After due deliberations at length, learned counsel for the appellant has prayed for to dismiss the instant second appeal as withdrawn with liberty to resort to appropriate remedy to file First Appeal From Orders under Order XLI Rule 1 (u) C.P.C. against the remand order passed by the first appellate court.
