3. Heard Mr. Ayub Khan, learned counsel for the petitioners, Mr. Rahul Mishra, learned counsel for respondent nos.3 & 4, Mr. Om Anand, learned Standing Counsel for the State-respondents and Mr. Sunil Kumar Singh, learned counsel for the Gaon Sabha.
4. Brief facts of the case are that the petitioners are chak holder no.235 and original holding of the petitioners are plot nos.2038/15, 2038/17, 2418, 2419/1 & 2419/3 total area 1.9645 hectares. Assistant Consolidation Officer proposed two chaks to the petitioners, first chak of plot no.2038/17 etc. and second chak on plot no.2038/38 including plot no.2419/3 etc. Petitioners were satisfied with the proposal made by the Assistant Consolidation Officer. Some tenure holders of the village filed chak objection before the Consolidation Officer which were decided by the Consolidation Officer vide order dated 22.12.2006 but no amendment was made in the chak of the petitioners. One Smt. Shanti Devi (chak holder no.988) also filed a chak objection before the Consolidation Officer which was decided vide order dated 4.11.2015, Smt. Shanti Devi filed a chak appeal against the order dated 4.11.2015 which was decided vide order dated 30.6.2017. Respondent nos.3 & 4 (Promod Kumar and Arvind Kumar) are claiming right on the basis of sale deed executed in their favour by Smt. Shanti Devi accordingly, filed a revision under Section 48 of U.P.C.H. Act against the order dated 30.6.2017 along with the prayer for condonation of delay. The aforementioned revision was registered as Revision No.139/23. Deputy Director of Consolidation vide order dated 24.7.2024 dismissed the aforementioned revision and maintained the appellate order dated 30.6.2017. Against the order dated 24.7.2024, respondent nos.3 & 4 filed a restoration application dated 3.12.2024 along with the application under Section 5 of Limitation Act. Respondent no.2/ Additional District Magistrate (Finance & Revenue) vide order dated 29.1.2025 decided the restoration application dated 3.12.2024 in ex-parte manner as well as disturbed the petitioners' chak taking out plot no.2419/3 from the petitioners' chak and allotted him udan chak from the bachat land, hence this writ petition for the following reliefs: "issue a writ order or direction in the nature of certiorari quashing the impugned order dated 29.1.2025 passed by learned Deputy Director of Consolidation, Bhagpat/ Additional District Magistrate (F/R)/ respondent no.02 Computerized Case No.20245411800000181 (Arvind Kumar Vs. Krishn Pal & Others), under Section 48 (1) of U.P.C.H. Act vide (Annexure No.01 to the writ petition). " in Revision No.RST/0181/2024,

Learned counsel for the petitioners submitted that the chak revision filed by respondent nos.3 & 4 has been decided in arbitrary manner disturbing the petitioners' chak which was proposed to him and maintained up to Settlement Officer of Consolidation stage. He further submitted that the plot no.2419/3 is original road side plot of the petitioners and the same has been taken away from the chak of the petitioners at the revisional stage by the Deputy Director of Consolidation. He further submitted that the impugned revisional order should be set aside and the stage of Settlement Officer of Consolidation should be maintained.

On the other hand, Mr. Rahul Mishra , learned counsel for respondent nos.3 & 4 submitted that the plot no.2192 is original road side plot of contesting respondent nos.3 & 4, as such, petitioners cannot be allotted chak over plot no.2192. He further submitted that Deputy Director of Consolidation while passing the impugned order has adjusted both the parties to the road side plot as far as possible. He placed the finding of fact recorded by the Deputy Director of Consolidation while deciding the revision under Section 48 of U.P.C.H. Act in order to demonstrate that both parties have been adjusted in accordance with the provisions of U.P.C.H. Act. He further submitted that no interference is required against the impugned revisional order passed in the allotment of chak proceeding.
7. I have considered the argument advanced by learned counsel for the parties and perused the records.
8. There is no dispute about the fact that the allotment of chak proceeding has been decided by the Deputy Director of Consolidation under the impugned order dated 29.1.2025.

