Heard Sri Subodh Kumar Rai, learned counsel for the petitioner and Sri Suresh Singh, learned counsel for the contesting respondents. By means of this writ petition filed under Article 226 of the Constitution, the petitioner has prayed for payment of post- retirement dues like gratuity, leave encashment and arrears along with interest. Learned counsel for the contesting respondents has assured that the post-retirement dues are likely to be released in favour of the petitioner very soon. Be that as it may, since now bifurcation process of U.P. Jal Nigam into two departments has been finalized and process is on to make payment of post retirement dues, it is hereby directed that entire post retirement dues of the petitioner shall be paid to the petitioner within a period of three months from the date of production of certified copy of this order, failing which, the interest over and above such delayed payment as admissible in law, shall also be paid to the petitioner by the respondents. It is also provided that in case if in the matter of payment of interest upon delayed post retirement dues, the petitioner has been discriminated against, he shall have liberty to make representation in that behalf within three weeks from today and in the event any such representation is made, the same shall be disposed of within the aforesaid period.
