1. Heard Sri Rajesh Chandra Gupta, learned counsel for applicant in the leading application as well as connected application and Sri S.K. Singh, learned AGA for the State.

The leading application under Section 482 Cr.P.C. has been filed by the applicant to quash the summoning order dated 01.02.2021 and order dated 22.8.2023 passed by Judicial Magistrate, Jewar, Gautam Budh Nagar as well as entire proceedings of Complaint Case No.23 of 2021 (Jagdish Garg Vs. Nelf Cosmetics (India) Pvt. Ltd. and others), under Section 138 N.I. Act, District Gautam Budh Nagar, pending in the court of Judicial Magistrate, Jewar, Gautam Budh Nagar.

The connected application under Section 528 BNSS has been filed by the applicant to quash the summoning order dated 01.02.2021 and order dated 22.8.2023 passed by Judicial Magistrate, Jewar, Gautam Budh Nagar as well as entire proceedings of Complaint Case No.24 of 2021 (Amit Kumar Garg Vs. Nelf Cosmetics (India) Pvt. Ltd. and others), under Section 143A N.I. Act, District Gautam Budh Nagar, pending in the court of Judicial Magistrate, Jewar, Gautam Budh Nagar.

4. In view of the order which being proposed to passed notice had not been issued to the opposite party No.2.

5. The facts of the leading application are that a complaint was lodged by the opposite party no.2 agaisnt the applicant under Section 138 of N.I. Act with an allegation that the applicant in order to discharge his liability had drawn two cheques bearing No.000821 dated 22.10.2020 for Rs.2,50,000/- and another cheque bearing No.000820 dated 20.10.2020 for Rs.30,00,000/- which on presentation in the bank came to be dishonoured on 25.11.2020 followed by statutory demand notice and the complaint under Section 138 of N.I. Act. Pursuant to the applicant came to be summoned under Section 138 of N.I. Act on 01.02.2021. Thereafter an application came to be preferred on 28.8.2021 by the opposite party No.2 for awarding of Rs.10,00,000/- interim compensation under Section 143A of N.I. Act which was objected by the applicant while filing a reply on 22.10.2021 and the said application came to be allowed on 22.8.2023 by the Court of Judicial Magistrate, Jewar, Gautam Budh Nagar in Complaint Case No.23 of 2021 (Jagdish Garg Vs. Nelf Cosmetics (India) Pvt. Ltd. and others).

As regards the connected application is concerned a complaint stood lodged by the opposite party No.2 against the applicant on 6.1.2021 with an allegation that the applicant herein in order to discharge his liability had drawn a cheque bearing No.000819 dated 25.10.2020 for Rs.30,00,000/- which came to be dishonoured on 25.11.2020 followed by statutory demand notice and the applicant came to be summoned on 01.02.2021 under Section 138 of N.I. Act. An application under Section 143A came to be preferred by the opposite party No.2 for awarding of interim compensation to the tune of 20% on 23.8.2021 which was objected by the applicant by filing his reply on 22.10.2021 and the same came to be allowed on 22.8.2023 by the Court of Judicial Magistrate, Jewar, Gautam Budh Nagar in Complaint Case No.24 of 2021 (Amit Kumar Garg Vs. Nelf Cosmetics (India) Pvt. Ltd. and others) directing the payment of interim compensation of Rs.5,00,000/-

7. Questioning the summoning order dated 01.02.2021 and order dated 22.8.2023 awarding interim compensation under Section 143A of N.I. Act both the applications have been preferred.

Sri Rajesh Chandra Gupta, learned counsel for applicant as per the instructions received from his client has made a statement that he has confining his relief to the challenged raised to the order dated 22.8.2023 passed by the court below awarding interim compensation and he is foreclosing his right to challenge the summoning order dated 1.2.2021 passed in the leading and connected application. He further submits that orders dated 22.8.2023 subject matter of challenge in leading and the connected application interim compensation under Section 143A of N.I. Act cannot be sustained as the same is not as per the mandate of the Hon'ble Apex Court in Rakesh Ranjan Srivastava Vs. State of Jharkhand passed in Crl. Appeal No.741 of 2024 decided on 15.3.2024. Submission is that the Court was under obligation to have prima facie evaluated the merits of the case set out by the complainant and the merits of the defence pleaded by the accused and the reply to the application, the financial distress of the accused and in case, the Court decides to pay interim compensation then the quantum and also consider the aspect relating to nature of transaction relationship of parties between the accused and the parties. He submits that said exercise is completely lacking. According to him the order be set aside and the matter be remitted back to the court below.

