By means of this petition filed under Article 227 of the Constitution, petitioner has prayed for expeditious disposal of Case No. 1099 of 2013, Kamlesh Kumar v. Smt. Reena Devi instituted under Section 13(1) of the Hindu Marriage Act, 1955. Learned counsel for the petitioner submits that the opposite party has appeared and filed written statement. Considering the facts and circumstances of the case, more specially the fact that it is a matrimonial dispute, the present petition is disposed of with direction to the court concerned to endeavour to ensure that the matrimonial case shall be disposed of within a statutory period prescribed for under Section 21-B of Hindu Marriage Act, 1955 without any unnecessary adjournment to either of the parties. It is clarified that in the event, this order could not be carried out within the time frame fixed for any technical reason, then for such delay in disposal of the appeal and pendency thereof itself shall ordinarily not be a ground sufficient enough to fasten the authority concerned with personal liability of contempt.
