Heard learned counsel for the applicants and learned A.G.A. for the State.
By means of the present application under Section 482 Cr.P.C., the applicant has sought for a suitable direction to the learned Additional Principal Judge, Family Court-II, Kanpur Nagar to expedite the proceedings of Case No. 1851 of 2023 (Smt. Madhuri Giri & Others Vs. Rakesh Giri), under Sections 127 Cr.P.C., and to decide the same within time stipulated by this Court, which is pending before the aforesaid court.
It is submitted by learned counsel for the applicants that applicants were awarded maintenance vide order dated 29.11.2017. Thereafter, in the month of August, 2023 the applicants have filed an application under Section 127 Cr.P.C. for enhancement of maintenance but no progress has been made in the proceedings so far. Learned counsel further submits that a direction may be issued to the concerned court to decide the aforesaid case within specific time frame.
In view of aforesaid, the concerned Family Court is directed to expedite the proceedings of the aforesaid case and to decide the same as early as possible, preferably within a period of seven months from the date of production of copy of this order before the court concerned, provided there is no legal impediment.