9. I have heard these submission so made across the bar and perused the record carefully.

The order dated 22.8.2023 passed in the leading and connected application which is as under:- (Leading Application) "ददिननाሪक-22.08.2023 पतनवलली पपेश हहई। पपुकनर पर उभयप्ቌ मय दवदनन अधधिवकन उपससቝኌत। ्ቚसतपुत पररवनदि पररवनदिली दनरन दिनधखिल ्ቚनቝኌरनन पत अन्तररत धिनर-143 क एन.आई.एक्ट ददिननाሪदकत 23.08.2021 कपे सपुनवनई/दनसतनरण हपेतपु दनयत हहै। अदभयपुक दनरन ्ቚसतपुत ्ቚनቝኌरनन पत पर आपधቈኌ दिनधखिल करतपे हहए कቝኌन दकयन हहै दक ्ቚसतपुत ्ቚनቝኌनन पत खिनररज दकयपे जननपे ययोग्य हहै। धिनर-143 क एन.आई.एक्ट मम यह ्ቚनवधिनन ददियन रयन हहै दक चचक ककी कपुल ्ቚश्नरत धिनरनदश कन 20 ्ቚदतशत तक अन्तररम ्ቌदतपपूदतर कपे रूप मम पररवनदिली कयो ददिलनयन जन सकतन हहै। ्ቚसतपुत पररवनदि मपु० 55,00,000/- रूपयपे धिनरनदश कपे चचक सपे साሪबाሪधधित हहै। न्यनयनलय कपे मत मम पररवनदिली कन ्ቚनቝኌरनन पत सवलीकनर दकयपे जननपे ययोग्य हहै। आदिपेश पररवनदिली दनरन ्ቚसतपुत ्ቚनቝኌरनन पत अन्तररत धिनर-143 क एन.आई. एक्ट सवलीकनर दकयन जनतन हहै। तद्नपुसनर आपधቈኌ दनसतनररत ककी जनतली हहै। अदभयपुक कयो आदिपेदशत दकयन जनतन हहै दक वह पररवनदिली कयो अन्तररम ्ቌदतपपूदतर कपे रूप मम मपु० 10,00,000/- रूपयपे (पनाሪच लनखि रूपयपे) दनयत दतधቝኌ तक अदिन कपेरतन सपुदनसश्चत करम। उक वनदि कन दनसतनरण यददि पररश्वनदिली कपे प्ቌ मम नहीሻ हयोतन हहै तयो पररवनदिली कयो इस आदिपेश कपे अनपुसनर ददिलनई रयली धिनरनदश अदभयपुक कयो वनपस करपेरन। पतनवलली वनसतपे अदቇኌम कनयरवनहली ददिननाሪक 01.09.2023 कयो पपेश हयो। ददिननाሪक-22.08.2023 (ननद़ቛम अकबर) न्यनदयक मधजसटटपेट, जपेवर रगौतमबपु्ቍनरर।" (Connected Application) "ददिननाሪक-22.08.2023 पतनवलली पपेश हहई। पपुकनर पर उभयप्ቌ मय दवदनन अधधिवकन उपससቝኌत। ्ቚसतपुत पररवनदि पररवनदिली दनरन दिनधखिल ्ቚनቝኌरनन पत अन्तररत धिनर-143 क एन.आई.एक्ट ददिननाሪदकत 23.08.2021 कपे सपुनवनई/दनसतनरण हपेतपु दनयत हहै। अदभयपुक दनरन ्ቚसतपुत ्ቚनቝኌरनन पत पर आपधቈኌ दिनधखिल करतपे हहए कቝኌन दकयन हहै दक ्ቚसतपुत ्ቚनቝኌनन पत खिनररज दकयपे जननपे ययोग्य हहै। धिनर-143 क एन.आई.एक्ट मम यह ्ቚनवधिनन ददियन रयन हहै दक चचक ककी कपुल ्ቚश्नरत धिनरनदश कन 20 ्ቚदतशत तक अन्तररम ्ቌदतपपूदतर कपे रूप मम पररवनदिली कयो ददिलनयन जन सकतन हहै। ्ቚसतपुत पररवनदि मपु० 30,00,000/- रूपयपे धिनरनदश कपे चचक सपे साሪबाሪधधित हहै। न्यनयनलय कपे मत मम पररवनदिली कन ्ቚनቝኌरनन पत सवलीकनर दकयपे जननपे ययोग्य हहै। आदिपेश पररवनदिली दनरन ्ቚसतपुत ्ቚनቝኌरनन पत अन्तररत धिनर-143 क एन.आई. एक्ट सवलीकनर दकयन जनतन हहै। तद्नपुसनर आपधቈኌ दनसतनररत ककी जनतली हहै। अदभयपुक कयो आदिपेदशत दकयन जनतन हहै दक वह पररवनदिली कयो अन्तररम ्ቌदतपपूदतर कपे रूप मम मपु० 5,00,000/- रूपयपे (पनाሪच लनखि रूपयपे) दनयत दतधቝኌ तक अदिन कपेरतन सपुदनसश्चत करम। उक वनदि कन दनसतनरण यददि पररश्वनदिली कपे प्ቌ मम नहीሻ हयोतन हहै तयो पररवनदिली कयो इस आदिपेश कपे अनपुसनर ददिलनई रयली धिनरनदश अदभयपुक कयो वनपस करपेरन। पतनवलली वनसतपे अदቇኌम कनयरवनहली ददिननाሪक 01.09.2023 कयो पपेश हयो। ददिननाሪक-22.08.2023 (ननद़ቛम अकबर) न्यनदयक मधजसटटपेट, जपेवर रगौतमबपु्ቍनरर।"