In order to appreciate the controversy involved in the matter, perusal of the finding recorded by the Deputy Director of Consolidation while passing the impugned order will be relevant which is as under: न्ययाययालययः उप ससंचयालक चकबन्दद मण्डलयः ममेरठ, जनपदयःबयागपत, तहसदलयः बडडौत RST वयाद ससंख्ययायः- /0181/2024 कम्प्ययटरदककत वयाद ससंख्ययायः- 20245411800000181 अरववन््ቖ ककमयार बनयाम ककष्णपयाल आवद असंतगरत धयारयायः-48(1), अधधवनमययः- उ०्ቚ० जजोत चकबन्दद अधधवनयम, 1953 मडौजया बयामनडौलद परगनया बरनयावया तहसदल बडडौत। वनणरय ससंबसंधधत अवभिलमेखोመ कमे अवलजोकन समे स्प्ቖ हहै वक चक ससंख्यया-988 बमेदय पक्ቔ मयसंगया वनवयासद गयाम कमे नयाम असंवकत हहै, धजसमे सहयायक चकबन्दद अधधकयारद स्तर पर गयाटया ससंख्यया-1892, 1893 1894 1895 1897 पर चक ्ቚवद्ቖ वकयया गयया हहै। उ्ሹ चक मम अपदलदय न्ययाययालय दयारया ससंशजोधन करतमे हहयमे चक ससंख्यया-988 समे गयाटया ससंख्यया-1892 आवद 'वनकयालकर गयाटया ससंख्यया-2697, 2701 पर चक ्ቚवद्ቖ वकयया गयया, धजनककी मकत्यक कमे उपरयान्त सहयायक चकबन्दद अधधकयारद दयारया वदनयासंक 29.09.2008 कजो नयामयान्तरण आदमेश पयाररत करतमे हहयमे उनकमे स्थयान पर अवभिलमेखोመ मम उनकमे जयायज वयाररस ससंजय ककमयार, बब्लय ककमयार, मककमेश ककमयार, ददपक ककमयार व मजोनय ककमयार पक्ቔगण बमेटय कया नयाम अवभिलमेखोመ मम दजर वकयया गयया हहै। बमेटय कमे उपरजो्ሹ वयाररसोመ समे शदमतद शयासंवत दमेवद दयारया वदनयासंक 29.08.2014 कजो चक ससंख्यया-988 ककी भियवम ्ቅय ककी गयद तथया शदमतद शयासंवत दमेवद समे चकदयार चक ससंख्यया-988 समे वनगरयानदकतयार शद ्ቚमजोद ककमयार एवसं अरववन््ቖ ककमयार दयारया भियवम ्ቅय ककी गयद हहै, धजसकया नयामयान्तरण आदमेश अवभिलमेखोመ मम हजो चककया हहै। इस सस्थवत मम ्ቚश्नगत वयाद मम शद अरववन््ቖ ककमयार व ्ቚमजोद ककमयार कया वहत-वनवहत हजो गयया। सहयायक चकबन्दद अधधकयारद दयारया अनकसयार बहैनयामया नयामयान्तरण आदमेश वदनयासंक 23.02.2017 पयाररत करतमे हहयमे गयाटया ससंख्यया-2191 2192 2193 समे वव्ቅमेतया शदमतद शयासंवतदमेवद कया नयाम वनरस्त कर वनगरयानदकतयार शद ्ቚमजोद ककमयार व अरववन्द ककमयार कया नयाम अवभिलमेखोመ मम दजर वकयया गयया हहै। शद ्ቚमजोद ककमयार व अरववन्द ककमयार दयारया ्ቚश्नगत भियवम कया बहैनयामया अपदलदय न्ययाययालय कमे आदमेश वदनयासंक 09.06.2016 कमे अनकसयार अपनमे हक मम वनस्पयावदत करयायया गयया हहै, वकन्तक अपदलदय न्ययाययालय दयारया शद अरववन्द ककमयार आवद कजो सकनवयाई कया अवसर वदयमे बगहैर आदमेश वदनयासंक 30.06.2017 पयाररत करतमे हहयमे वनगरयानदकतयार कया चक हवयाई ्ቚवद्ቖ कर वदयया गयया हहै, जजो उवचत नहीሻ हहै। ववपकद ससंख्यया-01 कमे चक ससंख्यया-235 कमे अवलजोकन समे स्प्ቖ हहै वक ववपकद कमे मयलजजोत