Heard learned counsel for the petitioner, learned Standing Counsel for the State respondents and learned counsel for the Gaon Sabha. By means of present writ petition filed under Article 226 of the Constitution, the petitioner has prayed following relief: "1 issue a writ order or direction in the nature of mandamus directing the learned court below to decide the case no. 01716 of 2020, computerized case no. T202014290501716 (Report Lekhpal v. Shiv Yadav) as expeditiusly as possible, pending in the court of Tehsildar, Tehsil Jakhaniya District Ghazipur within the time stipulated by this Court otherwise the petitioner shall suffer an irreparable loss and injury" Learned counsel for the petitioner submits that the proceeding has already been drawn against the unauthorized encroachers under Section 67 of the U.P. Revenue Code and now the case is registered as case No. T202014290501716. In view of the above, this petition stands disposed of with a direction to the concerned designated respondent to conclude the proceeding pending before him under Section 67 of the U.P. Revenue Code, 2006 within period of two months from the date of receipt of certified copy of this order. It is further provided that the concerned respondent shall follow the procedure prescribed for under the relevant Rules and the Code. Needless to add that such authority shall afford reasonable opportunity of hearing to all the parties concerned and shall also pass a reasoned and speaking order.