A close reading of the aforesaid order, the order granting interim compensation to the opposite party no.2/complainant would reveal that the same has been awarded on mere asking without adhering to the mandates as stipulated by the Hon'ble Apex Court in Rakesh Ranjan Srivastava (Supra). The para 19 of the following was observed as under:- "19. Subject to what is held earlier, the main conclusions can be summarised as follows: a. The exercise of power under sub-section (1) of Section 143A is discretionary. The provision is directory and not mandatory. The word "may" used in the provision cannot be construed as "shall." b. While deciding the prayer made under Section 143A, the Court must record brief reasons indicating consideration of all relevant factors. c. The broad parameters for exercising the discretion under Section 143A are as follows: i. The Court will have to prima facie evaluate the merits of the case made out by the complainant and the merits of the defence pleaded by the accused in the reply to the application. The financial distress of the accused can also be a consideration. ii. A direction to pay interim compensation can be issued, only if the complainant makes out a prima facie case. iii. If the defence of the accused is found to be prima facie plausible, the Court may exercise discretion in refusing to grant interim compensation. iv. If the Court concludes that a case is made out to grant interim compensation, it will also have to apply its mind to the quantum of interim compensation to be granted. While doing so, the Court will have to consider several factors such as the nature of the transaction, the relationship, if any, between the accused and the complainant etc. v. There could be several other relevant factors in the peculiar facts of a given case, which cannot be exhaustively stated. The parameters stated above are not exhaustive."

Since the aforesaid exercise regarding prima facie evaluation of the case complainant and the financial distress of the case quantum and other factors are completely leading thus the order dated 22.8.2023 passed by the court below in subject matter of challenge in both the applications cannot be sustained. Accordingly, application is decided in the following terms: A. The order dated 22.8.20230 passed in Complaint Case No. 23 of 2021 (Jagdish Garg Vs. Nelf Cosmetics (India) Pvt. Ltd. and others) in leading application and in connected application and order dated 22.8.2023 passed in Complaint Case No. 24 of 2021 (Jagdish Garg Vs. Nelf Cosmetics (India) Pvt. Ltd. and others) passed by Court of Judicial Magistrate, Jewar, Gautam Budh Nagar, Amroha are set aside. B. The matter stands remitted back to the court below to pass a fresh order strictly in accordance with law. C. For early disposal the certified copy of the orders be submitted by the applicant (parties) by 5.9.2025 before the court below.

13. The court below shall pass an order strictly in accordance with law.