कमे गयाटया मख्यया-2038/15 /17, 2418, 2419/1/3 ककल रकबया 1.9645 हमे0 हहै, धजसकमे सयापमेक ववपकद कया ्ቚथम चक गयाटया ससंख्यया-2038/17.2419 व वदतदय चक गयाटया ससंख्यया-2038/3, 2489, 2192, 2192 व 2419/3 पर ्ቚवद्ቖ वकयया गयया हहै। इससमे स्प्ቖ हहै वक ववपकद ससंख्यया - 01 कजो वनगरयानदकतयार कमे मयलजजोत कमे गयाटया ससंख्यया-2192 पर हवयाई चक ्ቚवद्ቖ वकयया गयया हहै। ववपकद कमे मयलजजोत कमे गयाटया ससंख्यया -2038/15/17 कमे समदप गयाटया ससंख्यया- 2038/25/26 पर बचत असंवकत हहै। यवद वनगरयानदकतयारगण उनककी मयासंग कमे अनकसयार उनककी मयलजजोत कमे गयाटया ससंख्यया- 2192 आवद कजो लमेकर एवसं ववपकदगण "ससंख्यया -01 कया चक उनककी मयलजजोत कमे गयाटया ससंख्यया-2038/15/17 कजो लमेतमे हहयमे गयाटया ससंख्यया -2038 /25/26 पर ्ቚवद्ቖ वकयया जयातया हहै , तजो ववपकद कजो कजोई हयावन नहीሻ हजोगद। वनगरयानदकतयारगण व ववपकदगण ससंख्यया-01 कमे चक मयलजजोत कमे गयाटोመ कजो लमेकर सकववधयानकसयार एवसं जजोत चकबन्दद अधधवनयम मम दद गयद व्यवस्थयाओसं कमे अनकसयार ्ቚवद्ቖ हजो जयायमगमे। वनगरयानदकतयार कमे मयलजजोत कमे गयाटमे सडक समे सटमे हहयमे हह, धजसकमे सम्बन्ध मम मया० उच्च न्ययाययालय इलयाहयाबयाद दयारया ययावचकया ससंख्यया -18820/2001 रयाम्ቚसयाद बनयाम उप ससंचयालक चकबन्दद इलयाहयाबयाद व अन्य मम पयाररत आदमेश वदनयासंक 19.01.2006 मम न्ययाय वनणरय वदयया गयया हहै वक सडक अथवया मकख्यमयागर समे लगमे भियखण्डोመ कजो चक बयाहर कर वदयया जयानया चयावहए। उ्ሹ व्यवस्थया उ्ቈर ्ቚदमेश जजोत चकबन्दद अधधवनयम 1953 धयारया 8-क-धसदयान्तोመ कया वववरण-मकख्य सडक, रयाजमयागर आवद समे लगमे भियखण्डोመ कया चक बयाहर वकयया जयानया-वदनयासंक 26 मई 1981 कजो अधधसयचनया जयारद-चक आवसंटन कमे सम्बन्ध मम वनयत वकयमे गयमे धसदयान्तोመ कया उलसंघन करतमे हहयमे धसदयान्तोመ कया वववरण तहैययार वकयया गयया हहै-सडक व रयाजमयागर समे लगमे भियखण्डोመ कया मयल्ययासंकन वकयया गयया और उन्हम वकसद पर-व्यव्ሹ कजो आवसंवटत कर वदयया गयया-धयाररत वकयया गयया हहै वक सडक समे लगद हहई भियवम कया मयल्ययासंकन नहीሻ वकयया जयानया चयावहए थया. और यवद वकयया हद गयया हहै तजो उसमे मयल खयातमेदयार कजो हद आवसंवटत वकयया जयानया चयावहए थया- धसदयान्तोመ कया उलसंघन कर वदयया गयया। आवसंटन मयान्य नहीሻ वकयया जया सकतया। गयाम बयामनडौलद कमे सम्बन्ध मम उच्च स्तर समे भिद जयासंच उपरयान्त जयासंच मम यह तथ्य जयासंच कममेटद कमे सम्मकख ्ቚकयाश मम आयया हहै वक चकबन्दद ्ቚयाववधयानोመ कया उलसंघन करतमे हहयमे बडडौत समे मकजफ्फरनगर रजोड समे ससंल्ሿ गयाटया कया वववनमय अनकपयात वनधयारररत कर उसपर उडयान चक बनयायमे गयमे हह , उ्ሹ अवनयवमततयाओसं कजो दयर करनमे हमेतक चकबन्दद वनदमेशयालय कमे दयारया अपनमे कयाययारलय कमे प्ቔ ससंख्यया -793/वव०्ቚ०- सया० वदनयासंक 09.01.2018 कमे दयारया वनदरश वनगरत वकयमे गयमे हह। उपरजो्ሹ वववमेचनया कमे आधयार पर स्प्ቖ हहै वक वनगरयानदकतयारगण कमे मयलजजोत कमे गयाटया सडक समे सटमे हहयमे हह, धजन्हमे बन्दजोबस्त अधधकयारद चकबन्दद स्तर पर हवयाई चक ्ቚवद्ቖ कर वदयया गयया हहै तथया ववपकदगण ससंख्यया-01 कजो वनगरयानदकतयारगण कमे मयलजजोत कमे गयाटोመ पर हवयाई चक ्ቚवद्ቖ वकयया गयया हहै, इसधलए वनगरयानदकतयारगण ककी मयासंग पजोषणदय हजोनमे कमे कयारण स्वदकयार हजोनमे यजोग्य हहै। अतयः आदमेश हहआ हहआ वकयः- आदमेश उपरजो्ሹ वववमेचनया कमे आधयार पर शद ्ቚमजोद ककमयार पक्ቔ सकखवदर धससंह व शद अरववन््ቖ ककमयार पक्ቔ श्ययाम धससंह वनवयासदगण गयाम बयामनडौलद परगनया बरनयावया तहसदल बडडौत धजलया बयागपत दयारया ्ቚस्तकत वनगरयानद स्वदकयार ककी जयातद हहै। ममेरमे दयारया तहैययार करयायद गयद चक ससंशजोधन तयाधलकया धजससमे मडौजया बयामनडौलद कमे जजोत चकबन्दद आकयार प्ቔ-23 भियाग-1 कमे चक ससंख्यया- 988, 235 व बचत ्ቚभियाववत हजोतमे हह, स्वदककत ककी जयातद हहै। स्वदककत ससंशजोधन तयाधलकया आदमेश कया असंग जयारद रहमेगद, तदयानकसयार भियवच्ቔ ससंशजोधधत हजो। प्ቔयावलद बयाद आवश्यक कयायरवयाहद दयाधखल दफ्तर हजो । वदनयासंक--29.01.2025 /Sd Illegible अपर धजलयाधधकयारद (वव/रया०)/ उप ससंचयालक चकबन्दद, बगपत ।
10. Perusal of the finding of fact recorded by Deputy Director of Consolidation as well as C.H. Form 23 of the petitioners along with Smt. Shanti Devi it is demonstrated that plot no.2419 /3 is original road side plot of the petitioners and plot no.2192 is original road side plot of Smt. Shanti Devi (Chak holder no.988) from whom respondent nos.3 & 4 are claiming right.

Petitioners has been adjusted on the road side plot of the private respondents and private respondents have been adjusted on the road side plot of the petitioners under the impugned revisional order in order to accommodate both parties to the road side plot. Petitioners are not satisfied with the order impugned as petitioners has been deprived from his original road side plot no.2419/3, as such, fresh consideration of the chak revision is required by Deputy Director of Consolidation in the matter.

Considering the entire facts and circumstances of the case, the impugned revisional order dated 29.1.2025 passed by Deputy Director of Consolidation in Revision No.RST/0181/2024, Computerized Case No.20245411800000181 (Arvind Kumar Vs. Krishn Pal & Others), under Section 48 (1) of U.P.C.H. Act is liable to be set aside and the same is hereby set aside.

