereunder: "6. That the aforesaid letter is a communication between the Secretary, U.P. Government and the Commissioner, Rural Development, U.P. No further guidelines/direction have been issued to the District Authorities till date with respect of appointment to the dependants of those who died in harness other than/except COVID-19. Hence, no action has been taken at the end of the Deponent in this regard. If any such guidelines/directions is issued in this respect by the Commissioner, Rural Development, U.P. to the District Authorities then the same shall be complied with." Maharajganj.

The Court is not satisfied with the explanation offered vide paragraph-6 of the personal afÏdavit of District Magistrate, Once the Government has issued a Government Order providing for compassionate appointment to the dependants of the deceased Rozgar Sevak, every district has to comply with the same. As far as the guidelines are concerned, in absence of any Rule or Regulation framed in that regard in such districts, the eligibility criteria laid down in the U.P. Recruitment of Dependants of Government Servants Dying in Harness Rules, 1974 as amended from time to time, may be followed. And hence, I direct the District Magistrate, Maharajganj to issue direction to Subordinate OfÏcers and then communicate this order to the Chief Development OfÏcer of the district to comply with the Government Order dated 18.03.2024 applying the principles as contained in 1974 rules in so far as definition of dependents and other eligibility criteria are concerned.

I further issue directions to the Secretary, Gram Vikas, Government of U.P., Lucknow and also the Commissioner, Village Development Department, Lucknow to issue necessary guidelines and directions so as to ensure that the Government Order dated 11.03.2024 is complied in its letter and spirit in all the districts of Uttar Pradesh.

It is expected both from the State Government as well as from those who are looking after such appointments in districts that dependants of the Gram Rozgar Sevak are offered compassionate appointment further by the concerned Gram Panchayats considering the immediacy of such applicants for the affected families where the sole earning member has died. It is directed accordingly that as and when the applications for compassionate appointment are filed by the dependants, the same sahll be disposed of within a maximum period of 2-3 months without any undue delay in the light of the observations made hereinabove.

I further issue directions to the Secretary, Gram Vikas, Government of U.P., Lucknow and also the Commissioner, Village Development Department, Lucknow to issue necessary guidelines and directions so as to ensure that the Government Order dated 11.03.2024 is complied in its letter and spirit in all the districts of Uttar Pradesh.

It is expected both from the State Government as well as from those who are looking after such appointments in districts that dependants of the Gram Rozgar Sevak are offered compassionate appointment further by the concerned Gram Panchayats considering the immediacy of such applicants for the affected families where the sole earning member has died. It is directed accordingly that as and when the applications for compassionate appointment are filed by the dependants, the same sahll be disposed of within a maximum period of 2-3 months without any undue delay in the light of the observations made hereinabove.
