This application under Section 482 Cr.P.C. has been filed by complainant praying for a direction to the Court below i.e. Additional Chief Judicial Magistrate, Court No.7, Allahabad to decide Criminal Complaint Case No. 191 of 2021 (Krishna Kumar Vs. Rajesh Kumar Sharma) under Section 138 N.I. Act, P.s. Phoolpur, District Allahabad within a time fixed by this Court. At the very outset, the learned A.G.A. has raised a preliminary objection by submitting that the accused has yet not appeared before the court below. In view of above, the prayer made by means of present application is wholly misconceived. As such, present application is liable to be dismissed. When confronted with above, learned counsel for applicant could not overcome the same. As a result, present application fails and is liable to be dismissed. It is, accordingly, dismissed.