The writ petition stands allowed in part and matter is remitted back before respondent no.2/ Deputy Director of Consolidation to decide the aforementioned revision afresh after affording proper opportunity of hearing to the parties, expeditiously preferably within a period of three months from the date of production of certified copy of this order before Deputy Director of Consolidation. It is clarified that the original road side plot no.2419/3 belonging to the petitioners should be allotted in the chak of the petitioners and the original road side plot no.2192 belonging to respondent nos.3 & 4 should be allotted in the chak of respondent nos.3 & 4 while deciding the aforementioned revision as directed above. In order to appreciate the controversy involved in the matter, perusal of the finding recorded by the Deputy Director of Consolidation while passing the impugned order will be relevant which is as under: न्ययाययालययः उप ससंचयालक चकबन्दद मण्डलयः ममेरठ, जनपदयःबयागपत, तहसदलयः बडडौत RST वयाद ससंख्ययायः- /0181/2024 कम्प्ययटरदककत वयाद ससंख्ययायः- 20245411800000181 अरववन््ቖ ककमयार बनयाम ककष्णपयाल आवद असंतगरत धयारयायः-48(1), अधधवनमययः- उ०्ቚ० जजोत चकबन्दद अधधवनयम, 1953 मडौजया बयामनडौलद परगनया बरनयावया तहसदल बडडौत। वनणरय ससंबसंधधत अवभिलमेखोመ कमे अवलजोकन समे स्प्ቖ हहै वक चक ससंख्यया-988 बमेदय पक्ቔ मयसंगया वनवयासद गयाम कमे नयाम असंवकत हहै, धजसमे सहयायक चकबन्दद अधधकयारद स्तर पर गयाटया ससंख्यया-1892, 1893 1894 1895 1897 पर चक ्ቚवद्ቖ वकयया गयया हहै। उ्ሹ चक मम अपदलदय न्ययाययालय दयारया ससंशजोधन करतमे हहयमे चक ससंख्यया-988 समे गयाटया ससंख्यया-1892 आवद 'वनकयालकर गयाटया ससंख्यया-2697, 2701 पर चक ्ቚवद्ቖ वकयया गयया, धजनककी मकत्यक कमे उपरयान्त सहयायक चकबन्दद अधधकयारद दयारया वदनयासंक 29.09.2008 कजो नयामयान्तरण आदमेश पयाररत करतमे हहयमे उनकमे स्थयान पर अवभिलमेखोመ मम उनकमे जयायज वयाररस ससंजय ककमयार, बब्लय ककमयार, मककमेश ककमयार, ददपक ककमयार व मजोनय ककमयार पक्ቔगण बमेटय कया नयाम अवभिलमेखोመ मम दजर वकयया गयया हहै। बमेटय कमे उपरजो्ሹ वयाररसोመ समे शदमतद शयासंवत दमेवद दयारया वदनयासंक 29.08.2014 कजो चक ससंख्यया-988 ककी भियवम ्ቅय ककी गयद तथया शदमतद शयासंवत दमेवद समे चकदयार चक ससंख्यया-988 समे वनगरयानदकतयार शद ्ቚमजोद ककमयार एवसं अरववन््ቖ ककमयार दयारया भियवम ्ቅय ककी गयद हहै, धजसकया नयामयान्तरण आदमेश अवभिलमेखोመ मम हजो चककया हहै। इस सस्थवत मम ्ቚश्नगत वयाद मम शद अरववन््ቖ ककमयार व ्ቚमजोद ककमयार कया वहत-वनवहत हजो गयया। सहयायक चकबन्दद अधधकयारद दयारया अनकसयार बहैनयामया नयामयान्तरण आदमेश वदनयासंक 23.02.2017 पयाररत करतमे हहयमे गयाटया ससंख्यया-2191 2192 2193 समे वव्ቅमेतया शदमतद शयासंवतदमेवद कया नयाम वनरस्त कर वनगरयानदकतयार शद ्ቚमजोद ककमयार व अरववन्द ककमयार कया नयाम अवभिलमेखोመ मम दजर वकयया गयया हहै। शद ्ቚमजोद ककमयार व अरववन्द ककमयार दयारया ्ቚश्नगत भियवम कया बहैनयामया अपदलदय न्ययाययालय कमे आदमेश वदनयासंक 09.06.2016 कमे अनकसयार अपनमे हक मम वनस्पयावदत करयायया गयया हहै, वकन्तक अपदलदय न्ययाययालय दयारया शद अरववन्द ककमयार आवद कजो सकनवयाई कया अवसर वदयमे बगहैर आदमेश वदनयासंक 30.06.2017 पयाररत करतमे हहयमे वनगरयानदकतयार कया चक हवयाई ्ቚवद्ቖ कर वदयया गयया हहै, जजो उवचत नहीሻ हहै। ववपकद ससंख्यया-01 कमे चक ससंख्यया-235 कमे अवलजोकन समे स्प्ቖ हहै वक ववपकद कमे मयलजजोत कमे गयाटया मख्यया-2038/15 /17, 2418, 2419/1/3 ककल रकबया 1.9645 हमे0 हहै, धजसकमे सयापमेक ववपकद कया ्ቚथम चक गयाटया ससंख्यया-2038/17.2419 व वदतदय चक गयाटया ससंख्यया-2038/3, 2489, 2192, 2192 व 2419/3 पर ्ቚवद्ቖ वकयया गयया हहै। इससमे स्प्ቖ हहै वक ववपकद ससंख्यया - 01 कजो वनगरयानदकतयार कमे मयलजजोत कमे गयाटया ससंख्यया-2192 पर हवयाई चक ्ቚवद्ቖ वकयया गयया हहै। ववपकद कमे मयलजजोत कमे गयाटया ससंख्यया -2038/15/17 कमे समदप गयाटया ससंख्यया- 2038/25/26 पर बचत असंवकत हहै। यवद वनगरयानदकतयारगण उनककी मयासंग कमे अनकसयार उनककी मयलजजोत कमे गयाटया ससंख्यया- 2192 आवद कजो लमेकर एवसं ववपकदगण "ससंख्यया -01 कया चक उनककी मयलजजोत कमे गयाटया ससंख्यया-2038/15/17 कजो लमेतमे हहयमे गयाटया ससंख्यया -2038 /25/26 पर ्ቚवद्ቖ वकयया जयातया हहै , तजो ववपकद कजो कजोई हयावन नहीሻ हजोगद। वनगरयानदकतयारगण व ववपकदगण ससंख्यया-01 कमे चक मयलजजोत कमे गयाटोመ कजो लमेकर सकववधयानकसयार एवसं जजोत चकबन्दद अधधवनयम मम दद गयद व्यवस्थयाओसं कमे अनकसयार ्ቚवद्ቖ हजो जयायमगमे। वनगरयानदकतयार कमे मयलजजोत कमे गयाटमे सडक समे सटमे हहयमे हह, धजसकमे सम्बन्ध मम मया० उच्च न्ययाययालय इलयाहयाबयाद दयारया ययावचकया ससंख्यया -18820/2001 रयाम्ቚसयाद बनयाम उप ससंचयालक चकबन्दद इलयाहयाबयाद व अन्य मम पयाररत आदमेश वदनयासंक 19.01.2006 मम न्ययाय वनणरय वदयया गयया हहै वक सडक अथवया मकख्यमयागर समे लगमे भियखण्डोመ कजो चक बयाहर कर वदयया जयानया चयावहए। उ्ሹ व्यवस्थया उ्ቈर ्ቚदमेश जजोत चकबन्दद अधधवनयम 1953 धयारया 8-क-धसदयान्तोመ कया वववरण-मकख्य सडक, रयाजमयागर आवद समे लगमे भियखण्डोመ कया चक बयाहर वकयया जयानया-वदनयासंक 26 मई 1981 कजो अधधसयचनया जयारद-चक आवसंटन कमे सम्बन्ध मम वनयत वकयमे गयमे धसदयान्तोመ कया उलसंघन करतमे हहयमे धसदयान्तोመ कया वववरण तहैययार वकयया गयया हहै-सडक व रयाजमयागर समे लगमे भियखण्डोመ कया मयल्ययासंकन वकयया गयया और उन्हम वकसद पर-व्यव्ሹ कजो आवसंवटत कर वदयया गयया-धयाररत वकयया गयया हहै वक सडक समे लगद हहई भियवम कया मयल्ययासंकन नहीሻ वकयया जयानया चयावहए थया. और यवद वकयया हद गयया हहै तजो उसमे मयल खयातमेदयार कजो हद आवसंवटत वकयया जयानया चयावहए थया- धसदयान्तोመ कया उलसंघन कर वदयया गयया। आवसंटन मयान्य नहीሻ वकयया जया सकतया। गयाम बयामनडौलद कमे सम्बन्ध मम उच्च स्तर समे भिद जयासंच उपरयान्त जयासंच मम यह तथ्य जयासंच कममेटद कमे सम्मकख ्ቚकयाश मम आयया हहै वक चकबन्दद ्ቚयाववधयानोመ कया उलसंघन करतमे हहयमे बडडौत समे मकजफ्फरनगर रजोड समे ससंल्ሿ गयाटया कया वववनमय अनकपयात वनधयारररत कर उसपर उडयान चक बनयायमे गयमे हह , उ्ሹ अवनयवमततयाओसं कजो दयर करनमे हमेतक चकबन्दद वनदमेशयालय कमे दयारया अपनमे कयाययारलय कमे प्ቔ ससंख्यया -793/वव०्ቚ०- सया० वदनयासंक 09.01.2018 कमे दयारया वनदरश वनगरत वकयमे गयमे हह। उपरजो्ሹ वववमेचनया कमे आधयार पर स्प्ቖ हहै वक वनगरयानदकतयारगण कमे मयलजजोत कमे गयाटया सडक समे सटमे हहयमे हह, धजन्हमे बन्दजोबस्त अधधकयारद चकबन्दद स्तर पर हवयाई चक ्ቚवद्ቖ कर वदयया गयया हहै तथया ववपकदगण ससंख्यया-01 कजो वनगरयानदकतयारगण कमे मयलजजोत कमे गयाटोመ पर हवयाई चक ्ቚवद्ቖ वकयया गयया हहै, इसधलए वनगरयानदकतयारगण ककी मयासंग पजोषणदय हजोनमे कमे कयारण स्वदकयार हजोनमे यजोग्य हहै। अतयः आदमेश हहआ हहआ वकयः- आदमेश उपरजो्ሹ वववमेचनया कमे आधयार पर शद ्ቚमजोद ककमयार पक्ቔ सकखवदर धससंह व शद अरववन््ቖ ककमयार पक्ቔ श्ययाम धससंह वनवयासदगण गयाम बयामनडौलद परगनया बरनयावया तहसदल बडडौत धजलया बयागपत दयारया ्ቚस्तकत वनगरयानद स्वदकयार ककी जयातद हहै। ममेरमे दयारया तहैययार करयायद गयद चक ससंशजोधन तयाधलकया धजससमे मडौजया बयामनडौलद कमे जजोत चकबन्दद आकयार प्ቔ-23 भियाग-1 कमे चक ससंख्यया- 988, 235 व बचत ्ቚभियाववत हजोतमे हह, स्वदककत ककी जयातद हहै। स्वदककत ससंशजोधन तयाधलकया आदमेश कया असंग जयारद रहमेगद, तदयानकसयार भियवच्ቔ ससंशजोधधत हजो। प्ቔयावलद बयाद आवश्यक कयायरवयाहद दयाधखल दफ्तर हजो । वदनयासंक--29.01.2025 /Sd Illegible अपर धजलयाधधकयारद (वव/रया०)/ उप ससंचयालक चकबन्दद, बगपत ।
10. Perusal of the finding of fact recorded by Deputy Director of Consolidation as well as C.H. Form 23 of the petitioners along with Smt. Shanti Devi it is demonstrated that plot no.2419 /3 is original road side plot of the petitioners and plot no.2192 is original road side plot of Smt. Shanti Devi (Chak holder no.988) from whom respondent nos.3 & 4 are claiming right.

Petitioners has been adjusted on the road side plot of the private respondents and private respondents have been adjusted on the road side plot of the petitioners under the impugned revisional order in order to accommodate both parties to the road side plot. Petitioners are not satisfied with the order impugned as petitioners has been deprived from his original road side plot no.2419/3, as such, fresh consideration of the chak revision is required by Deputy Director of Consolidation in the matter.

Considering the entire facts and circumstances of the case, the impugned revisional order dated 29.1.2025 passed by Deputy Director of Consolidation in Revision No.RST/0181/2024, Computerized Case No.20245411800000181 (Arvind Kumar Vs. Krishn Pal & Others), under Section 48 (1) of U.P.C.H. Act is liable to be set aside and the same is hereby set aside.

The writ petition stands allowed in part and matter is remitted back before respondent no.2/ Deputy Director of Consolidation to decide the aforementioned revision afresh after affording proper opportunity of hearing to the parties, expeditiously preferably within a period of three months from the date of production of certified copy of this order before Deputy Director of Consolidation. It is clarified that the original road side plot no.2419/3 belonging to the petitioners should be allotted in the chak of the petitioners and the original road side plot no.2192 belonging to respondent nos.3 & 4 should be allotted in the chak of respondent nos.3 & 4 while deciding the aforementioned revision as directed above.
